Yes, THC gummies are legal in New York for adults 21 and older, provided you buy them from a dispensary licensed by the state’s Office of Cannabis Management. The Marihuana Regulation and Taxation Act, signed on March 31, 2021, legalized adult-use cannabis and set up the regulated market that edibles now move through.1Office of Cannabis Management. Marihuana Regulation and Taxation Act (MRTA) and the Public Comment Process The rules layered on top of that basic legality — where you can buy, how much you can carry, where you can eat one, and what happens if you drive after — are what most people actually need to know.
Who Can Buy and Where
You have to be 21 to purchase, and you have to buy from a licensed adult-use retailer. Any other storefront selling THC gummies is operating illegally, no matter how the signage reads.2Office of Cannabis Management. Adult-Use Information This matters more than it sounds. New York, and New York City in particular, has seen a wave of unlicensed shops selling products with inaccurate THC labeling, no contaminant testing, and no oversight of any kind.
Two ways to check: licensed dispensaries are required to post a Dispensary Verification Tool near the main entrance, and the OCM publishes a “Buy Legal Map” of every licensed retailer in the state.3Office of Cannabis Management. Dispensary Location Verification If the shop isn’t on the map, walk out.
Potency and Packaging Limits
Every gummy package sold at a licensed dispensary follows the same caps. A single serving is limited to 10 milligrams of THC, and a package cannot exceed 100 milligrams total.4New York State Office of Cannabis Management. Know Your Edibles New York So a full package holds ten servings at most.
Those numbers matter if you’re new to edibles. A gummy takes anywhere from 30 minutes to two hours to take effect, and it lasts considerably longer than smoking. Eating a second gummy because the first “isn’t working yet” is one of the most common first-time mistakes.
Packaging must be child-resistant for the product’s full lifespan, tamper-evident, and resealable if the package holds more than one serving.5New York State Office of Cannabis Management. Part 128 and 129 PLMA Adopted Regulations Contrary to what some assume, transparent packaging is allowed as long as it doesn’t degrade the product.6Office of Cannabis Management. Part 128 Packaging and Labeling Guidance It just cannot be designed to appeal to anyone under 21.
How Much You Can Carry
New York separates public possession from what you can keep at home. In public, adults 21 and over can possess up to three ounces of cannabis flower and 24 grams of concentrated cannabis, which is the category gummies fall into.2Office of Cannabis Management. Adult-Use Information
At home the limit is much higher: up to five pounds of trimmed cannabis and an equivalent weight in concentrates.7New York State Office of Cannabis Management. Home Cultivation Overview The OCM recommends storing everything locked and out of reach of children and pets.
What Happens If You Go Over
Slightly over the public limit is treated as a violation rather than a crime, with a maximum $125 fine. The penalties climb fast, though. Possessing more than 16 ounces of flower or more than five ounces of concentrate is criminal possession in the third degree, a Class A misdemeanor carrying up to a year in jail.8NY Courts. Where You Can Eat a Gummy
The general rule tracks tobacco: you can consume cannabis wherever tobacco smoking is allowed. Your home is always fine, and most outdoor public spaces where tobacco is permitted work too. Off-limits: motor vehicles, federal property (which includes public housing), restaurants and bars including patios, hookah and cigar bars, and most public parks and beaches.9New York Office of Cannabis Management. Know Your Rights With Cannabis
Gummies don’t produce smoke or vapor, so the tobacco comparison feels off. It doesn’t matter. The public-consumption restrictions cover all forms of cannabis, so quietly eating a gummy at a restaurant table is still a violation.
Driving After a Gummy
Do not do this. New York treats driving after consuming THC as Driving While Ability Impaired by a Drug, and the first-offense penalties match a DWI: a mandatory fine of $500 to $1,000, up to one year in jail, and license revocation for at least six months.10Department of Motor Vehicles. Penalties for Alcohol or Drug-Related Violations Another $395 in surcharges and fees is tacked on. Edibles complicate the timing: effects can last four to six hours or longer, so a gummy eaten at lunch can still impair you at dinner.
Your Job and Your Lease
New York’s workplace protections are stronger than most states’. The MRTA amended Labor Law Section 201-d to make off-duty, off-premises cannabis use a protected activity, similar to off-duty alcohol use. An employer cannot fire you, refuse to hire you, or discriminate against you for using cannabis outside work, away from the workplace, and without using company equipment.11New York Department of Labor. Adult Use Cannabis and the Workplace, New York Labor Law 201-d A positive drug test alone cannot be used as evidence of impairment, since THC tests detect prior use rather than current impairment.
The protections aren’t absolute. Employers can still ban possession on company property, ban use during work hours including breaks, and act on visible impairment at work. And some jobs are carved out entirely — commercial truck drivers under federal DOT rules, for example, or any position where tolerating cannabis use would cost the employer a federal contract or federal funding.
On housing, landlords cannot refuse to rent to you solely because you use cannabis.12Office of Cannabis Management. Landlords They can ban smoking or vaping on the property and can prohibit growing plants. A smoking ban in your lease wouldn’t cover eating a gummy in your apartment, since nothing is being burned.
Hemp-Derived Gummies Are a Separate Category
Not every THC gummy you see for sale comes through the adult-use dispensary system. Hemp-derived products containing Delta-8 or Delta-9 THC have circulated online and in convenience stores under a gray area tied to the 2018 federal Farm Bill, which legalized hemp containing less than 0.3% Delta-9 THC by dry weight. New York regulates these through its Cannabinoid Hemp Program, with its own THC limits.
That’s changing. A provision in the 2025 federal appropriations law, set to take effect in November 2026, will restrict hemp-derived products to no more than 0.4 milligrams of total THC per container, a trace amount that would effectively remove intoxicating hemp gummies from the legal market.13New York State Office of Cannabis Management. Hemp and the 2025 Federal Appropriations Law What New Yorkers Need to Know After that date, any gummy strong enough to produce a noticeable effect will only be available through licensed adult-use or medical dispensaries.
Federal Property, Airports, and State Lines
Cannabis is still a Schedule I controlled substance under federal law. A proposed rulemaking to move it to Schedule III is pending an administrative law hearing as of late 2025, but no rescheduling has taken effect.14The White House. Increasing Medical Marijuana and Cannabidiol Research Until it does, carrying THC gummies onto federal property — national parks, military installations, federal courthouses, public housing — is a federal offense even in New York.
Air travel works the same way. The TSA doesn’t actively search for cannabis, but officers are required to report any suspected violation of law they find during screening, and cannabis products including gummies remain illegal to bring through security or onto a plane.15Transportation Security Administration. Complete List (Alphabetical) Federal first-offense possession carries up to one year of incarceration and a $1,000 fine. Crossing state lines with gummies is also a federal offense, even when both states have legalized cannabis.
What You Actually Pay at the Register
The dispensary price includes two layers of tax. A 13% excise tax applies at retail, with 9% going to the state and 4% split between the county and local municipality.16Tax Policy Center. How Do State and Local Cannabis (Marijuana) Taxes Work Distributors also pay a potency-based tax of 3 cents per milligram of THC on edibles, which shows up in the shelf price. A package at the 100-milligram cap carries $3 in potency tax before the excise tax is even calculated.
