Groceries in Florida are mostly not taxed. The state exempts food products sold for home consumption from its 6% sales tax, so meat, produce, dairy, bread, eggs, and similar staples ring up tax-free. The exceptions are the ones worth knowing about: candy, soft drinks, single-serve ice cream, prepared deli meals, dietary supplements, and pet food all carry the full sales tax.

What’s Exempt at the Grocery Store

Florida law exempts “food products for human consumption” when sold unprepared at grocery stores, supermarkets, and convenience stores.1Florida Legislature. The condition is that the item is sold unprepared for you to take home. Once the store cooks, heats, or assembles it, the exemption drops away.

Grocery Items You’ll Still Pay Tax On

Several products stocked right alongside exempt groceries are carved out of the food exemption and taxed at the full rate.

Candy, Gum, and Confections

Soft Drinks and Flavored Beverages

Sodas, flavored sparkling waters, and other carbonated drinks are fully taxable. Juice is only exempt if it’s 100% natural fruit or vegetable juice; anything less gets taxed at the standard rate.1Florida Legislature. Ice Cream Novelties and Single-Serve Frozen Treats

Ice cream, frozen yogurt, and similar treats sold in cones, small cups, pints, popsicles, or frozen fruit bars are taxable. The statute specifically excludes these single-serve formats from the food exemption.1Florida Legislature. Dietary Supplements and Vitamins

Multivitamins, minerals, herbal extracts, and protein powders are taxable. Florida doesn’t classify supplements as food, so the grocery exemption doesn’t reach them. A supplement only becomes tax-exempt if it’s labeled as a drug or medicine with a federal National Drug Code, which over-the-counter supplements typically don’t have.3Legal Information Institute. Pet Food

Prepared and Ready-to-Eat Foods

  • Rotisserie chickens, steamed seafood, and hot soup from a deli counter
  • Sandwiches and wraps assembled at the counter
  • Pre-made salads sold with dressing or utensils
  • Ready-to-eat meals packaged for carryout
  • Bakery items sold hot at a bakery with no seating

The line is who did the preparation. A frozen meal heated on the store’s premises is taxable; the same meal in sealed packaging that you take home to heat yourself stays exempt.3Legal Information Institute. Groceries Paid For with SNAP

When you pay with SNAP benefits through an EBT card, no sales tax is charged. Why Your Rate Might Be Higher Than 6%

The 6% state sales tax is a floor, not the whole rate. Most counties add a local discretionary sales surtax on the same taxable transactions.6Florida Dept. of Revenue. Coupons and Delivery Fees

On exempt groceries, coupons don’t affect tax because there’s no tax to reduce. On taxable items, the type of coupon matters. A store coupon lowers the sales price, so you’re taxed on the reduced amount. A manufacturer coupon does not, because the manufacturer reimburses the store and the full retail price still counts as the sales price for tax purposes.8Legal Information Institute. For online grocery orders, a delivery fee is not taxed if it’s listed separately on your receipt and you could have avoided it by picking the order up yourself.9Legal Information Institute. Either way, the fee rule only governs the fee itself; the groceries in the order are still taxed or exempt based on what they are.
