Airsoft guns are legal in Florida. They aren’t firearms under state law, so you don’t need a license to buy or own one, and Florida’s firearm background check rules don’t apply. What trips people up is everything around ownership: minors can’t use them without adult supervision, threatening someone with one can be charged as if it were a real weapon, and bringing one near a school is a felony. A realistic-looking airsoft gun draws the same police response as a real one, and Florida’s criminal statutes are broad enough to reach anyone who uses one recklessly.
Why Airsoft Guns Aren’t Firearms Under Florida Law
Florida Statute 790.001 defines a firearm as any weapon designed to expel a projectile by the action of an explosive.1Florida Senate. Florida Code 790.001 – Definitions Airsoft guns use compressed air, springs, or electric motors to fire plastic pellets, so they fall outside that definition. No concealed weapon license required, no background check to purchase.
The same chapter defines “weapon” more broadly, covering dirks, knives, metallic knuckles, tear gas guns, and “other deadly weapon” besides a firearm or common pocketknife.2Online Sunshine. Florida Code 790.001 – Definitions Whether an airsoft gun counts as an “other deadly weapon” depends on how it’s being used. Sitting in a case at home, almost certainly not. Pointed at a stranger’s face during an argument, almost certainly yes. That distinction is how airsoft guns end up triggering real criminal charges under statutes that only mention “weapons.”
Age Rules for Minors
No federal statute sets a minimum purchase age for airsoft guns. The 18-and-over policies at most retailers, and the 21-and-over rules at some major chains, are business decisions and not legal requirements.
Florida does restrict use by younger minors. Under Section 790.22, anyone under 16 is prohibited from using or possessing a BB gun, air or gas-operated gun, or electric weapon unless supervised by an adult who has the consent of the child’s parent or guardian.3Florida Senate. Florida Code 790.22 – Use of BB Guns, Air or Gas-Operated Guns, or Electric Weapons or Devices by Minor Under 16 Airsoft guns fit that language. A 14-year-old can play at an airsoft field, but only with an approved adult present and actively supervising.
An adult who knowingly lets a child under 16 use or possess one of these guns without proper supervision commits a second-degree misdemeanor, punishable by up to 60 days in jail and a $500 fine.3Florida Senate. Florida Code 775.082 – Penalties, Applicability of Sentencing Structures, Mandatory Minimum Sentences If a neighbor’s kid gets hurt with an unsupervised airsoft gun at your house, you’re the one facing charges.
Where You Can’t Use Them
Schools and School Zones
This is where airsoft law turns severe. Florida Statute 790.115 prohibits possessing any weapon (as defined in Section 790.001) on school property, school buses, school bus stops, or at school-sponsored events. Displaying a weapon in a threatening manner at a school or within 1,000 feet of one during school hours is a third-degree felony, punishable by up to five years in prison.5Florida Senate. Florida Code 790.115 – Possessing or Discharging Weapons or Firearms at a School-Sponsored Event or on School Property Simple possession of a weapon on school grounds, without any threatening behavior, is also a third-degree felony under the same statute. Because a realistic airsoft gun can qualify as an “other deadly weapon,” bringing one onto a campus is a serious risk.
Public Spaces
No Florida statute specifically bans airsoft guns from parks, sidewalks, or other public areas. The danger is how a realistic-looking gun in public interacts with other laws. Someone seeing what appears to be a firearm calls 911, an armed police response follows, and improper exhibition charges can follow that. Keep airsoft guns in cases whenever you’re outside a designated field or private property.
Private Property
Using airsoft guns on private property with the owner’s permission is lawful. Dedicated airsoft fields are the safest option because they’re built for it. On private land like a backyard or farm, get clear consent from the owner and make sure stray pellets can’t cross into neighboring property or public space.
What Will Get You Charged
Improper Exhibition
Florida Statute 790.10 makes it a first-degree misdemeanor to display any dangerous weapon in a rude, careless, angry, or threatening manner in the presence of others, unless you’re acting in self-defense.6Florida Senate. Florida Code 775.082 – Penalties, Applicability of Sentencing Structures, Mandatory Minimum Sentences7Florida Senate. Florida Code 775.083 – Fines This is the charge that catches airsoft owners off guard. Waving one around during a road rage incident, or pointing one at someone as a joke, is enough. The statute doesn’t require the weapon to be a firearm.
Aggravated Assault
If you threaten someone with a realistic airsoft gun and they reasonably believe it’s a real firearm, prosecutors can pursue aggravated assault charges. What the victim perceived matters more than what the object actually was.
Robbery With a Weapon
Under Section 812.13, robbery committed while carrying any weapon is a first-degree felony, and the statute doesn’t require the weapon to be a working firearm.8Online Sunshine. Florida Code 812.13 – Robbery Using an airsoft gun during a robbery makes your legal situation dramatically worse, even though it fires plastic pellets.
The Orange Tip and Why It Matters
Federal law makes it illegal to manufacture, ship, or sell any toy, look-alike, or imitation firearm without a blaze orange plug permanently affixed to the muzzle. The statute specifically names airsoft guns firing nonmetallic projectiles as look-alike firearms subject to this rule.9Office of the Law Revision Counsel. 15 USC 5001 – Penalties for Entering Into Commerce of Imitation Firearms Traditional BB guns, paintball guns, and pellet guns are explicitly excluded from the marking requirement.
The federal law governs sale and importation, not possession. Removing the orange tip after purchase isn’t a federal crime. It is one of the worst practical decisions an airsoft owner can make. Without that marker, police responding to a report of a gun have no fast way to distinguish your airsoft from a real firearm, and that split-second ambiguity has led to tragic outcomes.
Transporting Airsoft Guns
In a Car
Florida law doesn’t impose specific transportation rules for airsoft guns the way it does for firearms. That said, a realistic-looking airsoft gun sitting loose on a passenger seat is an invitation to a bad traffic stop. Keep it in a case or bag, unloaded, with the magazine removed. If an officer sees what looks like a handgun in your car, the situation escalates before you get a chance to explain.
On a Plane
The TSA treats airsoft guns like firearms for air travel. They can’t go in carry-on luggage. They must be unloaded, packed in a locked hard-sided container, and placed in checked baggage only.10Transportation Security Administration. Transporting Firearms and Ammunition You must declare the airsoft gun to the airline at the ticket counter when you check in. Airlines may impose additional restrictions on top of the TSA rules, so check your carrier’s policy before flying.
Local Rules Can Go Further
Florida’s firearms preemption law, Section 790.33, blocks cities and counties from passing their own gun regulations. That law covers “firearms and ammunition.”11Online Sunshine. Florida Code 790.33 – Field of Regulation of Firearms and Ammunition Preempted Because airsoft guns aren’t firearms under state law, local governments are free to add their own rules. Some municipalities regulate where airsoft guns can be discharged, apply noise or nuisance standards, or restrict use in public parks. Check the local code for your city or county before playing somewhere new. What’s legal on rural private property in one jurisdiction can draw a citation inside city limits in another.
