Building a residential pool in Arizona means complying with two layers of rules at once: state barrier standards set by A.R.S. § 36-1681, and the local building codes your city has adopted for structural, electrical, and plumbing work. Arizona pool building codes apply to any contained body of water at least 18 inches deep and wider than eight feet, which covers most in-ground pools, above-ground pools, and spas. Get the details right before you break ground and you avoid failed inspections, fines, and expensive rebuilds.
How State Law and Local Codes Fit Together
A.R.S. § 36-1681 sets the statewide floor for pool enclosures. On top of that, your city adopts a building code (most Arizona jurisdictions follow some edition of the International Residential Code) that governs the rest of construction.1International Code Council. Barrier and Fence Requirements
Under state law, the enclosure around your pool must meet every one of these standards:2Arizona Legislature. Arizona Revised Statutes Title 36 – Section 36-1681
- At least five feet tall, measured from the outside.
- No gap large enough for a four-inch sphere to pass through.
- Horizontal components spaced at least 45 inches apart vertically, or placed on the pool side. If they sit on the pool side, horizontal openings cannot exceed one and three-quarter inches. Chain-link or wire mesh must use a maximum mesh size of one and three-quarter inches.
- No exterior handholds or footholds on the outside face.
- At least 20 inches from the water’s edge.
These rules apply to in-ground and above-ground pools alike. For an above-ground pool, the pool wall itself can count as part of the barrier if it meets the height and gap rules, but external ladders and steps have to be removed or locked when the pool is not in use.
Gate Rules
Every gate must open outward, away from the pool, and be both self-closing and self-latching. The latch has to sit at least 54 inches above the ground. Place it lower and it must be on the pool side of the gate, with the release mechanism at least five inches below the top and no opening larger than half an inch within 24 inches of that release.2Arizona Legislature. The statute also permits a padlock, keyed lock, electric opener, or integral combination lock as an alternative. With one of those, the latch can sit at any height.2Arizona Legislature. When the House Wall Forms Part of the Enclosure
Plenty of Arizona pools sit right behind the house, with the home’s back wall serving as one side of the barrier. The statute allows it, but you have to pick one of three ways to compensate for the missing fence section:2Arizona Legislature. Arizona Revised Statutes Title 36 – Section 36-1681
- A four-foot barrier between the house and the pool that still meets all the gap, climbing, and gate rules above.
- A motorized safety pool cover operated by a key switch and meeting ASTM emergency standard F 13-89, with no manual operation beyond the key switch.
- Self-latching doors on every ground-level door with pool access, plus secured windows.
You pick one; they are not stacked. The motorized cover meeting ASTM F 13-89 adds real cost, so most homeowners choose the four-foot fence or the self-latching door route.
If you go with self-latching doors, each door opening onto the pool area needs a latch meeting the same specifications as a gate latch. Windows are handled by purpose. Emergency escape windows in sleeping rooms that open toward the pool need a latching device at least 54 inches above the floor. Every other openable window with pool access needs one of three things: a screwed-in-place wire mesh screen, a keyed lock that stops the window from opening more than four inches, or a latch at least 54 inches above the floor.2Arizona Legislature. Who Is Exempt

- Homes where every resident is at least six years old. Your city may still require a barrier under its local ordinance regardless of household ages.
- Pools and barriers built before the statute took effect. Renovation or barrier replacement usually triggers current code.
- Stock ponds, livestock troughs, and irrigation used in normal agricultural operations.
- Public and semi-public pools, which fall under separate health department rules.
- Cities with their own pool barrier ordinance at least as strict as the state law; the city rule governs.
The age-based exemption creates the most confusion. Even if you qualify today, selling the home to a family with young children can create liability exposure, and inspectors and agents will flag the missing barrier regardless.
Electrical, Drain, and Placement Standards
Pool electrical work has to comply with Article 680 of the National Electrical Code, adopted by Arizona municipalities through their local codes. The central requirement is equipotential bonding: the pool shell, structural reinforcing steel, metallic parts, underwater lighting brackets, metal fittings, perimeter surfaces extending three feet beyond the pool walls, and the water itself all have to be bonded together using solid copper conductors no smaller than 8 AWG.4National Electrical Code. A licensed electrician experienced with pool installations should handle it, and a separate electrical permit and inspection are required in most jurisdictions.
Federal law requires every pool and spa drain cover sold in the United States to meet the ANSI/APSP-16 performance standard for entrapment protection. Your contractor’s drain covers must be compliant on any new residential pool.5PoolSafely.gov. Setbacks and clearances come from your local code. A common minimum is three feet from property lines, but this varies significantly across Arizona cities, so confirm with your building department. Pool water surfaces must maintain a minimum vertical clearance of 22.5 feet from overhead electrical conductors. Underground wiring is not permitted directly beneath a pool and must sit at least five feet from the pool’s edge. Power lines crossing your yard can limit placement or force you to have the utility company raise or relocate them.
Draining a Pool
Arizona is a desert state, and how you get rid of pool water is regulated. Rules vary by municipality, but the general framework is consistent. Saltwater pools must be drained to the sanitary sewer; discharging salt water onto your yard or into storm drains is prohibited. For conventional chlorinated pools, you have to dechlorinate the water to below one part per million before draining outdoors, and the water has to stay on your property without causing erosion or running onto a neighbor’s lot. Acid wash water cannot leave your property or enter the sewer. Filter backwash can generally soak into your own ground, but it cannot flow off-site to streets or drainage channels. Check with your local utility or environmental services department for the specifics.
Permits and Inspections
No pool construction can start without a building permit from your local jurisdiction. The application typically requires a site plan showing placement relative to property lines and structures, engineering and structural drawings, and separate electrical and plumbing plans. Your contractor usually files the paperwork, but you as the homeowner are ultimately responsible for making sure the work is permitted and inspected.
The project then moves through mandatory inspections at key milestones. Two matter most:
- Pre-gunite (or pre-shell) inspection, after the steel reinforcement, plumbing, and electrical bonding are in place but before concrete goes on. Fixing problems after the shell is poured is enormously expensive, which is why this inspection exists.
- Pre-plaster (barrier) inspection, after the pool structure is complete but before plaster is applied and water is added. The inspector verifies barrier, gate, door, and window compliance. You typically need to be present, and the pool cannot be filled until this passes.
Some cities add inspections for electrical, plumbing, or deck work depending on scope. Your permit paperwork will list every required inspection and when it happens.
Penalties and Liability for Non-Compliance
Violating Arizona’s pool enclosure requirements is a petty offense. The law gives you a way out of the fine: install a compliant barrier within 45 days of being cited and complete an approved swimming pool safety course, and the court cannot impose a fine.3Arizona Legislature. The criminal penalty is the smaller problem. A non-compliant barrier exposes you to serious civil liability if a child reaches the pool and is injured or drowns, and homeowners insurance policies often carry exclusions or limits for pools that fail code. You can end up facing a lawsuit and a coverage denial at the same time.
