Amazon Delivery Accident Lawsuit: Liability, Verdicts, and Deadlines

If you were hit by an Amazon delivery van, you can sue Amazon — and recent juries have made clear that the company’s standard defense, that the driver worked for someone else, is not the shield it once was. An Amazon delivery accident lawsuit typically names the driver, the delivery company that employs the driver, and Amazon itself, and the central fight is almost always whether Amazon exercised enough control over the driver’s work to be legally responsible for the crash. Verdicts in the last three years have reached as high as $44.6 million against Amazon.

Why Amazon Says It Isn’t Responsible

Most Amazon-branded vans on the road are not driven by Amazon employees. Since 2018, Amazon has routed its “last mile” deliveries through its Delivery Service Partner program, in which Amazon recruits individuals to start small logistics companies, offers around $10,000 in startup assistance, and then contracts with those companies — DSPs — to supply drivers.1Capital Law Review. A Prime Opportunity for Tort Law Developments: Liability Issues Related to Amazon’s Delivery Service Partner Program The drivers wear Amazon uniforms and drive Amazon-branded vans, but their paychecks come from the DSP.

The contracts between Amazon and each DSP designate the DSP as an independent contractor and require the DSP to “defend, indemnify and hold harmless Amazon” for any injuries or deaths that occur during deliveries. Each DSP must carry at least $1 million in commercial auto insurance.1Capital Law Review. A Prime Opportunity for Tort Law Developments: Liability Issues Related to Amazon’s Delivery Service Partner Program When a crash happens, Amazon points to those documents and tells the injured person to deal with the DSP.

Amazon also runs a separate program called Amazon Flex, where individual drivers use their own vehicles to deliver packages as independent contractors. Flex drivers are covered during active deliveries by an Amazon commercial auto policy with up to $1 million in liability coverage.2Phoenix Law Team. The practical problem for an injured person is that the DSP is usually a small LLC with limited assets and the minimum policy. If your medical bills exceed $1 million, the only way to full compensation often runs through Amazon.

Legal Theories That Reach Amazon

Plaintiffs have pierced Amazon’s independent-contractor defense using several overlapping arguments. Which one works best depends on the state and the facts.

Respondeat Superior and Agency

Under respondeat superior, a company that controls the “method and means” of a worker’s job can be held liable for that worker’s negligence, the same way any employer is liable for its employees. Plaintiffs point to Amazon’s control over routes, schedules, performance metrics, uniforms, vehicles, and real-time monitoring to show that the DSP functions as Amazon’s agent rather than a truly independent business.3Yarborough Applegate. Countering Amazon’s Independent Contractor Defense in DSP Litigation

South Carolina courts, for example, weigh four factors: direct evidence of control, whether the company furnished equipment, the method of payment, and the right to terminate. A plaintiff does not have to establish all four; evidence supporting even one factor can be enough.3Yarborough Applegate. Countering Amazon’s Independent Contractor Defense in DSP Litigation

Joint Employment

Some plaintiffs argue Amazon is a “joint employer” with the DSP. In Edmonds v. Amazon.com, Inc., the U.S. District Court for the Western District of Washington denied Amazon’s motion to dismiss in April 2020, finding that allegations about Amazon’s role in training, monitoring, disciplining, and scheduling drivers were enough to plausibly show joint employment under the Fair Labor Standards Act.4Justia. Edmonds v. Amazon.com Inc. et al

Ostensible Agency

California plaintiffs have invoked ostensible agency, which holds a company liable when it causes the public to believe someone is its agent. Because DSP drivers wear Amazon uniforms, drive Amazon vans, and deliver Amazon packages, people struck by those vans generally have no way of knowing the driver technically works for a separate business.5Panish Shea Ravipudi LLP. Countering Amazon’s Defense to Liability for the Conduct of Its Delivery Drivers

Direct Negligence

Separate from the question of whose employee the driver is, plaintiffs can sue Amazon for its own negligence — in vetting, supervising, or retaining unsafe drivers, or in designing a delivery system that pushes drivers past safe limits. This argument focuses on what Amazon itself did or failed to do, often using Amazon’s own monitoring data to show the company knew about dangerous behavior.6Aguiar Injury Lawyers. Amazon’s own technology makes this a powerful theory. The Mentor app tracks acceleration, braking, speed, and phone usage, generating a safety score for each driver. Netradyne AI cameras in the vans flag drowsiness and distraction. Amazon has said this technology reduced collisions by 40% and distracted driving by 89% — a figure plaintiffs turn against the company by arguing that if Amazon has the data, Amazon has notice.3Yarborough Applegate. What Recent Verdicts Show

Three jury verdicts in the last three years illustrate how the arguments play out in front of a jury.

Shaw v. Amazon — $44.6 Million (South Carolina, 2023)

On December 7, 2023, a Dorchester County, South Carolina, jury awarded Shannon Shaw $44.6 million after an Amazon van struck his motorcycle in Summerville on September 24, 2021. The driver, Kevin Anthony Blekicki, worked for a DSP called MJV Logistics. Digital forensics revealed more than 90 recorded instances of distracted driving during his five months on the job, and phone records showed data usage consistent with watching pornography and YouTube videos at the time of the crash. Blekicki admitted on the stand that he had been distracted.8SC Lawyers Weekly. Jury Returns Eight-Figure Damage Award in Crash7ABC News 4. Dorchester County Jury Hands $44.6M Verdict Against Amazon

