Air Fryer Lawsuit: Recalls, Grounds, and Recovery

If a defective air fryer burned you, started a fire, or damaged your property, you may have grounds for an air fryer lawsuit against the manufacturer, importer, or retailer. Several of the biggest brands sold in the United States — including Cosori, Insignia, PowerXL, Secura, and Magic Chef — have been recalled since 2022 for fire, burn, and laceration hazards, and both individual injury claims and class actions are moving through the courts. What follows is what you need to know to figure out whether your unit is covered, what a claim would look like, and how much time you have to act.

Which Air Fryers Have Been Recalled

The U.S. Consumer Product Safety Commission has issued recalls affecting more than three million air fryers across at least five brands. The defects differ by model, but the hazards cluster around overheating, fires, melting components, and shattering glass.

Cosori (Atekcity). The largest action to date. On February 23, 2023, roughly two million units in the United States were recalled over a wire connection defect that could cause overheating. At the time of the recall, the CPSC had received 205 reports of fires, melting, burning, overheating, or smoking, along with 10 reports of minor burn injuries and 23 reports of property damage. The 3.7-quart and 5.8-quart models were sold between June 2018 and December 2022 at Best Buy, Target, Amazon, and other retailers.1CPSC. Insignia (Best Buy). Recalled twice. In April 2022, about 635,000 U.S. units were pulled after 68 reports of fires, burning, or melting, seven property damage reports, and two injuries, one involving a child’s leg.3Consumer Reports. PowerXL (Empower Brands). In December 2023, Empower Brands recalled about 319,000 PowerXL Vortex Dual-Basket Air Fryers in 9-quart and 10-quart sizes. The plastic U-shaped connector joining the two baskets could break during use, exposing users to hot food and surfaces. The CPSC received 41 reports of the connector breaking and three burn injuries.5CPSC. Empower Brands Recalls Power XL Dual Basket Air Fryers Due to Burn Hazard

Secura. About 6,400 units recalled on September 28, 2023 after a wire connection defect caused nine reports of fire, burning, or smoking. No injuries were reported.6CPSC. Secura Recalls Air Fryers Due to Fire and Burn Hazards

Magic Chef (Newair). Approximately 11,750 Magic Chef Digital Air Fryer ovens recalled in October 2022 over overheating risk. No incidents or injuries had been reported at the time.7CPSC. Newair Recalls Magic Chef Air Fryers Due to Fire and Burn Hazards

Ninja Foodi (SharkNinja). On May 1, 2025, SharkNinja recalled roughly 1.8 million Foodi OP300 Series multi-function pressure cookers (marketed with air frying capability) after a defect let the pressure-cooking lid open while the unit was still pressurized. The injury toll was far heavier than any dedicated air fryer recall: 106 burn injuries, more than 50 of which involved second- or third-degree burns to the face or body. Twenty-six lawsuits had already been filed by the date of the recall. The remedy is a free replacement lid, not a refund.8CPSC. Grounds for an Air Fryer Lawsuit

Product liability claims against an air fryer manufacturer typically rely on one or more of three theories: a manufacturing defect in the specific unit, a design defect inherent to the product, or a failure to warn consumers of a known hazard. Plaintiffs can seek compensation for medical expenses, lost wages, property damage, pain and suffering, and, in cases of especially reckless conduct, punitive damages.9Consumer Notice. Common allegations line up with what the CPSC has identified in each recall. The Cosori complaints cite the defective wire connection the agency flagged as the overheating cause. PowerXL cases focus on the plastic connector that could not withstand operating temperatures. Broader allegations across the litigation include faulty wiring, temperature controls that fail, heating elements reaching dangerous levels, and structural pieces that melt or shatter during ordinary cooking.1CPSC. Class Actions Already Filed

