$2.67B BCBS Settlement: Eligibility, Payment Amounts, and Timing

The Blue Cross Blue Shield settlement payout began reaching claimants in May 2026, drawn from a $2.67 billion antitrust class action fund. If you filed a claim by the November 5, 2021 deadline and held BCBS coverage during the class period, you’re eligible for a share. The estimated average payment is about $333, though individual amounts vary based on premiums paid and total valid claims.¹

Who Qualifies for a Payment

Eligibility depends on when you held Blue Cross Blue Shield coverage and what kind. The class covers individuals, insured groups (employers, unions, retiree groups, and similar organizations), and self-funded accounts that purchased or received BCBS health insurance or administrative services during the class period.

For individuals and insured groups, the class period runs from February 7, 2008 through October 16, 2020.
For self-funded (ASO) accounts, the period is shorter: September 1, 2015 through October 16, 2020.²

Several groups are excluded. Government accounts — federal, state, county, and municipal entities, along with Native American tribes — are outside the class. Medicare Advantage policies are excluded, though Medicare Supplemental policies are included. Dependents, beneficiaries, and non-employees cannot receive direct payments, though they benefit from the settlement’s business-practice reforms.²

You also had to file a claim by the November 5, 2021 deadline. About six million claims were filed against a class of roughly 100 million members.³⁴ If you didn’t file, you cannot collect from this settlement.

How Much You’ll Receive

After $667 million in attorneys’ fees and roughly $100 million in administration costs came out of the $2.67 billion fund, about $1.9 billion remained for distribution.⁵ That net amount was split into two independent pools: $1.78 billion for individuals and insured groups, and $120 million for self-funded (ASO) accounts.²

Your individual payout depends on three things:

The premiums or administrative fees you paid during the class period.
Whether you were fully insured or self-funded (each pool is calculated separately).
The total number of valid claims sharing the pool.

The estimated average payment is approximately $333.¹ One threshold to note: if your calculated payment comes to $5 or less, you will not receive a distribution at all.²

If You See an “ASO” Amount on Your Notice

ASO stands for Administrative Services Only. It means you had a self-funded plan, where an employer paid healthcare costs directly and paid BCBS an administrative fee to manage claims. On your claim form, a $0 in the premium column with a dollar figure in the ASO column indicates you were self-funded rather than fully insured. The claims administrator uses those administrative fees to calculate your share of the self-funded pool the same way it uses premium data for fully insured claimants.²

When and How Payments Arrive

JND Legal Administration, the court-appointed claims administrator, began sending initial distribution payments in May 2026.⁶⁷⁸

JND is sending out determination notices by email and postcard on a rolling basis, so not every claimant will receive theirs at the same time.²

Checking Your Claim Status

You can look up your claim through the official portal at bcbssettlement.com/claimstatus. The portal shows whether your claim has been processed and, once determinations are issued, your calculated payment amount.

If you receive a determination notice and disagree with the premium or ASO figures used to calculate your payment, you have 30 days from the date of your notice to submit documentation disputing the amount.² Miss that window and the calculated figure stands.

If You’re an Employer Who Received a Payment

Employers who receive settlement funds face an obligation individual claimants do not. If any portion of your payment is attributable to employee premium contributions, those funds are considered “plan assets” under the Employee Retirement Income Security Act (ERISA) and must be used exclusively for the benefit of plan participants.¹⁰

When exact contribution data isn’t available, the settlement applies default splits:

Single coverage: 82% employer / 18% employee.
Family coverage: 75% employer / 25% employee.

Employers who receive proceeds on behalf of employees who did not file individual claims hold the employee share as fiduciaries. Permissible uses include issuing refunds, implementing premium holidays, or enhancing plan benefits. Because the Department of Labor has not issued guidance specific to this settlement, employers have been advised to follow existing guidance on Medical Loss Ratio rebates under the Affordable Care Act as a framework.³

Why Payments Are Arriving Now

The settlement resolves In re: Blue Cross Blue Shield Antitrust Litigation, MDL 2406, a consolidated case in the Northern District of Alabama alleging that the BCBS Association and more than 30 member plans violated the Sherman Antitrust Act by dividing the country into exclusive territories and restricting competition among Blue plans.¹¹¹² The defendants denied wrongdoing but agreed to settle in October 2020.¹³

Judge R. David Proctor granted final approval on August 9, 2022, but four separate appeals from objectors — including Home Depot — delayed distribution. The Eleventh Circuit affirmed the settlement on October 25, 2023, and the U.S. Supreme Court declined to hear the case on June 24, 2024, clearing the last obstacle.¹⁰¹⁴ That’s why claims filed in 2021 are only paying out now.

One boundary worth noting: a separate $2.8 billion settlement was reached with healthcare providers (hospitals, doctors, and clinicians) in October 2024 and approved in August 2025. That is a different class and a different fund; it does not affect subscriber payouts under the $2.67 billion settlement described here.¹⁵¹⁶
