Fireworks are not allowed in Prosper. The town’s municipal code bans manufacturing, storing, selling, transporting, or setting off fireworks of any kind inside the corporate limits, and the prohibition runs year-round rather than lifting around holidays. What the Ban Actually Covers
The ordinance defines “fireworks” broadly enough to sweep in almost anything that combusts, explodes, or detonates to produce a visible or audible effect. Sparklers, small fountains, smoke bombs, Roman candles, bottle rockets, and firecrackers are all included. Only three narrow items are carved out of the definition: automotive flares, paper caps containing no more than 0.25 grams of explosive material per cap, and toy pistols or guns designed to use those caps.1Town of Prosper, TX. Town of Prosper Code – Article 5.04 Fireworks Everything else falls under the ban. There is no Fourth of July window, no New Year’s Eve window, and no exception for private property.
If You Live Just Outside Town Limits
Prosper straddles Collin and Denton counties, and plenty of neighborhoods sit near or along the town boundary. If your property is in unincorporated county land, the town ordinance does not directly apply. You still are not automatically clear.
Texas commissioners courts can prohibit or restrict fireworks in unincorporated areas, particularly during dry conditions.2Texas A&M Forest Service. Fines and Seizure

The Fire Chief has authority to seize and destroy fireworks found within town limits in violation of the ordinance. Police officers and firefighters can also stop vehicles transporting fireworks illegally and shut down a building where fireworks are stored until the Fire Chief arranges seizure and disposal.1Town of Prosper, TX. Civil Liability and Insurance
The fine is only part of the exposure. If you light fireworks on your property and a guest or neighbor is injured, you can be sued for negligence. Texas courts weigh factors like whether the fireworks were illegal, whether children were supervised, and whether safe distances and warnings were used. Using prohibited fireworks amplifies exposure because you were already breaking the law when the injury occurred.
Homeowner’s insurance policies commonly exclude coverage for injuries caused by illegal activity. If the insurer treats the fireworks as unlawful under Prosper’s ordinance, you could be personally liable for medical bills, lost wages, and other damages with no policy behind you.
Permitted Public Displays
The one legal path for fireworks inside Prosper is a permitted public display. The Town Council can grant permits to government agencies, fair associations, amusement parks, and similar organizations for supervised events run by a competent operator approved by the Town Administrator or a designee.1Town of Prosper, TX. Applicants must submit a written application at least ten days before the event, file it with both the Town Administrator’s office and the State Fire Marshal, and post a bond covering property damage and personal injury claims from the display.1Town of Prosper, TX. Reporting Illegal Fireworks
Call 911 immediately if fireworks cause an active fire or someone is injured. Getting Rid of Fireworks You Already Have
If you bought fireworks outside Prosper and now have them at home, don’t put them in the trash. Undischarged fireworks can ignite inside a garbage truck or at the landfill. Submerge them fully in a bucket of water: about fifteen minutes for small items, overnight for larger devices. Once saturated, wrap them in plastic bags to keep them from drying out and place the bagged fireworks in your household garbage. Duds and misfires get the same treatment, because their fuses or charges may still be live.
