Psychedelics are not legal in Vancouver. Psilocybin, LSD, DMT, mescaline, and related compounds are Schedule III substances under Canada’s federal Controlled Drugs and Substances Act, and that law applies in every province and city without exception.1Justice Laws Website. Controlled Drugs and Substances Act – Schedule III What makes Vancouver different is enforcement, not law: storefront dispensaries sell psilocybin openly, police rarely intervene against personal use, and the gap between the written rules and daily reality is wide enough to confuse almost everyone.
What Federal Law Says
Possessing, producing, selling, or importing any Schedule III substance without authorization from Health Canada is a criminal offence anywhere in Canada. There is no provincial or municipal carve-out. A Vancouver address does not change the statute, and a business license from the City of Vancouver does not authorize anyone to sell a federally controlled drug.
Penalties You Could Face
Simple possession of a Schedule III substance is a hybrid offence. Prosecutors can proceed by indictment, with a maximum of three years in prison, or by summary conviction, where a first offence carries up to six months in jail, a $1,000 fine, or both.2Justice Laws Website. Controlled Drugs and Substances Act – Section 4
Trafficking carries up to ten years on indictment or eighteen months on summary conviction.3Justice Laws Website. Controlled Drugs and Substances Act – Section 5 Life imprisonment is sometimes cited in older write-ups but does not apply to Schedule III drugs; those higher penalties are reserved for Schedule I and II substances like fentanyl and cocaine.

BC’s Decriminalization Pilot Did Not Cover Psychedelics
This is worth saying directly because many people assume otherwise. British Columbia ran a three-year decriminalization pilot from January 31, 2023, through January 31, 2026, allowing adults to possess up to 2.5 grams of certain drugs for personal use.5Province of British Columbia. Decriminalizing People Who Use Drugs in BC The covered substances were opioids like heroin and fentanyl, crack and powder cocaine, methamphetamine, and MDMA. Psilocybin, LSD, and other Schedule III psychedelics were never part of it.
The pilot has also expired. In May 2024, the exemption was amended to prohibit drug use in hospitals, public parks, and other shared spaces, and police regained the power to seize drugs in those settings. The BC government did not seek renewal, and the exemption ended on January 31, 2026.5Province of British Columbia. Why Dispensaries Operate Anyway
Walk through parts of Vancouver and you will see shops selling psilocybin mushrooms, microdose capsules, and infused edibles out of display cases, with branded packaging and point-of-sale systems that look identical to a licensed cannabis retailer. Some hold ordinary municipal business licenses for retail trade. None of that makes the sales legal. A city business license cannot authorize what federal criminal law prohibits.
These shops operate because the Vancouver Police Department exercises wide discretion on drug enforcement. The department has run a Four Pillars drug strategy since 2006, balancing enforcement with prevention, harm reduction, and treatment, and in practice has concentrated resources on organized crime and larger trafficking networks.6Vancouver Police Department. Vancouver Police Department Drug Policy Enforcement against psilocybin dispensaries has been inconsistent: some were raided in 2023 and again in 2024, others continued operating without interruption, and a shop’s survival often tracks whether it draws neighborhood complaints more than whether it is breaking the law.
What that means for you: every transaction at a Vancouver psilocybin shop involves a federally illegal substance. The seller is committing trafficking and the buyer is committing possession.7Justice Laws Website. Controlled Drugs and Substances Act – Sections 4 and 5 Being unlikely to be charged is not the same as being allowed. A shift in departmental priorities, political leadership, or federal posture could change the picture quickly, and there is no legal entitlement to the current leniency.
Grey market products also carry no quality oversight. Unlike substances supplied through Health Canada channels, dispensary mushrooms and edibles are not tested against pharmaceutical standards, and buyers have no reliable way to verify potency, purity, or the absence of contaminants.
The Legal Routes to Psilocybin
There are narrow but genuine legal pathways to psilocybin in Canada. All of them run through Health Canada and require a licensed healthcare provider. Nobody can legally self-prescribe or source these substances independently, even for a medical condition.
Special Access Program
Health Canada’s Special Access Program lets a healthcare practitioner request an unauthorized drug for a patient with a serious or life-threatening condition when conventional treatments have failed or are unavailable.8Health Canada. Health Canada’s Special Access Programs – Request a Drug The ability to request restricted drugs like psilocybin through the program was restored in January 2022.9Health Canada. Section 56 Exemptions
Under Section 56(1) of the Controlled Drugs and Substances Act, the federal Minister of Health can exempt a person or class of persons from the Act’s prohibitions for medical, scientific, or public interest reasons.11Justice Laws Website. Controlled Drugs and Substances Act – Section 56 This is the same provision that authorized the BC pilot, and it can also be granted to individual patients, giving the holder written protection to possess and use a substance under specified terms.
Clinical Trials
Health Canada treats clinical trials as the most appropriate route for advancing psilocybin research. Trials must meet Good Manufacturing Practices and have research ethics board approval, and the drugs used are quality-controlled for known active ingredient levels.9Health Canada. Psilocybin and Psilocin (Magic Mushrooms) Patients interested in participating should start with their healthcare provider.
Do Not Cross a Border With Psychedelics
Vancouver is close enough to the U.S. border that this needs to be stated plainly. Exporting a Schedule III substance from Canada carries up to ten years in prison on indictment.4Justice Laws Website. Controlled Drugs and Substances Act – Section 6 On the American side, psilocybin is a Schedule I substance under the U.S. Controlled Substances Act, and importing it carries up to twenty years in federal prison with substantial fines. A prior felony drug conviction doubles the maximum to thirty years. If anyone dies or suffers serious injury from the substance, mandatory minimums apply and can extend to life imprisonment.12Office of the Law Revision Counsel. 21 USC 960 – Prohibited Acts
A federal drug importation conviction can also bring asset forfeiture, loss of professional licenses, permanent bars on future border crossing, and immigration consequences for non-citizens. The lenient atmosphere in Vancouver has no bearing on how border agents on either side of the line treat the offence.
