THC gummies are legal in Kentucky through two separate pathways. Hemp-derived gummies containing no more than 0.3% delta-9 THC by dry weight can be sold to anyone 21 and older at retail stores across the state. Medical cannabis gummies with higher THC concentrations are legal for registered patients with qualifying conditions, with dispensary sales having started in January 2025. Any THC gummy that falls outside those two categories is illegal and can bring criminal charges.
Hemp-Derived Gummies for Adults 21 and Older
Kentucky uses the federal definition of hemp from the 2018 Farm Bill: cannabis with a delta-9 THC concentration at or below 0.3% on a dry weight basis.1Kentucky Legislative Research Commission. Concurrent Resolution Urging Congress to Reassess the Federal Definition of Hemp Products that fit within that ceiling are treated as hemp, which means gummies containing delta-8, delta-10, and low-concentration delta-9 THC can be manufactured, sold, and possessed legally as long as the finished product stays under the threshold.
House Bill 544, signed in March 2023, directed the Cabinet for Health and Family Services to regulate these products.2Kentucky Legislative Research Commission. House Bill 544 Under 902 KAR 45:190, a few rules matter to anyone picking a gummy off the shelf:
- You must be 21 to buy. Intoxicating hemp-derived cannabinoid products, including delta-8 and delta-9 gummies, cannot be sold, gifted, or transferred to anyone under 21.3Kentucky Legislative Research Commission. AN ACT Relating to the Regulation of Hemp-Derived Products
- Packaging must be child-resistant and tamper-evident.4Kentucky Legislative Research Commission. 902 KAR 45:190
- Packaging cannot use cartoon images, mimic candy or snack branding, or include the words “candy” or “candies.”4Kentucky Legislative Research Commission. 902 KAR 45:190
- Labels must show total cannabinoid content per serving and per container, and those numbers must match third-party lab results.4Kentucky Legislative Research Commission. 902 KAR 45:190
The age rule applies only to intoxicating products. Non-intoxicating hemp products like CBD gummies can still be sold to people under 21.4Kentucky Legislative Research Commission. 902 KAR 45:190
Checking That a Legal Gummy Is Also a Safe One
Legal is not the same as safe. The FDA has not approved delta-8 THC for any use. Between December 2020 and February 2022, the agency received 104 adverse event reports tied to delta-8 products, and 55% required emergency medical evaluation or hospitalization. Manufacturing is part of the reason. The amount of delta-8 that occurs naturally in hemp is small, so producers usually convert CBD into delta-8 through a chemical process that can introduce harmful byproducts if done poorly.5U.S. Food and Drug Administration. 5 Things to Know about Delta-8 Tetrahydrocannabinol – Delta-8 THC Before buying, ask for a Certificate of Analysis from an independent, accredited lab. A useful COA shows cannabinoid potency per serving, tests for pesticides and heavy metals, and confirms delta-9 THC at or below 0.3%. If the retailer can’t produce one, or the one on file lacks batch-specific data, walk away.
Medical Cannabis Gummies for Registered Patients
Kentucky’s medical cannabis program, created by Senate Bill 47 in 2023, is the second legal pathway.6Kentucky Legislative Research Commission. 23RS SB 47 Dispensaries began serving patients in January 2025. Unlike hemp gummies available to any adult, medical products require a patient card and a practitioner’s written certification.
Who Qualifies
You must be diagnosed with one of the following conditions:
- Any type or form of cancer, regardless of stage
- Chronic, severe, or debilitating pain
- Epilepsy or other intractable seizure disorders
- Multiple sclerosis, muscle spasms, or spasticity
- Chronic nausea or cyclical vomiting syndrome resistant to conventional treatment
- Post-traumatic stress disorder
The Kentucky Center for Cannabis can also approve additional conditions where sufficient scientific evidence supports medical cannabis use.7Kentucky Legislative Research Commission. Chapter 146 SB 47
Product Limits
Medical edibles, gummies included, are capped at 10 milligrams of delta-9 THC per serving.7Kentucky Legislative Research Commission. Chapter 146 SB 47 No product may contain vitamin E acetate.
Cost and Application
Get a written certification from a medical cannabis practitioner confirming your qualifying condition, then apply through the Kentucky Medical Cannabis Program. Visiting Patients
Kentucky recognizes valid medical cannabis cards from other states. Visiting patients can purchase at Kentucky dispensaries without applying for a Kentucky card by presenting their out-of-state card, another form of government-issued photo ID, and documentation of the qualifying diagnosis.9Kentucky Medical Cannabis Program. What Is Still Illegal
Marijuana remains a Schedule I controlled substance in Kentucky outside the medical program.10Cabinet for Health and Family Services. 902 KAR 55-015 Schedules of Controlled Substances A gummy that isn’t a compliant hemp product and isn’t an authorized medical cannabis product is contraband, and possessing it is a crime.
Possession of marijuana is a Class B misdemeanor, punishable by up to 45 days in jail and a fine of up to $250. - Less than 8 ounces, first offense: Class A misdemeanor, up to 12 months in jail
- Less than 8 ounces, subsequent offense: Class D felony, 1 to 5 years
- 8 ounces to under 5 pounds, first offense: Class D felony, 1 to 5 years
- 8 ounces to under 5 pounds, subsequent offense: Class C felony, 5 to 10 years
- 5 pounds or more, first offense: Class C felony, 5 to 10 years
- 5 pounds or more, subsequent offense: Class B felony, 10 to 20 years
Felony convictions also carry fines up to $10,000. Trafficking in Kentucky isn’t determined by intent to sell alone. Quantity by itself can push a case into trafficking territory.
Drug Testing and Your Job
A workplace drug test detects THC metabolites without distinguishing a hemp gummy from a medical product or an illegal edible. A positive result reads the same regardless of source. Most private employers in Kentucky are not required to accommodate off-duty THC use, even when the product was legal at the point of purchase.
The stakes are highest in safety-sensitive transportation roles. The U.S. Department of Transportation confirmed in February 2026 that marijuana remains unacceptable for workers subject to federal drug testing, even after the December 2025 executive order directing rescheduling. Taking Gummies Across State Lines
Federal law bars states from blocking the transport of lawfully produced hemp through their territory.14eCFR. 7 CFR 990.63 Interstate Transportation of Hemp On paper, a hemp gummy under 0.3% delta-9 THC is legal to carry across state lines. On the ground, it’s messier. A TSA officer or a police officer during a traffic stop cannot tell a compliant hemp gummy from an illegal marijuana edible by looking at it. TSA’s focus is security rather than drug enforcement, but agents who find what appears to be an illegal substance are required to report it to local law enforcement.
If you travel with hemp-derived gummies, keep the original packaging with lab-tested potency labeling and, ideally, a copy of the product’s Certificate of Analysis. That documentation supports compliance without guaranteeing a smooth encounter. Medical cannabis cards do not protect you in states without reciprocity, and marijuana remains federally prohibited for air travel regardless of a state-level card.
