Ambrosia Brands LLC Lawsuit: Salmonella, Recall, and Trademark

The Ambrosia Brands LLC lawsuit picture has two distinct tracks. On one side, a federal trademark case filed by Human Power of N Company is pending in the Western District of Texas. On the other, no consumer product liability suits have yet been filed over the February 2026 Salmonella recall of Rosabella Moringa Capsules, but plaintiff-side law firms are publicly investigating claims from people who were sickened.

The Salmonella Outbreak Behind the Claims

Between September 26, 2025, and January 8, 2026, ten people in eight states became ill with Salmonella after taking Rosabella-brand moringa powder capsules. Three were hospitalized. No deaths were reported. The affected states were Arizona, Florida, Iowa, Illinois, Indiana, Tennessee, Virginia, and Washington.1FDA. Outbreak Investigation of Extensively Drug-Resistant Salmonella in Moringa Powder

What sets this outbreak apart, and what any legal claim would likely emphasize, is the pathogen. Investigators identified two strains, Salmonella Newport and Salmonella Kentucky, both classified as extensively drug-resistant. The Newport strain carried the NDM-1 carbapenemase gene, which confers resistance to carbapenems, a class of antibiotics often used as a last resort for serious bacterial infections.2CIDRAP. The Indiana Department of Health confirmed the link by testing an unopened bottle collected from a patient’s home; it carried the same Salmonella Newport strain found in the sick patients. Of eight people interviewed, seven reported taking Rosabella moringa capsules.3CDC. Salmonella Outbreak Linked to Moringa Capsules Investigation Details The FDA’s traceback identified a single moringa powder supplier as the common source but did not publicly name it. The CDC declared the outbreak over on April 1, 2026, though the root cause of contamination was never determined.4Food Safety. The Recall and How to Identify Affected Bottles

On February 13, 2026, Ambrosia Brands voluntarily recalled 52 lots of Rosabella Moringa Capsules sold in 60-count white plastic bottles with green labels. Expiration dates on the recalled lots run from March 2027 through November 2027, so affected bottles may still be sitting in homes.5FDA. To check a bottle, look at the code on the bottom. All recalled lots start with SKU 1356, carry a seven-digit lot code in the middle, and end with “-1” or “-2.”1FDA. Outbreak Investigation of Extensively Drug-Resistant Salmonella in Moringa Powder The capsules were sold nationwide starting in February 2025 through the company’s website (tryrosabella.com), TikTok Shop, and Amazon, and also appeared through unauthorized sellers on eBay and Shein.6CDC. Consumers who still have the product should throw it away or return it to the point of purchase, clean any surfaces the capsules touched with hot, soapy water, and watch for symptoms of Salmonella infection such as fever, diarrhea, and vomiting.7Illinois Department of Public Health. The company can be reached at 914-768-1357, Monday through Friday, 9 a.m. to 4 p.m. CT.5FDA. Can Sickened Consumers Sue?

No specific product liability lawsuits by consumers who fell ill in the outbreak have been identified as of mid-2026. Several plaintiff-side law firms have announced investigations and are soliciting potential clients.

In contamination cases of this kind, plaintiffs typically pursue three theories. Strict product liability holds a manufacturer responsible for selling a defective product regardless of the care it took. Negligence requires showing the manufacturer failed to exercise reasonable care in production. Breach of warranty argues the product was not fit for its intended use.8USDA Economic Research Service. Legal Theories in Foodborne Illness Cases The drug-resistant nature of the Salmonella strain, which left patients with severely limited treatment options, could factor into arguments about the severity of the harm.

The Pending Trademark Lawsuit

The one active suit against Ambrosia Brands is unrelated to the recall. On February 17, 2026, Human Power of N Company filed a federal trademark infringement action in the U.S. District Court for the Western District of Texas, alleging violations of the Lanham Act. Judge Alan D. Albright is presiding.9PACER Monitor. Human Power of N Company v. Ambrosia Brands, LLC

Ambrosia Brands moved to dismiss for failure to state a claim on May 15, 2026. The plaintiff filed an amended complaint on June 4, 2026. The case remains active.9PACER Monitor. Human Power of N Company v. Ambrosia Brands, LLC

Subscription and Cancellation Complaints

The Salmonella recall is not the company’s only source of consumer friction. The Better Business Bureau lists 402 complaints against Ambrosia Brands over three years, with 389 closed in the most recent twelve months. The company is not BBB-accredited and holds a “C” rating.10BBB. Ambrosia Brands LLC BBB Profile

A recurring theme in the complaints: consumers say they believed they were making a one-time purchase and were instead enrolled in a recurring subscription. Complainants describe difficulty canceling through the website and continued charges after attempted cancellations. In several BBB responses, the company acknowledged that cancellation requests were not properly processed or “failed to reach their system.”11BBB. Rosabella Supplements BBB Complaints
