The Ardoin total loss settlement resolves a Louisiana class action alleging that GoAuto Insurance Company underpaid total-loss claims by leaving sales tax and regulatory fees out of its actual-cash-value payouts. The court signed the final approval order on August 14, 2025, and eligible class members who filed a timely claim are entitled to 100% of the unpaid sales tax and fees tied to their total-loss claim, minus a pro rata share of attorney fees and administration costs. As of mid-2026, payments have not yet been distributed.
Who Qualifies
You are in the class if all of the following apply:
- You were a Louisiana resident insured under a GoAuto motor vehicle policy with comprehensive or collision coverage.
- You submitted a first-party physical damage claim that GoAuto adjusted as a total loss.
- You received a total-loss payment.
- You did not retain the salvage vehicle.
- Your claim falls within the class period of May 16, 2012 through May 13, 2024.1Ardoin Total Loss Settlement. Settlement Home Page
One boundary worth noting: the settlement covers unpaid taxes and fees only. It does not resolve any dispute about the underlying valuation GoAuto assigned to a totaled vehicle.2Ardoin Total Loss Settlement. Frequently Asked Questions

Why Payments Haven’t Been Sent Yet
Even though the judge signed the final approval order in August 2025, the settlement website continues to tell class members that the court “still has to decide whether to approve the Settlement” and that “payments will be provided only after any issues with the Settlement are resolved.”1Ardoin Total Loss Settlement. Settlement Home Page The site asks class members to be patient, and no update has been posted announcing that checks have gone out.
Under the settlement agreement, the 90-day clock for mailing checks does not start on the approval date. It starts on the “effective date,” which depends on there being no pending motions for a new trial or appeals. Post-approval proceedings, if any are still active, would push distribution back.
What the Case Was About
Anna Ardoin alleged that GoAuto systematically left state sales tax, title fees, handling fees, plate fees, and other regulatory costs out of the actual cash value it paid on total-loss claims. Louisiana Revised Statutes ยง 22:1892(F)(2) states that the “deduction of prospective contractor overhead, prospective contractor profit, and sales tax in determining the actual cash value of an adjustment or settlement is not allowed on replacement cost policies or on actual cash value policies.”6Louisiana State Legislature. RS 22:1892 – Claims Practices The plaintiffs argued GoAuto violated that provision across thousands of total-loss payments over more than a decade.
GoAuto denied all allegations of wrongdoing and maintained it complied with its policy terms and Louisiana law throughout the class period.2Ardoin Total Loss Settlement. Frequently Asked Questions The case was filed in the 19th Judicial District Court for the Parish of East Baton Rouge as Anna Ardoin v. GoAuto Insurance Company, Case No. 719102.