Shaw suffered a traumatic brain injury, a broken back in three places, a massive rotator cuff tear, and other injuries requiring a cervical fusion and two permanent spinal cord stimulators. The jury awarded $14.6 million in actual damages and $30 million in punitive damages against Amazon, with smaller punitive awards against the driver and the DSP. Amazon’s highest pretrial settlement offer had been $1.25 million.9The State. Amazon Hit With $44.6 Million Verdict After Delivery Van Strikes Motorcyclist

The jury found Amazon vicariously liable and concluded by clear and convincing evidence that Amazon was grossly negligent in hiring, supervising, and retaining Blekicki despite its own data showing repeated safety violations. Amazon owned the van, designed the route, and monitored driving through the Mentor app and Netradyne cameras.9The State. Amazon Hit With $44.6 Million Verdict After Delivery Van Strikes Motorcyclist

Bradfield v. Amazon Logistics — $16.2 Million (Georgia, 2024)

In August 2024, a Gwinnett County, Georgia, jury awarded $16.2 million to the family of an eight-year-old boy struck and dragged by an Amazon van while he was riding a small electric bicycle in a residential neighborhood. The boy required multiple surgeries and will carry lifelong scarring. The DSP was FlyFella Logistics.10Fried Goldberg LLC. Fried Goldberg Secures $16.2 Million Verdict Against Amazon Logistics

The jury apportioned 85% of the fault to Amazon, 10% to the driver, and 5% to a non-party neighbor, finding that Amazon failed to properly train the driver and controlled the “time, method, and manner” of deliveries closely enough to be treated as an employer.11PR Newswire. Eisenberg v. Amazon — $5 Million (California, 2022)

In June 2022, a San Bernardino County jury awarded $5 million to Anita Sun Eisenberg, a 43-year-old entrepreneur run over by an Amazon van in a parking lot in 2018. Amazon admitted liability, so the trial was fought over damages. Eisenberg alleged crush injuries to her leg, neck and back injuries, and Complex Regional Pain Syndrome. Amazon acknowledged the leg and ankle injuries but argued $1.3 million was fair; the jury disagreed.12CVN. Woman Hit by Amazon Delivery Van Awarded $5M by CA Jury

Pressure on Drivers as Evidence

A thread running through these cases is the pace Amazon demands. A report by the Strategic Organizing Center documented DSP operators expected to deliver 350 to 400 packages per shift — a delivery every one to two minutes.13Wisner Baum LLP. In a Georgia case filed in June 2021, Ans Rana alleged that an Amazon van traveling nearly 68 mph in a 55-mph zone struck his Tesla on Interstate 75 in Atlanta, leaving him using a motorized wheelchair after brain and spinal injuries. His complaint alleges Amazon’s logistics algorithms forced drivers to rush at unsafe speeds. His medical bills exceeded $2 million; the DSP, Harper Logistics, carried only $1 million. Amazon has sought to seal information about its algorithms as trade secrets.15Detroit News. Amazon Sued Over Crashes, Drivers Rushing to Make Deliveries

Who to Sue and What Insurance Is Available

Identifying the right defendants in an Amazon crash case is more complex than in an ordinary car accident. The potential parties include the driver, the DSP that employs the driver, and Amazon itself. When loading or vehicle maintenance contributed to the crash, those responsible parties may also be liable.16Arash Law. Amazon Truck Accident Lawyers

Coverage normally starts with the DSP’s commercial auto policy, which Amazon requires to be at least $1 million. In serious injury or wrongful death cases, that often falls short. Establishing that Amazon itself was negligent — in training, supervision, retention, or system design — can open access to Amazon’s umbrella or excess policies, which can reach $5 million to $10 million or more. Documented jury verdicts have ranged from $5 million to over $44 million.6Aguiar Injury Lawyers. Amazon Crash Litigation

Deadlines and State Law Make a Difference

Filing deadlines vary by state. In many states, the statute of limitations for a personal injury claim is two years from the date of the accident. Property damage claims may have slightly longer windows, and claims that touch government entities can be much shorter. Missing the deadline forfeits the right to sue.16Arash Law. Amazon Truck Accident Lawyers

State law also shapes how much you can recover and whether you can recover at all. California’s Assembly Bill 5, signed in September 2019 and effective January 1, 2020, codified an “ABC test” under which a worker is presumed to be an employee unless the hiring company proves the worker is free from its control, performs work outside the company’s usual business, and is engaged in an independently established trade. For Amazon, the second prong is difficult to satisfy, since delivering packages is squarely within Amazon’s usual business.17California Franchise Tax Board. Worker Classification and AB 5 FAQ

Kentucky applies pure comparative fault under KRS 411.182, so Amazon’s share of responsibility is assessed separately and plaintiffs can recover even when defendants dispute fault among themselves. Virginia follows contributory negligence, under which a plaintiff found even slightly at fault can be barred from any recovery.6Aguiar Injury Lawyers. Evidence to Preserve Now

Early documentation often decides these cases. Useful records include the police report, photographs of the scene and vehicle damage, the driver’s name and employer information, medical records covering all treatment, and any dashcam or traffic camera footage.2Phoenix Law Team. What to Do When an Amazon Delivery Truck Driver Crashes Into You

Amazon’s own records are often the most important evidence: delivery schedules, GPS logs, Mentor app safety scores, and Netradyne camera recordings. In the Shaw case, the driver’s Mentor data documenting more than 90 distracted-driving events was central to the finding of gross negligence against Amazon. Those records are not voluntarily turned over; getting them generally requires formal legal discovery, which is one reason acting quickly, before data retention windows close, matters.2Phoenix Law Team.
