Barry Morphew Arrested: Arizona Charges, Bond, and Trial

Barry Morphew was arrested on June 20, 2025, during a traffic stop in Arizona, after a Colorado grand jury indicted him on a first-degree murder charge in the death of his wife, Suzanne Morphew. The arrest came more than five years after Suzanne vanished from the couple’s home near Salida on Mother’s Day 2020, roughly two years after her remains were found in a shallow grave in Saguache County, and three years after an earlier prosecution against him collapsed. Morphew has pleaded not guilty. He is now free on bond under house arrest, and his trial has been pushed to 2027.¹²

The June 2025 Arrest in Arizona

A Twelfth Judicial District grand jury returned the indictment on June 18, 2025. Arizona authorities, who had been coordinating with the Colorado Bureau of Investigation to monitor Morphew’s whereabouts since February 2025, received a warrant carrying a $3 million bond and specifying nationwide extradition to Colorado. Two days later, they took him into custody at a traffic stop. CBI Agent in Charge Gregg Slater traveled to Arizona to assist.²

An arrest report later showed that Morphew had been living in Arizona with a woman since May 2025 under the name “Lee Moore.” According to the woman, he revealed his real name and told her his wife had been “abducted in Colorado” only five days before officers arrived. A safe searched at the residence contained an AR-15-style rifle and a silencer; no additional charges were filed over those items.²

Morphew waived extradition and was returned to Colorado. He made his first court appearance on July 1, 2025, at the Alamosa County jail.³

Why He Was Charged Again

The second prosecution is being led by District Attorney Anne Kelly of the 12th Judicial District, with assistance from the Boulder County DA’s Office and appellate support from Denver.¹ What changed between the 2022 dismissal and the 2025 indictment is straightforward: investigators found Suzanne’s body, and the autopsy pointed at a substance almost no one in the area could legally get.

The Body and the “Smoking Gun”

In September 2023, CBI agents working an unrelated matter in a desolate area near Moffat known locally as “the boneyard” discovered human remains in a shallow grave less than an hour south of the Morphew home. The El Paso County coroner identified them as Suzanne’s on September 27, 2023.⁴⁵

The autopsy ruled the manner of death a homicide, caused by “unspecified means in the setting of butorphanol, azaperone, and medetomidine intoxication.”⁶ Those three drugs make up a compound called BAM, a chemical immobilizer wildlife biologists and veterinarians use to sedate large animals like deer, bear, and elk. It is tightly regulated by the DEA and the FDA and typically requires a professional prescription. Testing found all three components in Suzanne’s femur bone marrow.⁷

Specialists who examined the remains, including a forensic anthropologist, a botanist, and an entomologist, concluded it was “unlikely Suzanne decomposed from a fresh body to a skeleton at this location.” Investigators believe the body was moved at least twice.⁸ Former prosecutor Eric Faddis called the discovery of the remains and the finding of BAM the “smoking gun” that provided the basis for the second arrest.⁷

The Prosecution’s Theory

According to the indictment, prosecutors allege Barry Morphew used BAM to incapacitate Suzanne during a confrontation at their home on May 9, 2020. They cite a plastic needle cap recovered from the family’s clothes dryer alongside shorts he was reportedly wearing that day, and a tranquilizer rifle and packages of tranquilizer darts taken from the home’s gun safe.⁷

Barry had previously admitted to investigators that he used BAM to illegally sedate deer for antler removal.⁵ Court records indicate he obtained and filled several prescriptions for BAM in Indiana in 2018 while operating as a deer breeder. The indictment states that from 2017 through 2020, only Colorado Parks and Wildlife and the National Park Service received BAM prescriptions in the southwestern region of the state, making Barry Morphew the only private citizen in the Salida area known to possess the substance.⁷

A pharmacology expert told the grand jury that a dose of BAM would render a human “wholly immobile, vulnerable and unable to resist any constrictions to the recipient’s ability to breathe.”⁷ Toxicological analysis showed Suzanne’s body had begun to metabolize the drugs before she died, meaning she did not die immediately after being injected.⁵ Investigators believe Barry chased Suzanne through their home after the injection, citing a broken door frame and cellphone pinging data as evidence of a confrontation. Data from the onboard computer of Barry’s Ford truck showed doors opening and closing during a period when he claimed to be sleeping.⁸

The First Case That Fell Apart

Morphew was first arrested in May 2021 and charged with first-degree murder by Linda Stanley, then the 11th Judicial District Attorney. The presiding judge, Ramsey Lama, imposed severe sanctions on the prosecution for failing to turn over exculpatory evidence, excluding 14 expert witnesses in DNA, vehicle data, and cellphone analysis, and citing what he called a “negligent and arguably, reckless disregard” for discovery obligations.⁹

On April 19, 2022, nine days before trial, Stanley’s office moved to dismiss all charges without prejudice, preserving the option to refile. Stanley said the state needed more time to investigate and believed it was “close to discovering the victim’s body.” Defense attorney Iris Eytan called the charges “false from the beginning” and accused prosecutors of having “manufactured a murder case” they knew they would lose.⁹ That leaves the current case as the second attempt, brought by a different DA in a different judicial district, on a stronger physical-evidence foundation.

