Avis Car Rental Class Action Settlement: Claims and Deadlines

The Avis car rental class action settlement puts $1,025,000 on the table for roughly 299,000 customers whose personal information was exposed in the August 2024 data breach. If you got a notification letter from Avis or Avis Budget Group, you can file a claim by June 21, 2026, for up to $5,000 in documented out-of-pocket losses plus a pro rata cash payment that requires no proof of loss. Final approval is scheduled for July 28, 2026.¹²

Who Qualifies

The class covers any U.S. resident who received a notification from Avis Rent A Car System, LLC or Avis Budget Group, Inc. saying their personal information was compromised in the August 2024 breach.² Avis mailed those letters starting around September 4, 2024.³ If you rented from Avis but never received a notification, you are not part of this class.

What You Can Claim

There are two payment tracks, and you can claim both.

Out-of-pocket losses up to $5,000. Reimbursement covers documented, unreimbursed monetary losses tied to the breach, including fraudulent charges, credit monitoring costs, professional fees, postage, and bank fees. Losses have to fall between August 3, 2024, and the June 21, 2026, claims deadline. You also need to show you made reasonable efforts to mitigate the harm or seek reimbursement elsewhere first.⁴

Pro rata cash payment. Every valid claimant gets an equal share of whatever remains in the fund after out-of-pocket reimbursements, attorney fees, service awards, and administrative costs come out. No proof of loss is needed for this piece.²

Both amounts can be reduced pro rata if valid claims exceed what’s in the fund.⁴ Class counsel has asked for up to $341,632.50 in fees, and the ten named plaintiffs are eligible for service awards of up to $2,500 each.⁵ Avis has also agreed to make certain cybersecurity improvements as part of the deal.¹

How To File

File online at avisdatasecuritysettlement.com, or mail a completed claim form to the claims administrator at 1650 Arch Street, Suite 2210, Philadelphia, PA 19103. Questions go to the toll-free line at (888) 818-4234.⁶

For the out-of-pocket portion, you’ll need supporting documentation: bank statements, credit card statements, receipts, or invoices showing the loss and its connection to the breach. The pro rata cash payment does not require documentation.⁴

Key Deadlines

Exclusion or objection: postmarked by May 22, 2026.
Claim filing: submitted online or postmarked by June 21, 2026.
Final approval hearing: July 28, 2026, at 11:00 AM Eastern.

If you opt out, you keep the right to sue Avis on your own but lose any payment from this settlement.² Assuming the court grants final approval, payments are expected roughly 30 days after a claim is approved or 90 days after court approval, whichever is later.⁵

What the Breach Involved

Between August 3 and August 6, 2024, an unauthorized party accessed an Avis business application and took customer data. Avis spotted the activity on August 5, cut off access, and finished its internal review on August 14.³ The Maine attorney general filing put the number of affected people at 299,006.⁷

The compromised data varied by person and could include names, mailing addresses, email addresses, phone numbers, dates of birth, driver’s license numbers, and credit card numbers with expiration dates. Avis offered affected customers one year of free credit monitoring through Equifax.³ Avis denies wrongdoing and disputes the plaintiffs’ claims; the settlement resolves the litigation without any admission.¹
