Allison Mack Jail Time: Guilty Plea, Sentence, and Release

Allison Mack’s jail time for her role in the NXIVM case was a three-year federal prison sentence, of which she served roughly 21 months. The Smallville actress pleaded guilty in April 2019 to racketeering and racketeering conspiracy, was sentenced on June 30, 2021, reported to prison that September, and was released on July 3, 2023.¹²

What She Pleaded Guilty To

Mack was arrested on April 20, 2018, in Brooklyn and initially charged with sex trafficking, sex trafficking conspiracy, and forced labor conspiracy in the Eastern District of New York.³ About a year later, on April 8, 2019, and roughly a month before NXIVM founder Keith Raniere’s trial, she pleaded guilty to one count of racketeering and one count of racketeering conspiracy. The plea encompassed acts of extortion and forced labor tied to a secret subgroup called DOS.¹

Under the advisory federal sentencing guidelines, those offenses carried a recommended range of 168 to 210 months, or 14 to 17 and a half years.⁴ She was ultimately sentenced far below that.

The Three-Year Sentence

U.S. District Judge Nicholas Garaufis sentenced Mack in Brooklyn federal court on June 30, 2021. The sentence was three years in prison on each count, to run concurrently, three years of supervised release afterward, and a $20,000 fine.¹

The steep departure from the guidelines came out of a government motion under Section 5K1.1, which lets a court impose a lighter sentence when a defendant has provided substantial assistance. Prosecutors had filed that motion because of Mack’s cooperation, which began on April 2, 2019, when she sat down for the first of multiple proffer sessions. She turned over emails, documents, and an audio recording of a conversation between herself and Raniere about the branding ritual and how to make it appear consensual. Prosecutors used the tape repeatedly at Raniere’s trial and called it “crucial evidence.”⁵ She was prepared as a potential witness but never called to the stand.⁶

Prosecutors did note a limit on her cooperation, writing that Mack “could have provided even more substantial assistance had she made the decision to cooperate earlier.”⁷

In explaining the sentence, Judge Garaufis cited Mack’s cooperation, her expressions of remorse, and her progress toward rehabilitation. He said she had been “ensnared in Mr. Raniere’s coercive and manipulative web” and was “a slave as well as a master.” A guidelines sentence, he wrote, “would be much greater than necessary,” but some period of incarceration was still appropriate.⁴ In a letter to the court, Mack wrote in part: “I am sorry to those of you that I brought into Nxivm. I am sorry I ever exposed you to the nefarious and emotionally abusive schemes of a twisted man.”⁸

At the same hearing, victims described her differently. Judge Garaufis himself called Mack a “willing and proactive ally” who debased victims with “creative enthusiasm” and held “total control” over them. Jessica Joan, a former DOS member, called Mack “a predator and an evil human being.”⁹

How Much Time She Actually Served

Mack reported to the Federal Correctional Institution in Dublin, California, on September 13, 2021.¹⁰²¹¹ She remained subject to three years of supervised release after leaving prison.¹

The Conduct Behind the Sentence

NXIVM presented itself as a self-help organization but operated, according to federal prosecutors, as a criminal enterprise. DOS, created in late 2015 and marketed to members as a women-only mentorship program, functioned as a coercive hierarchy Raniere described in “slave-master” terms.¹²

Mack was a “first-line master” in DOS, directly beneath Raniere. She later said she used her celebrity as a “power tool” to recruit women into the organization.¹³³¹⁴

How Her Sentence Compared to Other NXIVM Defendants

Mack was one of six people charged in the federal NXIVM case, and her three-year term sat in the middle of the group.

Keith Raniere was convicted at trial in June 2019 on all seven counts, including racketeering, sex trafficking, and forced labor conspiracy, and sentenced to 120 years in prison and a $1.75 million fine. The Second Circuit upheld his conviction in October 2025. He is held at USP Tucson.¹⁵
Clare Bronfman, the Seagram’s heiress and NXIVM executive board member, pleaded guilty to conspiracy to harbor undocumented immigrants and fraudulent use of identification. She got 81 months, forfeited $6 million, and was fined $500,000. She moved to a New York City halfway house in 2024 and was scheduled for release in June 2025.¹⁶
Nancy Salzman, NXIVM’s co-founder and president, pleaded guilty to racketeering conspiracy and was sentenced to 42 months.¹⁷
Lauren Salzman pleaded guilty to racketeering and racketeering conspiracy, testified against Raniere over four days, and received no prison time — five years of probation and 300 hours of community service. Prosecutors called her cooperation “extraordinary” and “critically important.”¹⁸
Kathy Russell, the group’s former bookkeeper, pleaded guilty to visa fraud and was sentenced in October 2021 to two years of probation and 200 hours of community service.¹⁷

The gap between Mack’s prison term and Lauren Salzman’s probation reflected, in Judge Garaufis’s telling, the difference in cooperation — Salzman testified at trial, while Mack did not — and the depth of Mack’s active role in orchestrating abuse within DOS.¹⁹

Where She Is Now

Since her release, Mack has been pursuing a master’s degree in social work, researching PhD programs in expressive arts therapy, and working at a nonprofit that brings creative arts programming to prison populations.²⁰²¹²²

In November 2025 she broke her public silence in a seven-episode CBC podcast, Allison After NXIVM. On it she said, “I don’t see myself as innocent,” called descriptions of her as abusive and aggressive during her NXIVM years “100% all true,” and described herself as having been a “harsh monster” who abused her power to coerce women.²⁰ She also acknowledged that the coercion in DOS amounted to rape and said she had at times found the power dynamics “exciting.”²³
