Is Your Mattress Covered

The settlement applies to U.S. consumers who bought one of more than 70 specific mattress models between October 1, 2017, and June 30, 2024. On the Ashley side, that includes the Chime and Chime Elite series, MyGel, Millennium, iKidz, and “The Perfect 10.” On the Resident Home side, it includes Nectar’s Classic, Hybrid, Luxe, Premier, and Copper lines; DreamCloud’s Classic, Hybrid, Luxe, Premier, and Rest models; and Siena’s Hybrid Plush, Signature Memory Foam, and Essential Memory Foam.1Forbes. Check the white tag sewn into the seam of your mattress for the SKU or model number, then look it up on the settlement website. Only mattresses with fiberglass in the inner sock surrounding the foam are included.2Mattress Class Action Settlement. Long Form Notice

How to File a Claim

If you received an email notice from the settlement administrator, you don’t need to provide proof of purchase. Everyone else needs to submit documentation: a sales receipt, a store record, or a photo of the mattress label showing the SKU or serial number. What You Actually Get

The settlement is a voucher, not a cash refund. The $9 million “Common Voucher Fund” is divided among valid claims on a pro rata basis, so the individual voucher amount depends on how many people file. There is one path to a cash payment. Class counsel plans to request up to $3 million in attorneys’ fees, paid separately by the defendants. What the Lawsuit Alleged

The complaint, filed August 30, 2024, by lead plaintiff Jaime Todd, alleged that Ashley Furniture Industries, Ashley Global Retail, and Resident Home sold mattresses with a fiberglass inner sock used as a fire-retardant barrier. Consumers who unzipped and removed the outer cover, often to wash it, could release fiberglass fibers into their homes. The suit brought claims for failure to warn, design defect, negligence, breach of warranty, unjust enrichment, violations of state consumer protection statutes, and violation of the Consumer Product Safety Act under 15 U.S.C. ยง 2073.3Mattress Class Action Settlement. A September 2022 complaint filed with the Consumer Product Safety Commission described the aftermath on a 12-inch Signature Design Chime Memory Foam mattress. After the zippered cover was removed, a “plume of fiberglass” left the home “covered in millions of tiny shards” and, in the consumer’s words, “unliveable.” A two-year-old in the household was treated in an emergency department for wheezing and a persistent cough. A 2023 investigation by Pittsburgh station WTAE documented similar reports: burning eyes, itchy skin, rashes, and one child whose asthma flared badly enough to require an emergency room visit. Dr. Deborah Gentile, an asthma and allergy specialist, told the station that children are a “special potential risk group.” Fibers embedded in furniture, curtains, clothing, and air ducts, and one family reported remediation and replacement costs above $25,000.7WTAE. The defendants deny all the claims and any wrongdoing. The case, Todd v. Ashley Furniture Industries, LLC, et al., is pending before Judge William M. Conley in the U.S. District Court for the Western District of Wisconsin.
