What You Can Claim
The settlement offers two payment tracks, and you can be eligible for both.
- Documented loss payment up to $5,000. This covers out-of-pocket costs tied to the breach: bank fees, phone charges, postage, gas for local travel, and fees you paid for credit reports, credit monitoring, or identity theft insurance. - Cash fund payment. Every class member who files a valid claim gets a pro rata share of whatever is left in the fund after documented losses, attorney fees, litigation costs, service awards, and administration are paid. Who Is Eligible
The class includes all living U.S. residents whose personal information was potentially compromised in the breach, including everyone who received a notice from Absolute Dental about the incident. What Happens If You Do Nothing
If you are in the class and do not opt out, you are bound by the settlement whether or not you file a claim, meaning you cannot sue Absolute Dental separately over the breach. Opting out preserves your right to sue but forfeits any payment. The release covers Absolute Dental only; it does not release claims against Judge Consulting, Inc., the IT provider whose account was used in the intrusion.6Absolute Data Settlement. What Was Exposed
Between February 19 and March 5, 2025, an unauthorized third party accessed Absolute Dental’s network through a Judge Consulting account, according to notification letters that described “the inadvertent execution of a malicious version of a legitimate software tool.”7Montana Department of Justice.
