Aaliyah’s marriage to R. Kelly took place on August 31, 1994, in a secret ceremony that relied on a fake identification card listing the 15-year-old singer as 18. Her parents had the marriage annulled through Cook County court in February 1995. Nearly three decades later, the bribe Kelly paid to obtain that fraudulent ID became the first racketeering act federal prosecutors proved against him, contributing to the 30-year sentence he received in 2022.
How the Marriage Was Arranged
The marriage license application was filed through a satellite location of the Cook County Clerk’s Office. On the form, Aaliyah’s birth date appeared as January 16, 1976, which would have made her 18. Her real birth date was January 16, 1979. She was 15.
The three-year discrepancy was not a clerical mistake. Federal prosecutors later established that on August 30, 1994, Kelly arranged for a bribe to an Illinois government employee to produce a fake identification card for Aaliyah. The clerk’s office, presented with what looked like a legitimate ID, issued the license. Both parties signed the application, certifying the information as accurate. The ceremony took place the next day.
Why the Marriage Was Illegal Under Illinois Law
Illinois law requires a county clerk to verify that both applicants meet the state’s age rules before issuing a license. Anyone 18 or older can marry without additional permission. Applicants who are 16 or 17 need written consent from both parents or a legal guardian, or a court order approving the marriage.1Illinois General Assembly. 750 ILCS 5/203 – License to Marry
No provision in Illinois law permits anyone under 16 to marry under any circumstances. Parental consent cannot change that. Judicial approval cannot change that. At 15, Aaliyah was categorically ineligible, which meant the license should never have been issued regardless of what the paperwork claimed.
The Annulment
Aaliyah’s parents moved quickly once they learned of the marriage. Illinois law provides specific grounds for declaring a marriage invalid: fraud involving the essentials of the marriage, a 16- or 17-year-old marrying without parental consent or judicial approval, or a marriage otherwise prohibited by law.2Illinois General Assembly. 750 ILCS 5/301 – Declaration of Invalidity, Grounds
Aaliyah’s case touched more than one of those grounds. She was under 16, which made the marriage prohibited outright. A fake ID had been used to misrepresent her age, which was fraud going to an essential of the marriage. And her parents had never consented. The petition described the marriage as fraudulent and stated that Aaliyah was of sound mind and not pregnant.
In February 1995, a Cook County judge granted the petition. A declaration of invalidity is not a divorce. It treats the marriage as though it never legally existed, and the record was vacated accordingly.
The Non-Disclosure Agreement
After the annulment, Kelly’s legal team secured a non-disclosure agreement from the Haughton family. The NDA kept Aaliyah and her parents from publicly discussing the marriage or the circumstances behind it. Aaliyah herself never spoke about it in interviews before her death in a plane crash in August 2001.
The agreement surfaced during Kelly’s 2022 federal trial, where prosecutors introduced it as evidence. Aaliyah was identified in court filings as “Jane Doe #1.”
How the Marriage Became Part of the Federal Case
The fraudulent license carried no serious legal consequences for Kelly at the time. That changed 25 years later. In December 2019, federal prosecutors in Brooklyn added a bribery charge to an existing racketeering indictment, accusing Kelly of paying an Illinois government employee to create the fake ID used to obtain the license. According to the indictment, Kelly arranged the bribe because he believed Aaliyah was pregnant and thought marriage would shield him from criminal liability.
Prosecutors designated the bribery scheme “Racketeering Act One,” placing the 1994 marriage at the foundation of the pattern of criminal conduct they alleged. In June 2022, a Brooklyn jury convicted Kelly on racketeering and sex trafficking charges, and he was sentenced to 30 years in federal prison.3ICE. R. Kelly Sentenced to 30 Years in Prison
A separate federal trial in Chicago produced convictions on three counts of producing child pornography and three counts of enticing a minor to engage in criminal sexual activity, adding a 20-year sentence.4U.S. Department of Justice. Robert Kelly Sentenced to 20 Years That case did not center on Aaliyah. The two sentences run partially concurrently, but together they ensure Kelly will spend decades in prison. The 1994 marriage, once buried by an annulment and an NDA, ended up as one of the earliest documented acts in the case that put him there.
