On a November 1, 2018 earnings call, Cook described Apple’s new iPhones as “off to a good start” and told investors the company was not being hurt by worsening economic conditions in China.3The Guardian. Four days after the call, Apple cut iPhone production substantially. Then on January 2, 2019, Cook issued a letter warning that quarterly revenue would come in roughly $9 billion below Apple’s earlier forecast, blaming almost all of the shortfall on weak demand in Greater China.3The Guardian. The suit was brought under Section 10(b) of the Securities Exchange Act and Rule 10b-5, which prohibit materially false or misleading statements tied to buying or selling securities. Claim Deadline and Current Status

The deadline to submit a claim was October 4, 2024. Final approval followed on September 17, 2024, and distributions are being processed through the claims administrator. If you did not file by the deadline, you are not eligible to receive a payment from this settlement.

How the Case Got to $490 Million

Two rulings kept the case alive and pushed Apple toward settlement. In June 2020, Judge Gonzalez Rogers denied much of the motion to dismiss, finding that the plaintiffs “plausibly allege that Cook represented that Apple was not experiencing pressure in China” and that the complaint “adequately pleads that the China-related statements were materially false or misleading when made.”4Robbins Geller Rudman & Dowd LLP. Not the Same as the Batterygate Settlement

This case is often confused with Apple’s “Batterygate” settlement, but they are separate matters. Batterygate, In re Apple Inc. Device Performance Litigation, was a consumer lawsuit alleging Apple secretly throttled older iPhones through software updates. That case settled for between $310 million and $500 million, with payments of $92.17 per claim beginning in January 2024.13CNET. A New Apple Securities Case Over AI and Siri

Apple faces a separate, ongoing securities fraud class action filed in 2025. In City of Coral Springs Police Officers’ Pension Plan v. Apple Inc. (Case No. 25-cv-06252), shareholders allege Apple made false and misleading statements about when advanced AI-powered Siri features would be available, particularly on the iPhone 16, and that the absence of those features hurt iPhone 16 sales. The case is pending before Judge Noel Wise in the Northern District of California, with a motion to dismiss the amended complaint being briefed as of February 2026.14KTMC.
