Arizona Traffic Ticket and Complaint: Pay, Contest, or Dismiss

If you get a traffic ticket in Arizona, you have until the date printed on the front of the citation to do one of three things: pay the fine, elect Defensive Driving School if you qualify, or notify the court you are pleading not responsible and want a hearing. Your signature on the ticket is a written promise to respond by that date.1cite azdot penalties Miss it and the court can enter a default judgment, suspend your license, or issue a warrant, depending on the charge.

Read the Ticket Before You Do Anything

Every Arizona citation uses the same statewide form, and it tells you where and how to respond.2cite 28-1557 Find three things on it first.

The court. Your case is assigned to a specific Municipal Court or Justice Court based on where the stop happened, and every action you take must go through that court. Nothing you file with a different court counts.

The deadline. It is printed on the front. Everything below assumes you act before it.

The classification: civil or criminal. Civil traffic violations cover most everyday moving infractions, such as speeding, running a red light, and unsafe lane changes. These are non-criminal matters handled under Title 28 of the Arizona Revised Statutes.3cite 28-1591 Criminal traffic violations are misdemeanors or felonies: DUI, criminal speed (more than 20 mph over the limit or 85 mph and above), reckless driving, and driving on a suspended license. Criminal charges carry possible jail time and require a mandatory court appearance.4cite Pima County The classification controls almost everything that follows, including whether Defensive Driving School is even on the table.

Your Three Response Paths

Before the due date, you commit to one of three tracks: plead responsible and pay, elect Defensive Driving School (civil only), or plead not responsible and contest the charge. These are mutually exclusive. Once you commit, you generally cannot switch. Your choice has to reach the court on the citation before the deadline.

Paying the Fine

Pleading responsible closes the case fastest, but it puts a conviction on your record and points on your license.

The base fine for a civil traffic violation in Arizona cannot exceed $250.5cite Justia 28-1598 The number on your payment notice will be higher, sometimes much higher, because Arizona law adds three surcharges on top of every civil traffic penalty: 42%, 7%, and 6%, all calculated on the base fine.6cite 12-116.01 On a $250 base fine, those surcharges alone add $137.50, and court fees push the total up further.

Most courts take payment online through a court portal, by mail, or in person at the clerk’s office. You will need your citation number. Once payment is processed, the court reports the conviction to the Motor Vehicle Division (MVD).

If You Cannot Pay All at Once

Arizona courts offer the Compliance Assistance Program (CAP), which lets you make a down payment and set up monthly installments without seeing a judge. While you are enrolled in CAP, the court tells MVD you are in compliance, which can prevent or lift a license suspension tied to unpaid fines. Defensive Driving School

For eligible civil violations, Defensive Driving School is the best realistic outcome. The citation is dismissed, no points go on your record, and no conviction is reported to MVD.

You qualify only if all of the following apply:

  • The charge is a civil traffic moving violation, not a criminal offense and not a parking or standing violation.
  • You have not attended Defensive Driving School for a citation issued within the past 12 months. Eligibility runs from the date of the current violation, not from when you last took the course.8cite azcourts.gov DDS
  • You finish the course no later than seven days before your court date.8cite azcourts.gov DDS
  • If you hold a commercial driver’s license, you were driving a vehicle requiring a Class D or Class M license and it was not being used commercially.9cite ARS 28-3392

The cost has four parts: a school fee set by the school, a state fee, a state surcharge, and a court diversion fee. The diversion fee varies by county and changes in April and October each year. Check your specific court’s cost on the Arizona Judicial Branch website before enrolling.10cite azcourts.gov cost to attend

One thing not to expect: an insurance discount for taking the course. Most auto insurers offer a premium discount for voluntary defensive driving courses, but they specifically exclude court-ordered ones.11cite GEICO The real insurance benefit is that no conviction reaches your record, so your insurer never sees the violation at all.

Contesting the Ticket

If you did not commit the violation, you can fight it. How that works depends on whether the charge is civil or criminal.

Civil Traffic Hearings

To contest a civil ticket, notify the court by your due date that you are pleading not responsible. Usually that means checking the “Not Responsible” box on the citation and mailing it in, or filing online or in person. The court schedules a civil traffic hearing.

