The ADT Solar lawsuit landscape has two distinct sides: a California wage-and-hour class action brought by former employees that is heading toward final approval in December 2025, and a much larger body of homeowner claims over defective installations, unhonored warranties, and misleading sales practices that intensified after ADT announced in January 2024 that it was exiting residential solar entirely. If you bought a system from ADT Solar or SunPro Solar, or worked for either company in California, the options open to you depend on which category you fall into.
What Homeowners Are Suing ADT Solar Over
The Better Business Bureau profile for ADT Solar lists 569 complaints filed in the last three years, most of them concerning customer service (392), followed by service or repair issues (104) and sales and advertising problems (35). The claims homeowners have brought or explored fall into a handful of recurring categories:
- Defective installation and property damage, including roof penetrations that cause leaks, panels positioned in ways that prevent effective charging, and inverter or hardware failures.
- Misrepresentation and fraud tied to sales pitches about energy savings, federal tax credits, and contract terms.
- Breach of contract and warranty for failure to honor workmanship warranties, maintenance commitments, and production guarantees originally signed under SunPro or ADT Solar.
- Predatory sales and financing practices, including high-pressure door-to-door sales, confusing loan paperwork, and inflated dealer fees.
- Consumer protection statute claims under state deceptive trade practices laws, and in some cases under the Telephone Consumer Protection Act for allegedly illegal telemarketing calls.2Kneupper & Covey. Can I Sue Sunpro Solar
Homeowners have also reported that solar liens placed on their property have complicated home sales and refinancing.
Warranties After ADT Left the Solar Business
When ADT announced the exit, a company representative told CNET that the 25-year limited workmanship warranty and 25-year Power Production Guarantee in customer contracts “will remain in place,” and that manufacturer warranties on panels, inverters, and racking would also continue.3CNET. Your Solar Company Went Out of Business. Now What? What ADT is actually doing now is narrower than that statement suggested.
ADT’s help page states the company is “no longer able to support” warranty service requests and directs customers to contact equipment manufacturers directly for hardware failures. ADT characterizes any previous assistance with those requests as having been “a courtesy to customers even though it was outside of our contractual obligation.”4ADT. ADT Solar Equipment and Service
The Power Production Guarantee is a different story. ADT says the guarantee remains active: if your system produces less than 95 percent of the contracted annual estimate, adjusted for degradation, you can request a review and receive a payout of $0.10 per kilowatt-hour of the shortfall.4ADT. In one case, ADT reviewed a customer’s production from August 2022 through August 2023 and issued a payout of $1,030. In a May 2025 response, the company stated it “affirms its commitment to honoring the Power Production Guarantee” so long as contract terms have not been voided.5Better Business Bureau. Whether You Can Sue or Must Arbitrate
ADT acquired SunPro rather than buying only its assets, so homeowners with original SunPro contracts generally retain the right to assert claims against ADT Solar as the successor entity. Under the FTC’s Holder Rule and state analogues, you may be able to raise the same defenses and claims against the current contract holder that you had against SunPro. Some consumer attorneys have argued that this rule also allows homeowners to stop making loan payments to solar lenders if the system is not functioning as promised.2Kneupper & Covey. Whether you can actually file in court or must go through arbitration depends on the specific terms of your original contract. Pull the paperwork you signed at installation and look for an arbitration clause before choosing a path.
The California Employee Class Action
Former ADT Solar employees in California have their own case moving through the courts. Brandon Lewis and Karl DiTommaso v. ADT Solar LLC, et al., Case No. CIVSB2317667, was filed on July 31, 2023, in the Superior Court of California, County of San Bernardino. The defendants are ADT Solar LLC and Marc Jones Construction, LLC, which did business as Sunpro Solar, Buildpro, and Energy Pro.6ILYM Group. Lewis v. ADT Solar Settlement Agreement
The complaint alleges that ADT Solar failed to pay minimum and overtime wages, denied meal and rest periods, did not timely pay final wages upon separation, issued inaccurate wage statements, and failed to reimburse employees for business expenses. Settlement Terms
After a March 26, 2024, mediation, the parties agreed to a gross settlement fund of $225,000. The court granted preliminary approval on August 14, 2025.7ILYM Group. Lewis et al. v. ADT Solar LLC Settlement Administration The allocation:
- Attorney fees of up to 33 percent ($74,250), plus litigation expenses of up to $15,189.73.8ILYM Group. Lewis v. ADT Solar Class Notice
- Service payments of up to $5,000 for each of the two named plaintiffs.
- Administration costs of up to $7,950, handled by ILYM Group, Inc.
- PAGA penalties of $20,000, with 75 percent ($15,000) going to the California Labor and Workforce Development Agency and 25 percent ($5,000) split among aggrieved employees.

Who Is Eligible and What to Do
The class covers all hourly, non-exempt employees who worked for ADT Solar in California between February 3, 2019, and May 15, 2024. PAGA aggrieved employees are those who worked at least one day between January 10, 2023, and May 15, 2024. No claim form is required. The administrator calculates each share from payroll records and mails a check. If you think your recorded workweeks are wrong, contact ILYM Group within 60 days of receiving your notice. To opt out, submit a written exclusion request within the same window. The response deadline is November 11, 2025, and the final approval hearing is scheduled for December 15, 2025, at 8:30 a.m. in San Bernardino Superior Court.7ILYM Group. Lewis et al. v. Why ADT Solar Exited the Business
ADT entered residential solar by acquiring SunPro Solar, a Mandeville, Louisiana installer founded by Marc Jones, in a deal that closed on December 9, 2021. The segment lost money quickly. ADT had already closed 22 of its 38 solar branches before the formal exit.12Solar Power World.
