- You were treated at Atrium Health Urology between April 1, 2021, and September 22, 2022.
- Atrium Health notified you that blood testing was advisable because of the sterilization documentation lapse.
- You underwent that blood testing.
- Your testing did not show a new infection.
Court filings estimate about 1,300 patients meet that definition.
How Much You’ll Get and When
The $2.5 million fund is divided before class payments are calculated. Attorneys’ fees are capped at 30% of the fund, or $750,000. Litigation costs come to roughly $35,246. The two named plaintiffs, Monica Jackson and Keith Grays, may each receive service awards of up to $5,000. Who Is Not Covered
Patients who tested positive for a new infection are not part of this class. They keep the right to bring their own separate legal claims against the hospital authority. Anyone who opted out by the March 23, 2026 deadline is also excluded and will not receive a payment.
What Happened at the Kenilworth Clinic
An internal quality assurance audit at Atrium Health’s urology practice in the Kenilworth facility in Charlotte’s Dilworth neighborhood found that cleaning and sanitization logs for reusable endoscopic instruments, including cystoscopes, had not been accurately maintained for about six months. Atrium began notifying patients in the fall of 2022 that they may have been exposed to hepatitis B, hepatitis C, and HIV, and offered free blood testing followed by mandatory retesting six months later.5WSOC-TV. Final Approval and Contact Information
Judge Robert Ervin granted preliminary approval on December 5, 2025. The final approval hearing, originally set for April 24, 2026, was rescheduled to June 19, 2026, at Mecklenburg County Superior Court.
