Lever-action rifles are legal to own in California. Their manual cycling action places them outside the state’s assault weapon ban, which reaches only semiautomatic firearms. Ownership still comes with the same purchase, transport, and storage rules that apply to every rifle in the state, plus one wrinkle on the buyer’s age that catches people out. Here is what actually governs a lever-action purchase and what keeps one legal after you take it home.
Why the Assault Weapon Ban Doesn’t Apply
Under Penal Code 30515, a rifle qualifies as an assault weapon only if it is semiautomatic and centerfire, and either accepts a detachable magazine with features like a pistol grip or folding stock, or has a fixed magazine holding more than 10 rounds.1California Legislative Information. Every one of those categories starts with “semiautomatic.” A lever-action rifle fires one round per trigger pull and requires the shooter to work the lever by hand to eject the spent case and chamber the next cartridge. It isn’t semiautomatic, so the definition never engages. That single fact is what makes the whole category legal in California.
Tubular Magazines Are Exempt from the 10-Round Cap
California bans most ammunition feeding devices that hold more than 10 rounds. Penal Code 16740 defines a “large-capacity magazine” but carves out a specific exception: a tubular magazine contained in a lever-action firearm is not a large-capacity magazine, no matter how many rounds it holds.3California Legislative Information. A lever-action rifle with a built-in tube that carries 12 or 14 rounds is legal on that basis alone. The exemption covers all calibers, not just rimfire. It does not extend to detachable box magazines, though. If a lever-action rifle is designed to use a detachable box magazine rather than a fixed tube, the box magazine is still subject to the 10-round limit.
Barrel and Overall Length
Every rifle in California must have a barrel at least 16 inches long and an overall length of at least 26 inches, measured in the shortest configuration in which the rifle will still fire.4California Legislative Information. California Penal Code PEN 17170 Drop below either threshold and the rifle becomes a short-barreled rifle, which is illegal to possess in the state. If you are looking at a used lever-action that appears unusually compact, measure it before you sign paperwork.
Age to Purchase
The default minimum age to buy any firearm in California is 21. Federal law sets the floor at 18 for long guns and most states follow that, but California raised its threshold under Penal Code 27510.5California Legislative Information. California Penal Code PEN 27510
Lever-action buyers get a specific opening. The 21-year minimum does not apply to a firearm that is not a handgun, not a semiautomatic centerfire rifle, and not a frame or receiver, as long as the buyer is at least 18 and holds a valid, unexpired hunting license from the California Department of Fish and Wildlife.5California Legislative Information. How the Purchase Works
Every firearm sale in California must go through a licensed dealer. That includes gun shows and private sales between individuals. There are no exceptions.
Firearm Safety Certificate
Before taking possession of any firearm you need a Firearm Safety Certificate. The exam is 30 written questions on safe handling, storage, and California firearms law, and you need at least 75 percent to pass. The fee is $25 and covers two attempts. Background Check and Fees
The dealer completes a Dealer’s Record of Sale, which submits the transaction to the California Department of Justice for a background check. The DROS fee is $31.19.7State of California – Department of Justice – Office of the Attorney General. Regulations: Dealer Record of Sale (DROS) Fee You will need a valid California driver’s license or state ID showing your current address. If the ID address is out of date, a second government document such as a vehicle registration or voter ID can bridge the gap.
The background check screens for federal disqualifiers such as felony convictions, qualifying domestic violence convictions, active protective orders, mental health commitments, dishonorable discharges, and unlawful drug use, along with California’s own additional categories.
Ten-Day Wait
Once the DROS is submitted, a 10-day waiting period runs before you can take the rifle home. It cannot be expedited or waived. If you need the rifle for a specific date, such as opening day of a hunting season, count backward and buy early.
Transporting the Rifle
California requires rifles to be unloaded during transport. Long guns do not have to be in a locked container the way handguns do, so an unloaded lever-action rifle can travel in a soft case or uncased in the trunk.8State of California – Department of Justice – Office of the Attorney General. The practical habit: any time the rifle is in a vehicle or moving between locations, the action is open, the tube is empty, and the chamber is clear. Keep ammunition separate until you reach the range or the field.
Safe Storage in the Home
Starting January 1, 2026, California requires every firearm owner to store firearms securely inside the home whenever the firearm is not being carried or under the direct control of the owner or another authorized user. Secure storage means locked in a California Department of Justice-certified safety device or kept in a secure gun safe. A rifle standing in a closet no longer meets the standard. A stricter rule applies if someone in your household is prohibited from possessing firearms under state or federal law. Under Penal Code 25135, every firearm must be locked up or under your direct physical control at all times. Modifications That Can Make a Legal Rifle Illegal
A factory lever-action rifle from a maker like Marlin, Henry, or Winchester, with a traditional stock, an 18- to 24-inch barrel, and a tubular magazine, satisfies every California requirement out of the box. Aftermarket work is where owners get into trouble. Adding a pistol grip stock does not create an assault weapon on a lever-action, because the assault weapon definition requires a semiautomatic action. Cutting the barrel under 16 inches, or reducing overall length under 26 inches, does create an illegal short-barreled rifle. Replacing a tubular magazine with a detachable box magazine drops the tubular exemption and pulls the rifle back under the 10-round cap.
Buying used calls for the same checks. Verify barrel length, overall length, and magazine type before the transfer paperwork goes in. A good dealer will catch obvious problems, but confirming it yourself is faster than a failed sale.
