Arkansas Makes Gold and Silver Legal Tender: Exemption and Federal Tax

What Arkansas Actually Exempts

The 2023 law, Act 595, does two things on the tax side. That second piece is the bigger deal for anyone who’s held metals for a while. If you bought gold ten years ago and sell it today at a substantial profit, Arkansas takes nothing from the gain. The state’s view is that you swapped one form of money for another, not that you sold an investment asset.

The Act also says specie cannot be characterized as personal property for taxation or regulatory purposes. That single line is what supports the broader tax treatment: the state stops seeing gold and silver as an asset in your portfolio and starts treating them as money.

What Counts as Specie

Only certain gold and silver qualifies. The law defines specie as coins containing gold or silver, plus refined bullion stamped with its weight and purity, and the metal has to be valued primarily for its content rather than as a collectible or novelty.1Justia Law. Coins issued by the United States Government fit cleanly. American Gold Eagles and American Silver Eagles are the clearest examples. Numismatic pieces bought for their rarity rather than their metal content sit outside the definition. If you’re paying a premium because a coin is old or scarce, you’re buying a collectible, and the exemption isn’t designed for that.

Federal Tax Still Hits Your Gain

The 28 Percent Rate on Long-Term Gains

Sell precious metals you’ve held for more than a year at a profit, and the gain is taxed at a maximum federal rate of 28 percent. That’s higher than the 0, 15, or 20 percent long-term capital gains rates that apply to stocks and most other investments. The upshot: an Arkansas resident can sell gold in Little Rock, owe the state nothing, and still owe the IRS up to 28 percent on the profit. Reading “legal tender” as “tax-free” is a mistake that catches people at filing time.

Broker Reporting

Brokers and dealers must file Form 1099-B on certain precious metal sales, but the trigger is tied to quantities used in CFTC-approved futures contracts. Selling a single coin generally won’t produce a 1099-B. A parent who bought gold at $400 an ounce and dies when it’s worth $3,000 leaves the heir a basis of $3,000, wiping out the unrealized gain. The heir owes federal capital gains tax only on appreciation above that reset figure.

Arkansas’s rule that specie isn’t personal property for state tax purposes may shape how the state handles estate-level treatment, but the federal side operates independently. Large holdings deserve a look from a tax professional who understands both the state exemption and the federal collectibles classification.

Why the Exemption Rarely Comes Up in Everyday Purchases

The state tax break matters most for holders and traders, not for people trying to buy groceries with a gold coin. The Act authorizes specie as a payment option, but no one is required to accept it. Leaving Arkansas Changes the Math

The state exemption is Arkansas-specific. If you sell gold in a state that taxes precious metals gains, you can owe state tax there even though the same sale at home would have been tax-free. Cross-border transactions and moves to another state can undo the benefit, so residency and the location of the sale matter.