Two class actions targeting air fryer defects have drawn attention. Velez et al. v. Tristar Products, Inc. (Case No. 1:21-cv-23909-MGC), filed in November 2021 in the Southern District of Florida, alleged that the Emeril Lagasse Power Airfryer 360, 360 XL, Deluxe, and Plus models contained design and manufacturing defects causing them to overheat, smoke, and catch fire. The complaint claimed that the fryers’ five heating elements could drive internal temperatures to roughly 1,000°F and that the units lacked an automatic shut-off. The case was voluntarily dismissed without prejudice on February 22, 2022.10Top Class Actions. Air Fryer Fire Forces Woman, Dogs to Flee, Says Class Action Accusing Tristar of Defect

Willis v. Best Buy Co. Inc. (Case No. 0:24-cv-01066), filed in the District of Minnesota, takes a different angle: the plaintiff alleges that the replacement inner pots Best Buy supplied for recalled Insignia air fryers held substantially less volume than the originals, and that Best Buy neither disclosed the change nor offered a refund alternative. The claims include breach of warranty, unjust enrichment, and violations of Minnesota and Illinois consumer protection laws.11Top Class Actions. A class action was also filed in May 2025 over the Ninja Foodi recall, and at least one individual federal case, Wolf-Bond v. SharkNinja Operating LLC, is pending.12ABC News. 1.8 Million Ninja Foodi Pressure Cookers Voluntarily Recalled

As of mid-2026, no public settlements or jury verdicts have been reported in the Cosori, Insignia, Magic Chef, or PowerXL cases. The SharkNinja Foodi litigation is the most active front, with 26 lawsuits on file at the time of the recall and specific outcomes not yet disclosed.9Consumer Notice. Air Fryer Lawsuits8CPSC. What You Can Recover

Individual product liability suits and class actions chase different kinds of money. An individual case covers your actual injuries and losses: current and future medical bills, lost wages, repair or replacement of damaged property, physical pain, emotional distress, scarring, and long-term disability. Punitive damages are rare and reserved for conduct a court considers exceptionally reckless.9Consumer Notice. Air Fryer Lawsuits

Class actions, by contrast, generally focus on returning the purchase price to a group of buyers who all experienced the same defect. That makes them useful for product-only losses but typically far smaller per person than an individual injury suit. If you were burned or your home was damaged, an individual claim is usually the higher-value route.

If You Own a Recalled Air Fryer

The CPSC’s instruction in every one of these recalls is the same: stop using the unit immediately. The remedies offered by the brands vary. Best Buy provided refund checks or store credit for Insignia owners. Cosori offered a free replacement or a refund, but required owners to cut the power cord and submit a photo as proof of destruction.13Cosori. Cosori Product Recall PowerXL offered a full refund. Secura offered a $45 Amazon gift card or a free replacement in exchange for a cut-cord photo. Newair offered Magic Chef owners a credit of at least $50. SharkNinja is sending Foodi owners a replacement lid rather than a refund and says the air frying function can still be used safely on the affected cookers.14SharkNinja/RQA. SharkNinja Voluntary Recall

Participating in a recall and preserving a legal claim are not the same thing. If you were injured or suffered property damage, photograph the unit and the damage before you cut, destroy, or ship anything back. The physical product is often the most important piece of evidence in a defect case, and some remedy programs require you to disable it before you receive a replacement. A plaintiff’s attorney will usually want to inspect the unit first.

The statute of limitations for product liability suits varies by state, which is why injured consumers are generally advised to speak with a personal injury attorney soon after an incident rather than wait to see how a class action plays out. A class member who opts in may still preserve individual injury claims depending on how the settlement is structured, but that is a question to put to counsel before signing anything.

A Note on PFAS and Nonstick Coatings

Some legal investigations have examined whether nonstick air fryer coatings contain PFAS, sometimes called “forever chemicals.” That inquiry has not yet produced significant litigation, so a chemical-exposure claim against an air fryer maker is not currently a developed path the way the fire and burn claims are.9Consumer Notice.
