BCBS Settlement: Eligibility, Payouts, and Determination Notices

The BCBS settlement is a $2.67 billion class action resolution of antitrust claims that more than 30 Blue Cross Blue Shield insurers agreed not to compete with one another and inflated premiums as a result. It became final on June 24, 2024, after the U.S. Supreme Court declined to hear further appeals,¹ and the settlement administrator, JND Legal Administration, began mailing checks to approved claimants on May 11, 2026.²

One thing to know up front: the deadline to file a claim was November 5, 2021.³ If you didn’t file, you can’t claim now. If you did file, the sections below explain what you should be seeing.

Who Qualifies

The settlement covers individuals, insured employer groups and their employees, and self-funded accounts and their employees who had a Blue-branded commercial health insurance or administrative services plan during specific windows:⁴

Individuals and insured groups: February 7, 2008 through October 16, 2020.
Self-funded accounts: September 1, 2015 through October 16, 2020.

Medicare Supplemental policyholders are included. Dependents, beneficiaries (including minors), non-employees, government entities, and Medicare Advantage policyholders are not.⁴

How Much You Get

There is no flat per-person payment. After attorney fees and administrative costs, the net fund is roughly $1.9 billion, split into two pools that do not cross-subsidize each other:⁴

$1.78 billion for individuals, insured groups, and their employees.
$120 million for self-funded accounts and their employees.

Your share is proportional. The administrator divides what you paid in premiums or administrative fees during the class period by the total premiums or fees from everyone in your pool, then multiplies by the pool total.³ Anyone whose calculated payment comes to $5.00 or less receives nothing.⁴ The net fund is being distributed to roughly 6 million claimants.⁵

Payments and Determination Notices

The court authorized distribution on April 24, 2026, one day after the motion to distribute was filed.⁶ Checks started going out on May 11, 2026.⁷

Before payment, claimants receive a determination notice by email or postcard, on a rolling basis. The notice lists the “Total Premiums Paid” or “Total Administrative Fees Paid” figure the administrator has on file for you. If that number looks wrong, you have 30 days from the date the notice is sent to dispute it.⁶ Claimants who don’t submit their own documentation are assigned a share based on pre-set percentages.⁴

What the Case Was About

The litigation was filed in 2012 and consolidated in January 2013 before Judge R. David Proctor in the U.S. District Court for the Northern District of Alabama as MDL 2406.⁸ Subscribers alleged that the Blue Cross Blue Shield Association and its member plans divided the country into exclusive geographic territories and agreed not to compete for customers.⁹ The plans also capped how much non-Blue-branded insurance they could sell, which plaintiffs said further suppressed competition.¹⁰ The end result, according to the suit, was that subscribers paid inflated premiums and had fewer choices.

Judge Proctor granted final approval of the $2.67 billion subscriber settlement on August 9, 2022.¹¹¹²¹

What the Settlement Changed Going Forward

The settlement also required structural changes to how BCBS plans compete. A 2022 analysis in JAMA Health Forum summarized the main reforms:¹³

Employers with more than 5,000 employees can solicit a second bid from a competing Blue plan, ending the local plan’s monopoly on those national accounts.
The “National Best Efforts” rule, which required plans to derive at least two-thirds of their national health insurance revenue from Blue-branded products, was eliminated.
The “Local Best Efforts” rule is capped at 80% of a plan’s annual health revenues.
The BCBS Association’s control over member plan mergers and acquisitions is curtailed, with unresolved disputes going to binding arbitration.
Plans with more than 40% commercial market share in a state generally cannot use most-favored-nation clauses requiring providers to match rates offered to competitors.

The Separate Provider Settlement

If you’re a hospital, physician, or other healthcare provider rather than a subscriber, you’re looking at a different case. Providers pursued their own antitrust claims against the same defendants and reached a separate $2.8 billion settlement, which a federal judge approved on August 19, 2025.¹⁴ Eligible providers were those who furnished services, equipment, or supplies covered by a Blue commercial plan between July 24, 2008, and October 4, 2024; the provider claim deadline was July 29, 2025.¹⁵ Provider payouts use a tiered points system based on total amounts billed to BCBS during the class period, adjusted by a geographic “harm coefficient.”¹⁶

About 6,500 provider organizations opted out, less than 1% of a class of more than one million.¹⁷ Among them were Mayo Clinic, Providence, University of Michigan Health, and AdventHealth, several of which have filed their own antitrust suits seeking treble damages.¹⁸
