Bath Planet Lawsuit: Felony Fraud Charges and Complaint Pattern

The most serious Bath Planet lawsuit is a criminal case in Missouri, where the state attorney general has filed 20 felony charges against a former dealer accused of taking more than $395,000 from customers for bathroom remodels that were never done. Beyond that prosecution, the national brand faces a steady pattern of consumer complaints across the country, and its corporate structure and website terms make it difficult for customers to sue the parent company directly.

The Missouri Felony Fraud Case

In December 2025, the Missouri Attorney General’s Office filed 20 felony charges in Greene County Circuit Court against James Gordon Bennett, who operated American Reflections Bath and Spa Inc. as Bath Planet of Southwest Missouri on West Battlefield Road in Springfield. Investigators say 38 consumers paid Bennett for bathroom projects and received no work, no materials, and no refunds. Total reported losses exceed $395,000, and many of the complainants were over 60 years old.2Springfield News-Leader. The court issued a warrant with a $25,000 open court bond. Bennett’s defense attorney, Chad Mann, filed a motion to recall or quash the warrant and publicly called the allegations “a civil dispute, not a criminal case,” arguing the Attorney General’s Office should focus on “matters that restore confidence in the business environment and address true misconduct.”2Springfield News-Leader. Bennett already faced a separate felony charge in Dallas County, Missouri, filed in September 2025 for stealing $750 or more. That case involves a Buffalo, Missouri, customer who contracted in November 2024 for a step-in bathtub, paid nearly $8,300 upfront on an $11,000 contract, and received no work by mid-September 2025. Why the National Brand Says It Isn’t Liable

Bath Planet is one of two flagship brands operated by Bath Concepts Industries, LLC (formerly BCI Acrylic), headquartered in Libertyville, Illinois. Local operators are not employees of the parent company. They are independent businesses that purchase Bath Planet products, use the brand name under a dealer agreement, and run their own sales and installation.6KBB Online. Bath Planet Launched by BCI That structure is why the parent company has responded to many complaints by pointing customers back to the local dealer, and it is why criminal exposure in the Missouri case falls on Bennett personally rather than on the national brand.

The 2017 Trademark Suit Against a Dealer

The corporate parent has used litigation against its own dealer network as well. In September 2017, Bath Planet LLC filed a federal trademark action against Dietzler Ventures Inc. in the United States District Court for the Northern District of Illinois, case number 1:17-cv-06901. The Broader Complaint Pattern

The Better Business Bureau profile for Bath Planet’s Libertyville, Illinois, headquarters lists 91 complaints filed over a recent three-year period, with 12 closed in the most recent 12 months. Service and repair issues lead the categories with 39 complaints, followed by 19 for sales and advertising and 14 for order issues. Recurring themes include leaking drains and shower pans, installations that fall short of quality expectations, difficulty reaching management after the job, and aggressive telemarketing. Financing has surfaced in complaints outside Missouri too. A 2023 WSB-TV report profiled Rex Pullman of East Point, Georgia, who said he hired Bath Planet for a new bathtub and paid a $2,000 deposit in June 2023. The work was never done. Pullman also said he was signed up for a loan through Momnt without his consent, with the account linked to the salesperson’s phone number rather than his own. The financing company agreed to cancel the contract and void the debt, but Pullman said he had not heard from Bath Planet since July 4, 2023.9WSB-TV. What You Can Do If You Have a Claim

If your problem is with a specific local operator, that dealer is usually the correct defendant, because the parent company treats them as independent businesses. If a dealer has taken money and failed to deliver, filing a complaint with your state attorney general is a meaningful step: the Missouri prosecution grew directly out of consumer complaints funneled to that office.

Suing the national brand is harder. Bath Planet’s website terms include a mandatory arbitration clause and a class-action waiver. Under those terms, users must submit disputes to JAMS arbitration instead of filing a traditional lawsuit. The agreement also imposes a one-year time limit on bringing any legal action and caps the company’s maximum liability at $500 if a court finds the arbitration requirement unenforceable. Those terms govern the company’s website and online offerings. Whether they reach an in-home sales contract depends on the specific dealer agreement a customer signed, which may contain its own dispute resolution provisions. Read what you signed before assuming arbitration applies, and before assuming it doesn’t.

If financing was arranged through Momnt or a similar lender and the work was never done, contacting the lender directly can be effective. In the Georgia case, the financing company canceled the contract and voided the debt even though the customer never heard back from Bath Planet.
