Adrian Peterson Lawsuit: $5.2M Loan, $8.3M Judgment, Asset Seizures

The Adrian Peterson lawsuit that has followed the former NFL MVP for years traces back to a single $5.2 million loan he guaranteed in 2016. After Peterson defaulted, a New York judge entered an $8.3 million judgment against him in January 2021, and with interest accruing at more than $2,200 a day, the balance owed to lender DeAngelo Vehicle Sales has since climbed to an estimated $12 million or more.¹²

The Loan Behind the Lawsuit

In October 2016, Peterson borrowed $5.2 million from DeAngelo Vehicle Sales, a Pennsylvania-based lender. The loan was arranged by his then-financial advisor Jeff Wiseman for a company co-owned by Peterson, Wiseman, and a third partner. Peterson was the majority owner and personally guaranteed the debt.²

Most of the money went to clear other debts. About $3.2 million repaid Thrivest Specialty Funding, described in court filings as a “payday lender for professional athletes,” and another $1.34 million went to Crown Bank.³ Peterson had treated the loan as an advance against an $18 million contract option with the Minnesota Vikings. The Vikings declined that option in 2017, and the anticipated payday never arrived.⁴

The Default and $8.3 Million Judgment

DeAngelo Vehicle Sales sued Peterson in New York in 2018, claiming $6.6 million with interest and fees.⁵ The parties reached a settlement in August 2019 requiring Peterson to pay $25,000 on October 18, another $25,000 on October 31, a $2.25 million lump sum on November 11, and a further $25,000 once the Washington Football Team picked up his 2020 option.⁶

Peterson paid $165,000 in total and missed the $2.25 million installment.⁷ The settlement carried an acceleration clause: a missed payment meant Peterson would not contest a judgment for the full outstanding balance. DeAngelo invoked it. On January 13, 2021, Judge Paul Wojtaszek of the Erie County Supreme Court in New York entered a judgment of $8,268,426.21, with daily interest continuing to run.¹ A court-appointed receiver reported in mid-2024 that Peterson had made no payments against the judgment.²

Asset Seizures and the Memorabilia Auction

With the judgment unpaid, DeAngelo turned to Texas courts to enforce it. Attorney Robert Berleth was appointed receiver and directed to locate and seize Peterson’s assets, focusing on his home in Missouri City, Texas, and several storage units.⁸ In August 2023, Berleth filed suit alleging that Peterson and his wife were using connected companies to conceal assets and had transferred ownership of the storage units to another person’s name. Peterson denied the allegations and said he was financially stable.⁹

The fight went public in February 2024, when Texmax Auctions listed nearly 1,000 items attributed to Peterson, including his 2007 Rookie of the Year and 2012 NFL MVP trophies, game-worn jerseys, and game balls.⁹ Peterson posted a video saying he had not authorized the sale and that the auction company had accessed his storage units under false pretenses.¹⁰ The auction was suspended hours before closing, with the auctioneer citing a “legal matter.”¹¹

In September 2024, a Houston judge escalated enforcement, ordering Fort Bend County constables to accompany Berleth to Peterson’s Missouri City home to seize assets and “keep the peace and prevent interference with the receiver’s duties.” By that point the total debt had reached an estimated $12 million to $12.5 million.¹²⁸

How Peterson Has Defended Himself

Peterson’s representatives at Entertainers & Athletes Group have framed the debt as the product of bad advice from Wiseman, who they say assured Peterson the business venture would repay the loan and that no personal funds would be needed.¹³ EAG CEO Denise White said “every effort to resolve this issue has been rejected” and that settlement attempts have been “rebuffed” by the creditor. EAG characterized the interest rate as “loan sharking.”² Peterson’s attorney Chase Carlson said in 2019 that the running back had been “trusting the wrong people” and was “taken advantage of by those he trusted.”³

According to Peterson’s own representatives, Wiseman has not faced financial or legal responsibility in connection with the loan.² Peterson has separately pursued arbitration against Morgan Stanley Wealth Management, alleging a broker gave him bad investment advice that helped deplete his fortune.¹⁴ Peterson has not filed for bankruptcy.⁸

Other Creditors in the Background

The DeAngelo judgment is the largest of Peterson’s known debts, but not the only one. A Maryland judge ordered him to pay $2.4 million to Democracy Capital Corp. in July 2019.¹⁵ A Minnesota court ordered him to pay an outstanding $600,000 balance to Crown Bank in 2018.¹⁶ Thrivest, which was paid off with proceeds of the DeAngelo loan, later assigned its claim on Peterson’s insurance policy to DeAngelo Vehicle Sales.¹⁷

Where Things Stand Now

As of late 2025, the DeAngelo Vehicle Sales debt remains unresolved, with the total estimated between $11 million and $13 million including accrued interest and attorney fees. In September 2025, a Houston judge denied a motion by Berleth to sell Peterson’s 2007 BMW, ruling that Peterson had the right to designate the vehicle as exempt property under Texas debt collection law. The broader collection effort continues, and the memorabilia auction remains suspended.¹⁸
