A six-hour final approval hearing took place on January 15, 2026. When Payments Can Be Sent
Under the settlement agreement, no money can be distributed until three things happen: the court grants final approval, all claims have been reviewed, and the appeals window closes.5Telecom Data Settlement. AT&T Data Incident Settlement If any party appeals after final approval, the effective date of the settlement is pushed back another 30 days beyond the last appellate ruling.6Business CCH. In plain terms, a favorable ruling from Judge Brown starts the clock, not the checks. Any objector who appeals can add months to the timeline, and given the number of objections already on file, that possibility is real.
How Much Class Members Will Actually Receive
The headline number is $177 million, but individual payouts will be much smaller than the maximums advertised. At the January hearing, plaintiffs’ attorneys acknowledged that actual per-person payments would likely be far below the caps because of the sheer volume of claims relative to the fund.1New Haven Register. The money is split into two separate, non-reversionary cash funds:6Business CCH. AT&T Settlement Agreement
- The AT&T 1 Fund ($149 million) covers the March 2024 dark web leak. Class members whose Social Security numbers were exposed (Tier 1) receive five times the payout of those whose other data was exposed but not their Social Security number (Tier 2). Documented financial losses tied to the breach can be claimed up to $5,000.
- The AT&T 2 Fund ($28 million) covers the July 2024 breach involving stolen call and text records. Eligible account owners and end users can claim up to $2,500 for documented losses on or after April 14, 2024, or take a pro rata share (Tier 3) of what remains in the fund.
Someone affected by both breaches can file against both funds and could receive up to $7,500 combined, but each claim needs separate documentation.5Telecom Data Settlement. AT&T Data Incident Settlement
Both funds are reduced before any payments go out. Deductions include settlement administration costs, court-approved service awards of up to $1,500 per class representative, and attorneys’ fees.6Business CCH. What that means for a typical claimant: with 4.38 million claims filed against a combined fund reduced by roughly $59 million in fees plus administration costs, the pool actually available to class members is well below $177 million, and the maximum tier payouts are ceilings that most claimants will not hit.
Who Is Covered by Each Fund
The AT&T 1 class covers anyone in the United States whose personal data was part of the March 30, 2024, dark web disclosure. That leak affected roughly 73 million people, including 7.6 million then-current account holders and 65.4 million former customers, with exposed fields including names, addresses, phone numbers, email addresses, dates of birth, account passcodes, billing account numbers, and Social Security numbers.7AT&T. The AT&T 2 class covers AT&T account owners, line users, and end users whose call and text records were stolen in the July 12, 2024, breach.6Business CCH. AT&T Settlement Agreement That theft covered interactions between May 1 and October 31, 2022, plus January 2, 2023, and included phone numbers, call and text counts, aggregate call durations, and cell site identifiers for a small subset of customers. What to Do If You Filed a Claim
There is no action to take right now. Kroll is processing claims, and the settlement website remains the official channel for status updates.5Telecom Data Settlement. AT&T Data Incident Settlement Payments cannot be issued until Judge Brown enters a final approval order and the appeal window runs out. If you filed a claim, make sure the settlement administrator has your current mailing address and email; that is the only step within your control while the court’s ruling is pending.
Other AT&T Settlements That Sometimes Cause Confusion
Two other AT&T settlements come up in searches and are not part of the $177 million data breach case.
The FTC’s data-throttling case against AT&T Mobility alleged the company misled customers about unlimited data plans and resulted in a $60 million settlement in 2019. The FTC distributed $52 million in refunds in 2020 and sent an additional $6.3 million to 267,734 former customers in April 2024.10Federal Trade Commission. AT&T Data Throttling Refunds
A separate older class action, In Re: AT&T Mobility Wireless Data Services Sales Tax Litigation, dealt with internet access taxes improperly charged between 2005 and 2010. That settlement is fully resolved and in its final distribution stages, though some checks remain outstanding because individual taxing jurisdictions process refunds at different speeds.11ATT Mobility Settlement.