At the hearing, the state must prove the violation by a preponderance of the evidence, meaning more likely than not. That is a lower bar than the “beyond a reasonable doubt” standard used in criminal cases. The citing officer or another state witness testifies, and you can cross-examine. You can present your own evidence and witnesses. If the state’s witness does not show up, the court dismisses the complaint. If you are found not responsible, any deposit is returned. If found responsible, the court enters a judgment and imposes the penalty and surcharges.12cite civil traffic rules PDF

Criminal Traffic Cases

Criminal traffic charges follow a different track. You must appear at an initial hearing, where the judge reads the charges, advises you of your rights, and asks for a plea of guilty, not guilty, or no contest.13cite AZ Court Help initial appearances A not guilty plea sends the case to a pretrial conference or trial.

You have the right to an attorney at every stage. If you cannot afford one, you can request a court-appointed attorney, but the court will only grant that request if the prosecution is seeking jail time. Even if appointed, you may have to reimburse some or all of the fees.14cite AZCourtHelp criminal traffic

In either civil or criminal cases, you can request discovery from the prosecution, including the police report and any evidence the state plans to use.

Points and Why Defensive Driving School Matters

Every civil traffic conviction reported to MVD carries a point value that stays on your record. Arizona’s schedule assigns points by severity:15cite AZDOT points assessment

  • 2 points: most standard moving violations, such as unsafe lane change or failure to signal
  • 3 points: speeding, and driving over or parking in a gore area
  • 4 points: failure to stop for a signal or stop sign causing serious injury
  • 6 points: leaving the scene of an accident, or failure to stop causing death
  • 8 points: DUI, extreme DUI, reckless driving, aggressive driving

Accumulate eight or more points in any 12-month period and MVD will require you to attend Traffic Survival School or face a license suspension.16cite AZDOT TSS Traffic Survival School is separate from Defensive Driving School; it is assigned by MVD, not a court, and it does not dismiss citations.

Because Defensive Driving School ends in dismissal rather than conviction, no points attach. That is the clearest reason to elect it whenever you qualify.

Photo Enforcement Tickets Are Different

Red-light and speed camera tickets do not work the same as a traffic stop. Arizona law distinguishes between an actual citation and a preliminary “notice of violation.” A notice of violation is not a court-issued document, and you are under no legal obligation to respond to it or identify the driver.17cite AZ AG opinion

For a photo enforcement citation to be enforceable, it must be formally served, either by direct delivery or through the methods authorized by Arizona’s civil procedure rules. If the agency uses alternative means such as mail, it must tell you that you have no obligation to identify the driver or respond, and that failure to respond may result in formal service with additional fees.17cite AZ AG opinion The citation also has to be issued within 60 days of the alleged violation.18cite 28-1592

If you only receive a mailed notice and are never formally served with the actual uniform traffic ticket and complaint, the case generally cannot proceed. If you are properly served, treat it like any other ticket and respond by the due date.

If You Have an Out-of-State License

An out-of-state license does not insulate you from an Arizona ticket. Arizona participates in interstate compacts that share conviction and noncompliance information between states. Fail to respond and your home state’s motor vehicle agency will be notified and can suspend your driving privileges there.19cite AAMVA NRVC Member states also report convictions to your home state within 15 days, and your home state treats the offense as if it had happened locally for points, suspensions, and insurance reporting.20cite DLC info Handle the citation through the court on the ticket, the same as a resident would.

What Happens If You Miss the Deadline

Missing your response date is the most expensive mistake you can make, and how bad it gets depends on the charge.

Civil Violations

If you fail to respond, the court enters a default judgment finding you responsible for the full fine, surcharges, and an added default fee.21cite AZCourtHelp FTA The court then notifies MVD to suspend your driving privileges until the judgment is satisfied. You will also owe MVD a $10 reinstatement fee to restore your license after you clear the judgment.22cite ServiceArizona fees Collection fees may be added over time. Criminal Violations

Failing to appear on a criminal traffic charge triggers a bench warrant for your arrest. The court also orders MVD to suspend your license. On top of the original charge, the failure to appear becomes a separate criminal offense. Under Arizona law, failing to appear after giving a written promise to appear (which is what your signature on the ticket represents) is a Class 2 misdemeanor. If you were required by law to appear in connection with a misdemeanor, the failure to appear charge escalates to a Class 1 misdemeanor.23cite ARS 13-2506 You now face two criminal cases instead of one, with additional fines and potential jail time for each.

Respond by the date on the citation even if your response is only to request more time or ask about a payment plan. Every option on the ticket gets worse the moment that deadline passes.
