Arkansas Emotional Support Animal Laws and Requirements

Arkansas emotional support animal laws rest mostly on the federal Fair Housing Act, with a 2023 state statute layered on top that changes how ESA letters have to be written. If you have a legitimate ESA, an Arkansas landlord generally has to let you keep the animal without pet fees or pet deposits, even in a no-pet building. But the letter supporting your request has to come from a licensed provider who has actually been treating you, and the protection stops at your front door: ESAs have no right to enter restaurants, stores, or airplane cabins in Arkansas.

Housing Rights for ESA Owners

The federal Fair Housing Act prohibits disability-based discrimination in housing, and the Arkansas Fair Housing Act is considered substantially equivalent to it.1Arkansas Department of Inspector General. What that means in practice: a landlord with a no-pet policy still has to make a reasonable accommodation for a tenant whose disability creates a need for an ESA. Once the landlord receives a proper accommodation request with supporting documentation, they must allow the animal. They cannot charge a pet deposit, a pet fee, or monthly pet rent for it.3U.S. Department of Housing and Urban Development. When a Landlord Can Still Refuse

The accommodation right is not absolute. A landlord can deny a specific ESA request in three narrow situations:

  • The animal poses a direct threat to the health or safety of others that no lesser accommodation could address.
  • The animal would cause substantial physical damage to the property that no lesser accommodation could prevent.
  • Granting the request would impose an undue financial or administrative burden on the housing provider.

These findings have to be based on the individual animal’s actual behavior or history, not on assumptions about a breed or size.

A separate set of rentals is exempt from the FHA entirely. Under federal law, a single-family home rented by an owner who owns no more than three such homes and rents without a broker is exempt, and so are owner-occupied buildings with no more than four units.4Office of the Law Revision Counsel. 42 USC 3603 – Effective Date of Subchapter If you’re renting from one of these owners, the accommodation right may not apply.

The 30-Day Provider Relationship Rule

This is the Arkansas-specific piece most people miss. In 2023, the legislature passed HB1420, which requires that a licensed mental health professional have an established therapeutic relationship with the patient for at least 30 days before writing an ESA letter.5Arkansas State Legislature. Beyond that timing requirement, the letter itself has to meet the standard HUD lays out: it should come from a licensed healthcare professional (a physician, psychologist, psychiatrist, or licensed therapist), and it should confirm that you have a disability substantially limiting a major life activity and that the ESA provides therapeutic support alleviating a symptom or effect of that disability.6HUD Exchange. Telehealth and Online Letters

Telehealth is not automatically disqualifying. HUD distinguishes between legitimate remote care and websites that sell certificates to anyone who pays a fee. A licensed provider delivering real care over telehealth can produce a valid ESA letter; a pay-for-a-letter site cannot.7U.S. Department of Housing and Urban Development. Landlords are allowed to request documentation when the disability or the need for the animal is not obvious. They cannot demand your full medical records, insist on a specific diagnosis, dictate the format of the letter, or require annual renewals for a permanent condition.

Deposits and Damage Liability

The no-fee rule is often misread as no-liability. It isn’t. A landlord cannot charge you a pet deposit, pet fee, or pet rent for your ESA. But if the animal damages the unit beyond normal wear and tear, whether that’s scratched floors, stained carpet, or chewed trim, the landlord can deduct the repair cost from your standard security deposit the same way they would for any other damage you or a guest caused.3U.S. Department of Housing and Urban Development. Photograph the unit at move-in and keep a written condition checklist. That record is what protects you if a landlord later blames the animal for pre-existing damage. Renter’s insurance with pet liability coverage is also worth looking at, since an ESA that bites or injures someone can create personal liability separate from anything the lease covers.

Service Animals vs. ESAs

The two categories are not interchangeable, and the difference decides where the animal is allowed to go. Under the ADA, a service animal is a dog (or in some cases a miniature horse) individually trained to perform a specific task tied to the handler’s disability, such as guiding a blind person, alerting a deaf person, or interrupting a panic attack with pressure therapy.8U.S. Department of Justice. ESAs are protected only in housing. Service animals are protected in housing, businesses, government buildings, public transportation, and virtually anywhere the public is allowed. ESAs can be any species; ADA service animals are limited to dogs and miniature horses. Public Places and Air Travel

An ESA has no right to enter a restaurant, grocery store, movie theater, or any other business in Arkansas. A business that turns away your ESA is acting within the law, and presenting an ESA letter does not change that. Some businesses choose to welcome well-behaved animals, but that’s their decision, not your right.

Air travel changed in 2021. The Department of Transportation’s December 2020 final rule revising the Air Carrier Access Act took effect in January 2021 and stated that ESAs are no longer treated as service animals for airline purposes.11U.S. Department of Transportation. Psychiatric service dogs trained to perform a specific task still fly in the cabin at no charge under the revised rules.

ESAs in Arkansas Campus Housing

The Fair Housing Act reaches dormitories and other university-owned housing because they are dwellings. An Arkansas college cannot refuse an ESA accommodation just because pets aren’t ordinarily permitted in student housing.3U.S. Department of Housing and Urban Development. Universities can have their own accommodation paperwork on top of the letter, but they cannot impose requirements that conflict with fair housing law, such as excluding certain species without an individualized assessment. The ESA is limited to the student’s own living space. Classrooms, dining halls, libraries, and other campus buildings follow the ADA public-access rules, which cover service animals only.

If a Landlord or University Denies Your Request

You can file a housing discrimination complaint with HUD or with the Arkansas Department of Inspector General, which handles fair housing enforcement at the state level.1Arkansas Department of Inspector General. Fair Housing Laws Under federal law, the complaint generally has to be filed within one year of the discriminatory act. You can also skip the administrative process and file a federal lawsuit directly.

Remedies can include an order requiring the landlord to allow the animal, monetary damages for the harm caused, and in some cases attorney’s fees. Save every email, text, and letter connected to the request, including the accommodation request itself, whatever documentation you submitted, and the landlord’s response. A written trail is worth more than any account of what was said in a phone call.

Faking an ESA

Arkansas does not have a statute that specifically criminalizes misrepresenting a pet as an ESA. Some states, including Florida and Virginia, have fines for ESA fraud; Arkansas has not passed one as of 2026. That doesn’t make the practice safe. Submitting a fabricated ESA letter can support a lease termination for material misrepresentation, and a business can eject and ban someone caught faking ESA status.
