Ashley Benefield Case: Shooting, Verdict, and Appeal

The Ashley Benefield case ended with the former ballerina convicted of manslaughter with a firearm for fatally shooting her estranged husband, Doug Benefield, at her Lakewood Ranch, Florida home on September 27, 2020. A Manatee County jury acquitted her of second-degree murder on July 30, 2024, and Circuit Judge Stephen Whyte sentenced her on December 3, 2024, to 20 years in state prison followed by 10 years of probation.¹ She is appealing.

What Happened the Night of the Shooting

Doug Benefield, 58, was shot inside Ashley’s home while the couple loaded a U-Haul for a planned move to Maryland. Ashley, then 28, fired a .45 caliber Springfield Armory handgun four times. Doug was struck in the chest and the right knee and sustained an abrasion to the right shoulder; the chest wound perforated his right lung and killed him, according to Medical Examiner Russell Vega.² Ashley then ran to a neighbor’s house.³

She told investigators, and later testified, that an argument turned physical: she said Doug pushed a box into her, struck her on the side of the head, and lunged at her before she fired.⁴ Two other loaded firearms were later recovered in the home: a second gun of Ashley’s in a bedroom closet backpack, and her mother’s gun in the kitchen pantry.⁵

Ashley was arrested in November 2020 and charged with second-degree murder. She pleaded not guilty.⁴

The Marriage and the Allegations That Preceded the Shooting

Ashley Byers and Doug Benefield met on August 25, 2016, at a Ben Carson campaign event. She was 24; he was 54, a Navy veteran and widower with a teenage daughter, Eva. They married in Charleston, South Carolina, 13 days later.⁶ They had one daughter together, Emerson.

Between 2017 and 2020 the marriage broke down, reconciled, and broke down again. Ashley accused Doug of poisoning her and their daughter with heavy metals, of physically abusing the child, and of stalking her. Authorities investigated each accusation and closed every one without charging Doug. In a 2018 custody hearing, Judge Diana Moreland granted Doug joint custody and stated there was “not a single scintilla of credibility” in Ashley’s testimony.⁴ In May 2020, Ashley filed a restraining order against Doug.⁷

The Stand Your Ground Ruling

In February 2023, defense attorney Neil Taylor filed a 105-page motion invoking Florida’s Stand Your Ground law, which permits deadly force without a duty to retreat if the person reasonably believes it necessary to prevent imminent death or great bodily harm. Once raised, the burden shifts to the state to prove the force was not justified.⁸

After a two-day immunity hearing in July 2023, Judge Whyte denied the motion. He ruled that the evidence “proves clearly and convincingly that the defendant is not entitled to court-ordered immunity from criminal prosecution, as she was not justified in using deadly force” that night.⁹ The case moved to a jury.

The Trial

Trial opened July 23, 2024, at the Manatee County Judicial Center in Bradenton. Prosecutors Suzanne O’Donnell and Rebecca Freel represented the state; Neil Taylor led the defense.⁹

The State’s Theory

Prosecutors argued Ashley killed Doug to secure sole custody of Emerson. O’Donnell told jurors Ashley “wanted sole custody of her child and was very afraid that she was going to lose custody altogether” and framed the shooting as “a custody battle that this mother was going to win at all costs.”⁴ They pointed to the string of investigated-but-uncharged accusations as a pattern of false claims.¹

The physical evidence mattered. The medical examiner testified the fatal chest wound entered from the side, which prosecutors said contradicted Ashley’s account of a frontal lunge; they argued Doug was likely turning away.¹⁰ Neighbor John Sant testified he saw no injuries on Ashley when she arrived at his door. Prosecutors also played a video from Doug’s phone recorded one week before the shooting, showing Ashley, her mother, and Doug laughing together during a game.⁴ Officer Chris Gillum testified that during earlier custody proceedings Ashley had asked him to arrest Doug in court, telling him a visible arrest in front of the judge would help her keep custody of Emerson.¹¹

The Defense Case

Ashley testified on July 26, 2024, describing Doug as “controlling and volatile.” She said he had once fired a gun into the kitchen ceiling during an argument, an act Doug had acknowledged in an earlier hearing as “the dumbest thing I’ve ever done.”⁴ She said he broke objects, drove erratically, and once punched the family dog unconscious; Doug had previously acknowledged striking the dog but described it as a push.⁵

The defense introduced a text message from Doug’s late first wife, Renee, referring to Doug “kicking me so hard on New Year’s Eve” and holding a gun to his head on two occasions.⁴ Attorneys also submitted texts in which Doug acknowledged the ceiling gunshot and said he was “having a nervous breakdown.” Physician Dr. Barbara Russell testified she observed swelling on the side of Ashley’s face after the shooting.⁷ Two mental health experts testified in support of a battered spouse syndrome argument.⁹

On cross-examination, Ashley testified that Doug had never struck her before the night of the shooting. Prosecutors used the answer to challenge the broader abuse narrative.⁵

The Verdict

Deliberations began the afternoon of July 30, 2024. Around 10:45 p.m. the same night, after more than six hours, the jury acquitted Ashley of second-degree murder and convicted her of the lesser-included offense of manslaughter with a firearm.¹²¹

Motion for a New Trial and Sentencing

On August 9, 2024, the defense moved for a new trial. Two claims drove the motion. The first involved comments posted on a livestream of the trial by a user identifying as the sibling of a juror, alleging that the juror had smuggled a flip phone into the deliberation room and that the jury had been “split 5-1” before reaching a manslaughter compromise.¹³ The second alleged that “Juror 15” had failed to disclose a personal history of domestic violence and a child custody dispute during jury selection.¹⁴

Judge Whyte interviewed each of the six jurors in October 2024. All denied bringing or seeing a cellphone in deliberations. On Juror 15, the judge found she had not associated her prior dismissed cases with “domestic violence” and that defense questioning during voir dire had been “vague and ambiguous,” attributing the nondisclosure to a “lack of diligence” by the defense rather than concealment by the juror. The judge also rejected a claim of prosecutorial misconduct in closing, finding the statements “not improper or did not amount to fundamental error” and noting the defense had not objected at the time.¹⁴ The motion was denied on November 27, 2024.

On December 3, 2024, Judge Whyte sentenced Benefield to 20 years in state prison followed by 10 years of probation. The statutory maximum was 30 years. The judge denied a defense request for a downward departure from the guidelines.¹

The Appeal and Where Benefield Is Now

Benefield filed a notice of appeal on October 18, 2024, to Florida’s Second District Court of Appeal. Attorney William Ponall is handling it, and the defense has asked to exceed the standard 50-page brief limit. The appeal centers on the juror misconduct claims.¹⁵¹⁶ As of November 2025, legal experts estimated the appeal could take one to two years to be heard.

Judge Whyte denied bond pending appeal in February 2025. He acknowledged that the “bases for appeal are fairly debatable and not frivolous,” but cited the length of the sentence, Benefield’s lack of concrete community ties such as property ownership, and the risk she might flee to avoid missing milestones in her daughter’s life.¹⁷

Benefield was held at Lowell Correctional Institution in Ocala under inmate number S62420.¹⁸ In January 2026 she was moved to disciplinary confinement at Homestead Correctional Institution in Miami-Dade County after an alleged battery on a corrections officer. The Florida Department of Corrections confirmed the transfer but released no further detail on the incident or any additional charges.¹⁹
