Ann Taylor Class Action Lawsuit Settlement: Eligibility and Claims

The Ann Taylor class action lawsuit settlement gives eligible shoppers at Ann Taylor Factory Stores and LOFT Outlet Stores a single voucher worth up to $11 toward a future in-store purchase, in exchange for claims that the stores advertised discounts off inflated “original” prices that items had never actually sold for. The case, Binder, et al. v. Premium Brands OpCo LLC, was filed in the Superior Court of California for the County of San Diego and received final approval in 2025.¹

Who Qualifies

You are a class member if you bought one or more products at a stated discount at an Ann Taylor Factory Store or LOFT Outlet Store in one of eight states during the qualifying window for that state, and you did not receive a refund or credit for the purchase. The windows all end on November 4, 2024, and start on September 4 of a year that varies by state:

Pennsylvania: from 2018
California and Washington: from 2020
New York and Wisconsin: from 2021
Ohio and Texas: from 2022
Oregon: from 2023

Only in-store purchases at the Factory and Outlet locations are covered. Full-price Ann Taylor or LOFT stores are not part of this settlement.²

What You Get

Each class member receives one voucher worth up to $11.00, regardless of how many qualifying purchases they made.³ The voucher can be used at any Ann Taylor Factory Store or LOFT Outlet Store, and it comes with these terms:

It is transferable, so you can give it to someone else.
It can be stacked with other store discounts and offers.
It is valid for six months from the date it is distributed.
It has no cash value. If your purchase is less than $11, the difference is forfeited, and if you return an item bought with the voucher, the voucher amount is not refunded.²

How to Claim

If you received a direct email notice from the settlement administrator, Simpluris, you do not need to do anything. Your voucher will be sent to you automatically once the settlement is final.⁴

If you did not receive an email but believe you qualify, you had to submit a claim form through the settlement website at pbocpricingsettlement.com. No proof of purchase was required to file.³

Key Dates and Current Status

The claim form, opt-out, and objection deadlines were all September 10, 2025. The fairness hearing was set for November 14, 2025, at 1:30 p.m. before Judge Michael D. Washington in San Diego. Vouchers are expected to go out roughly 30 days after final approval and the resolution of any appeals.³

According to Truth in Advertising, the California court granted final approval, reflected in a July 2025 minute order.¹ As of mid-2026, Top Class Actions listed the claims status as “in progress,” suggesting distribution may still be underway.⁵

Separately, Premium Brands OpCo LLC agreed to pay up to $1,255,000 in attorneys’ fees, costs, and service awards, subject to court approval. Each of the four class representatives requested a service award of up to $1,250.²

What the Lawsuit Alleged

The four named plaintiffs, Demetra Binder, Angela Waldner, Christina Calcagno, and Deborah O’Dea, alleged that the price tags at Ann Taylor Factory and LOFT Outlet stores compared sale prices to “original” prices that were artificially inflated and did not reflect what the items had ever actually sold for.² The claim, sometimes called a “phantom markdown,” was not that the clothes were defective or overpriced in absolute terms, but that the comparison price made shoppers think they were saving more than they actually were. California, Oregon, and several other states have consumer protection laws that specifically prohibit this kind of advertising, which is why the qualifying states and date ranges look the way they do.

The Earlier 2018 Ann Taylor Settlement Was a Different Case

If you are looking for the older Ann Taylor outlet settlement, that was a separate lawsuit. In Morrow v. Ascena Retail Group Inc. and Ann Inc., filed in 2016 in the Southern District of New York, plaintiffs made similar allegations about inflated original prices. Ann Taylor agreed to a $6.1 million settlement in December 2017, and class members who bought items between May 2012 and May 2016 could choose either a $5 cash payment or a $12 store voucher. Final approval came in April 2018, and class members ultimately received settlement checks of about $6.84.⁶⁷ That case is closed and has no bearing on eligibility for the current $11 voucher settlement.
