BCBS Settlement: Eligibility, Payouts, and Determination Notices

The BCBS settlement is a $2.67 billion class action resolution of antitrust claims that more than 30 Blue Cross Blue Shield insurers agreed not to compete with one another and inflated premiums as a result. Who Qualifies

The settlement covers individuals, insured employer groups and their employees, and self-funded accounts and their employees who had a Blue-branded commercial health insurance or administrative services plan during specific windows:4BCBSSettlement.com. Settlement FAQ

  • Individuals and insured groups: February 7, 2008 through October 16, 2020.
  • Self-funded accounts: September 1, 2015 through October 16, 2020.

Medicare Supplemental policyholders are included. Dependents, beneficiaries (including minors), non-employees, government entities, and Medicare Advantage policyholders are not.4BCBSSettlement.com. Settlement FAQ

How Much You Get

There is no flat per-person payment. After attorney fees and administrative costs, the net fund is roughly $1.9 billion, split into two pools that do not cross-subsidize each other:4BCBSSettlement.com. Settlement FAQ

  • $1.78 billion for individuals, insured groups, and their employees.
  • $120 million for self-funded accounts and their employees.

Your share is proportional. The administrator divides what you paid in premiums or administrative fees during the class period by the total premiums or fees from everyone in your pool, then multiplies by the pool total.3Forbes. Payments and Determination Notices

Before payment, claimants receive a determination notice by email or postcard, on a rolling basis. The notice lists the “Total Premiums Paid” or “Total Administrative Fees Paid” figure the administrator has on file for you. If that number looks wrong, you have 30 days from the date the notice is sent to dispute it.6ClaimDepot. What the Case Was About

The litigation was filed in 2012 and consolidated in January 2013 before Judge R. David Proctor in the U.S. District Court for the Northern District of Alabama as MDL 2406.8U.S. District Court, Northern District of Alabama. What the Settlement Changed Going Forward

The settlement also required structural changes to how BCBS plans compete. A 2022 analysis in JAMA Health Forum summarized the main reforms:13JAMA Network. Blue Cross Blue Shield Antitrust Settlement

  • Employers with more than 5,000 employees can solicit a second bid from a competing Blue plan, ending the local plan’s monopoly on those national accounts.
  • The “National Best Efforts” rule, which required plans to derive at least two-thirds of their national health insurance revenue from Blue-branded products, was eliminated.
  • The “Local Best Efforts” rule is capped at 80% of a plan’s annual health revenues.
  • The BCBS Association’s control over member plan mergers and acquisitions is curtailed, with unresolved disputes going to binding arbitration.
  • Plans with more than 40% commercial market share in a state generally cannot use most-favored-nation clauses requiring providers to match rates offered to competitors.

The Separate Provider Settlement

If you’re a hospital, physician, or other healthcare provider rather than a subscriber, you’re looking at a different case. Providers pursued their own antitrust claims against the same defendants and reached a separate $2.8 billion settlement, which a federal judge approved on August 19, 2025.14Becker’s Payer Issues.
