Who Qualifies
The class covers current or former Aetna members anywhere in the United States who received a prerecorded voicemail from AbleTo on their cellular phone during the class period. Excluded are AbleTo employees, officers, directors, and affiliates, the judges assigned to the case and their close relatives, plaintiffs’ counsel and their staff, and anyone who filed a timely opt-out.2ClassAction.org. Eligibility does not follow from having Aetna coverage alone. You need to have received a prerecorded voicemail from AbleTo on your cell phone during that window. Landline calls, live calls, and calls to non-Aetna members are outside the class.
How Much You Get
Each class member with an approved claim receives a one-time $23 payment. Only one claim is honored per person no matter how many calls or voicemails you received.3ClassAction.org. When Payments Are Expected
The final fairness hearing is set for July 28, 2026, at 1:00 p.m. in Tampa Courtroom 12B. If the judge grants final approval and no appeals delay the process, checks are expected to be mailed to approved claimants about 56 days after that hearing.1ClaimDepot. The Claim Deadline Has Passed
The deadline to file a claim, opt out, or object was June 3, 2026. If you did not submit a claim by that date, you are not on track to receive a payment from this settlement. If you filed a timely claim, no further action is required. The administrator will process approved claims after the court rules.

The complaint brought claims under the federal Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (FTSA), both of which allow $500 per violation and $1,500 per willful violation.5Florida Legislature.
