What Ashley Found
On September 29, 2021, Jason asked Ashley to help him set up a Venmo account for his electrician business. Partway through, he called back in what she described as a panicky state and told her to stop. The reaction was strange enough that she looked at his computer files. She contacted the Riverton City Police Department. When detectives executed a search warrant on the iCloud account and Jason’s phone, the total came to more than 1,500 photos and over 100 videos of child sexual abuse material, depicting girls estimated to be between 8 and 15 years old. How Jason Was Arrested
Ashley cooperated with police to bring Jason in. In October 2021, at officers’ direction, she asked him to meet her in a Walmart parking lot on the pretense of talking about their marriage. The Charges and the Plea Deal
The case moved to Salt Lake County Third District Court. Prosecutors filed ten counts of second-degree felony sexual exploitation of a minor, one third-degree felony count of obstructing justice, and two Class A misdemeanor counts of voyeurism against Jason, then 41.5ABC4 News. On November 3, 2022, Jason was sentenced under a plea agreement. He pleaded guilty to one count of sexual exploitation of a minor and two counts of voyeurism by concealed or disguised electronic equipment. Every other charge was dismissed with prejudice. The court imposed 329 days in the Salt Lake County Jail with credit for time served, plus 48 months of supervised probation. The prison sentence on the felony was suspended. Probation conditions barred him from the internet and required a cognitive behavioral treatment program, a mental health evaluation, a parenting class, and compliance with Group A Sex Offender conditions.5ABC4 News. Avaya and the Sentencing Hearing
Avaya, the stepdaughter Jason had secretly filmed, moved in with her biological father after the arrest because she no longer felt safe at home. She was 15 when he was incarcerated and rejected the letters he sent from jail seeking forgiveness, telling the documentary the apologies were self-serving and calling him “really manipulative” and someone who “will literally say anything to make you believe him.”1ABC News. At the 2022 sentencing, Avaya spoke to the court. In audio featured in the documentary, she said: “He completely ruined my family. He ruined our lives. He ruined me. I’m mentally not the same. I have extreme anxiety now. I have depression and have really bad PTSD. I would want him to be in prison. I don’t want him to look at another child.” She wore a sweatshirt and sweatpants to the hearing so Jason could not look at her in a way she found uncomfortable.6Yahoo Entertainment. Life After Jason’s Release
Ashley and Jason married in 2011. She had two children from a previous relationship, including Avaya, and the couple shared one young daughter. Jason had been in Avaya’s life since she was a toddler.7Decider. Betrayal: A Father’s Secret Hulu Review
When the arrest became public in October 2021, Ashley initially told her children Jason was at a mental hospital. Local media coverage ended that. After his release, Ashley faced a divorce in which Jason stood to receive half of the couple’s shared assets, and she fought to block him from getting unsupervised visitation with their youngest daughter. In a May 2024 podcast appearance, she said the custody battle had consumed two years of her life. Avaya, 18 by the time the docuseries came out, had repaired her relationship with Ashley and still lives in the same town as Jason, who is a registered sex offender.9iHeartPodcasts. Ashley has since spoken publicly about the case on bonus episodes of Betrayal Weekly, describing the ongoing legal fights and speaking with others in similar situations. “We have to build up so many people and bring light to this like really ugly dark thing,” she said.9iHeartPodcasts. Ashley’s account first reached a broad audience through Betrayal, hosted by Andrea Gunning and produced by Glass Podcasts and iHeartPodcasts. ABC News Studios then adapted the story into a three-part docuseries, Betrayal: A Father’s Secret, which began streaming on Hulu on July 30, 2024. It features interviews with Ashley, Avaya, Ashley’s sisters and stepmother, and law enforcement, including Sete Aula’i, section chief for the Utah Attorney General’s Internet Crimes Against Children unit, who called the possession and distribution of such material “an epidemic here and across the world.”1ABC News. Why 100 Counts Became One
Under Utah law, sexual exploitation of a minor through knowingly possessing or viewing child sexual abuse material is a second-degree felony, and each image depicting a different minor, or the same minor in different material, is a separate offense.11WomensLaw.org. Sexual Exploitation of Minor Offenses – Utah Statutes That per-image structure is why Jason initially faced 100 counts. It also frames the gap between those original charges and the single felony count he ultimately pleaded to.
Utah also imposes a mandatory reporting duty on anyone with reason to believe a child has been abused, requiring immediate contact with the Division of Child and Family Services or the nearest law enforcement agency.12Utah Legislature.
