Aiden Fucci’s Father: Jason Fucci’s Record and Letter to the Judge

Aiden Fucci’s father is Jason Michael Fucci, the biological father of the Florida teenager who pleaded guilty to the first-degree murder of 13-year-old Tristyn Bailey. Jason did not live with Aiden at the time of the killing, has a criminal record of his own dating back two decades, and became publicly known in the case largely through a letter he and his wife submitted to the sentencing judge asking for mercy.

Who Jason Fucci Is

Jason Michael Fucci is Aiden’s biological father. At the time of the May 2021 murder, Aiden lived with his mother, Crystal Lane Smith. Jason had remarried, and his wife Yasmin Fucci is Aiden’s stepmother.¹

References in the letter Jason later sent the court to “our weekend” and to taking the children tubing on May 1, 2021, suggest he had a shared custody or regular visitation arrangement with Smith. Aiden has two brothers and two sisters. After the arrest, Smith moved because of threats, and Aiden’s younger siblings had to change schools.¹

Jason Fucci’s Criminal Record

Court records show Jason Fucci has had multiple encounters with the criminal justice system. In 2003, when he was around 18 or 19, he was charged in Duval County with lewd or lascivious battery and child abuse involving a 15-year-old girl. He was found guilty and sentenced to two years of probation. He violated the terms of that probation and served 14 months in prison as a result.²

The same year, a repeat violence injunction was filed against him in connection with a child custody matter. His record also includes theft and driving with a suspended license. In 2016, he was charged with battery for assaulting a man at a gas station and received six months of probation along with anger management.²

The Letter to the Sentencing Judge

Ahead of Aiden’s sentencing hearing in March 2023, Jason and Yasmin Fucci submitted a written statement to Circuit Judge R. Lee Smith. In it, Jason described his son as a “kind and caring boy” and “the baby of the family,” and reminded the court that Aiden was only 14 when he committed the murder.¹

Much of the letter recounted family routine. Jason wrote about attending “Cars and Coffee” on the first Saturday of each month, building cars, baking together, and playing video games. He described Aiden as a thoughtful teenager with “traditional manners.”¹

Addressing the crime itself, Jason wrote, “There are no words to right this wrong,” and called the experience “utter heartbreak and pain.” He acknowledged the difficulty of “grieving the living while mourning the child of another.” The letter closed with a direct request for “the Court’s compassion and mercy.”¹

The Sentencing Hearing and Who Spoke for Aiden

Judge Smith presided over a two-day sentencing hearing on March 22 and 23, 2023, in St. Johns County. Jason Fucci’s contribution to that proceeding came through the written letter rather than in-person testimony. The only relative who took the stand for the defense was Aiden’s paternal grandmother, Deborah Spiwak. She described Aiden as a “silly, happy child” who grew up in a “happy home” with a “good family,” and she asked the court not to “take him out of our lives forever.” She also offered a tearful apology to the Bailey family.³

Crystal Smith, Aiden’s mother, was not present at the hearing, reportedly on advice from her attorney. She had her own pending case at the time, a tampering with evidence charge tied to washing Aiden’s blood-stained jeans on the night of the murder. Smith submitted her own letter to the judge asking, “please show my Aiden mercy, he is not beyond saving.”¹

The defense also called psychologist Dr. Stephen Bloomfield, who argued that rehabilitation was possible given Aiden’s age and ongoing brain development. Bloomfield said that before the murder, “there was an excellent prognosis for Aiden to be rehabilitated,” though he acknowledged it “won’t be easy.” Prosecutors countered with statements Aiden allegedly made to his girlfriend weeks before the killing, in which he described plans to murder someone.³

The Sentence Jason Fucci’s Letter Was Aimed At

The mercy Jason Fucci asked for was not granted. On March 24, 2023, Judge Smith sentenced Aiden to life in prison, with the sentence subject to judicial review after 25 years.⁴ Because Aiden was a juvenile at the time of the crime, the death penalty was never available, and he faced a mandatory minimum of 40 years and a maximum of life.⁵

The judge said the crime involved a “heightened level” of premeditation, had no motive, and was carried out to “satisfy this defendant’s internal desire to feel what it was like to kill someone.”⁶

Aiden’s public defender filed an Anders appeal, the type filed when counsel cannot identify meritorious grounds for challenge. On February 28, 2025, the Fifth District Court of Appeal affirmed the conviction and life sentence, reversing only a clerical error involving a public defender application fee.⁷ As of January 2025, Aiden had been transferred to the Cross City Correctional Institution in Dixie County, Florida, in a move the Florida Department of Corrections described as routine.⁸