Bond, Release, and Not-Guilty Plea

Morphew was held on the $3 million cash-only bond set at indictment. His defense team, David Beller and Jane Fisher-Byrialsen, asked the court to reduce it to $500,000, pointing to his record of appearing at every proceeding during the first prosecution. Prosecutors opposed any reduction.¹⁰

On September 2, 2025, 12th Judicial District Chief Judge Amanda Hopkins changed the bond from cash-only to cash or surety, allowing release for $300,000 posted through a bondsman. The judge attached strict conditions: stay in Colorado, wear a GPS ankle monitor, surrender his passport, drive only vehicles registered to him, use only his legal name, and comply with a protective order.¹¹ He posted bond and was released on September 19, 2025, to house arrest.¹² In January 2026, he pleaded not guilty to first-degree murder.¹³

The Cremation Fight

In February 2026, Barry Morphew signed forms authorizing cremation of Suzanne’s remains and arranged their release from the El Paso Coroner’s Office to a funeral home for a February 20 cremation. Prosecutors moved fast. On February 18, the court issued a search warrant for the remains; on February 19, an undersheriff took custody of them from the funeral home, a day before the scheduled cremation. Prosecutors described the timing as an attempt to destroy material evidence ahead of key rulings on the admissibility of the BAM toxicology findings.¹⁴

The seizure spawned a separate dispute. Morphew’s daughters, Mallory and Macy, Suzanne’s lawful next of kin, filed a motion for custody of the remains. Their attorney called the seizure “outrageous, cruel and shocking to the conscience” and argued it violated the family’s religious freedoms.¹⁵ In March 2026, a judge granted the daughters the chance to be heard on the issue.¹⁶

How the Defense Is Fighting

Beller and Fisher-Byrialsen have questioned the reliability of the toxicology. They argue that only the El Paso County Coroner’s Office reported the BAM compounds in Suzanne’s remains, and that the coroner’s lab is certified only for DUI testing, not complex toxicological analysis of this kind. They have signaled motions targeting the forensic work.⁷

The defense has also pointed to unresolved DNA. During the first prosecution, CBI Agent Joseph Cahill testified that a partial male DNA profile found on the glovebox of Suzanne’s car matched samples from three unsolved sexual assault cases in Chicago, Phoenix, and Tempe. The sample did not match Barry Morphew.¹⁷ Prosecutors characterized the sample as containing “limited genetic data,” but Cahill testified he had not followed up on the matches, and unknown male DNA was also found on Suzanne’s abandoned bicycle.¹⁸

In earlier proceedings, the defense argued that the tranquilizer dart rifle cited in the original arrest affidavit was “inoperable and had not been used in a long time,” and accused investigators of deliberately omitting that fact.¹⁹

A Family Split Down the Middle

The case has divided Suzanne’s family. Her daughters, Mallory and Macy, have stood by their father through both prosecutions and were regularly seen entering court with him during the first case.¹⁶ After the 2022 dismissal, Mallory told reporters, “We just know our dad better than anyone else and we know he was not involved in our mom’s disappearance.”²⁰

Suzanne’s siblings have taken the opposite position. In a victim impact statement submitted in August 2025, her brother David Moorman wrote that he was “requesting a life sentence with no chance of parole.” Her sister, Melinda Moorman Balzer, said she hopes the family can eventually bring Suzanne’s remains home to Indiana.¹⁵

When the Trial Will Happen

Trial had been set for October 2026 in Alamosa. In June 2026, Judge Hopkins granted a defense motion to delay, with the defense citing what the court described as an “almost unprecedented amount of discovery” requiring significant time to organize and review. DA Kelly and Suzanne’s siblings objected. The judge ordered the trial scheduled before the end of July 2027.²¹ A motions hearing was set for July 2026 to address dozens of defense filings on evidentiary exclusions, witness testimony, jury selection, and discovery.²² Until then, Morphew remains out on bond and confined to Colorado under GPS monitoring.
