The three plaintiffs are Christopher Beacom, the former director of baseball operations; Michael “Dusty” Napoleon, a former assistant coach who worked as hitting coach and recruiting coordinator; and Jonathan Strauss, a former assistant coach who served as pitching coach. Along with the university and Foster, the complaint names athletic director Derrick Gragg, deputy athletic director Monique Holland, and associate athletic director for human resources Rachel Velez. What the Complaint Says Foster Did
The complaint describes a coaching environment defined by volatility and intimidation. According to the plaintiffs, Foster’s profanity-laced tirades and unpredictable outbursts left staff members so anxious that they avoided common areas to minimize contact with him.3Courthouse News Service. The suit also alleges racially insensitive and sexist remarks. It says Foster referred to a prospect at a high school camp as the “Chinese kid” and said a female team manager should not be on the field because he did not want “the guys staring at her ass.”4Chicago Tribune. The plaintiffs further claim Foster pressured them to violate NCAA recruiting rules, including holding meetings with underage players and organizing unofficial visits.5CBS News Chicago. What They Reported and When They Were Removed
According to the lawsuit, the staffers began raising concerns with administrators in October 2022. On November 30, 2022, they filed a formal written complaint with Northwestern’s human resources department. They say they also sent at least eight emails to university officials asking for protection from Foster’s behavior, and that those emails went unanswered.6The Athletic. Northwestern completed its internal HR investigation on February 22, 2023. The investigation found “sufficient evidence to substantiate” many of the allegations, including bullying and abusive behavior and inappropriate comments about a female staff member. It reportedly did not find enough evidence to support the claims about racially insensitive comments or interference with medical care. Foster was not disciplined and coached the entire 2023 season. The plaintiffs allege that on the same day the investigation concluded, Gragg told them none of the three would be returning to the program. The lawsuit says the university then transitioned them to “remote special contract workers” so they could receive the rest of their pay. The Legal Claims
The complaint advances several theories:
- Breach of contract through retaliation, alleging their removal violated the university’s non-retaliation policy and their employment agreements.
- Negligent hiring, claiming Northwestern failed to properly vet Foster despite what the complaint calls his “established and well-known reputation as a bully.”
- Negligent supervision, alleging administrators ignored repeated reports of misconduct.
- Fraudulent inducement, claiming the university misrepresented the work environment during the assistant-coach hiring process.

Northwestern’s Response
Northwestern called the lawsuit “without merit” and said it intended to “contest it vigorously.” Spokesman Jon Yates said that when the athletic director and the university first learned of complaints about Foster, “the University immediately initiated a human resources investigation.” Yates added that the plaintiffs “received full support from the University, they were paid for their full contracts and, at their request, were allowed to support other areas of our athletic department as needed.”8CBS Sports. Foster’s Removal and the Status of the Case
Northwestern went 10-40 under Foster in 2023, and 16 players entered the transfer portal after the season.10ESPN. The lawsuit was filed a month later, on August 14, 2023. As of the available record, it remains pending in Cook County Circuit Court, with no publicly reported rulings on motions to dismiss and no settlement. How This Case Fits Alongside Northwestern’s Other Athletic Suits
The baseball staff case is separate from the hazing litigation that dominated Northwestern athletics in the same period. Football coach Pat Fitzgerald was fired on July 10, 2023, three days before Foster’s removal, and later filed a $130 million wrongful termination suit; a group of football players reached a settlement with the university in April 2025 that did not encompass the baseball staff lawsuit.13WTTW News.
