How the Dashcam Video Spread

The consequences hit fast. Taco Bell, where Golden had been head of mobile commerce and innovation, fired him within days. Spokesperson Ashley Sioson said, “Given the behaviour of the individual, it is clear he can no longer work for us.”5Global News. The Criminal Charges and Sentence

Prosecutors initially filed four misdemeanor charges: assault, battery, assault on a public transportation property, and battery on a public transit employee with injury.7CBS News San Francisco. A judge sentenced him to 60 days in county jail, three years of informal probation, and restitution to Caban.8Orange County District Attorney. The offense is a “wobbler” that can be filed as a misdemeanor or a felony; prosecutors chose the misdemeanor.9Orange County Register. Golden’s Apology and Caban’s Response

Golden’s attorneys said he was “extremely remorseful” and “accepts full responsibility for his actions.”10CNBC. Caban declined the meeting. “He says it’s not him, but that’s the only him I know,” he said, questioning whether Golden’s tears reflected real remorse or exposure. Reporting also surfaced a prior DUI: Golden had pleaded guilty to a DUI charge in Kentucky roughly three years earlier, around 2012, though he maintained he did not have a drinking problem.11CBS News. Caban v. Golden

On November 3, 2015, Caban sued Golden in Orange County Superior Court, alleging assault, battery, and infliction of emotional distress.12Los Angeles Times. Golden’s $5 Million Countersuit

In December 2015, Golden filed a cross-complaint seeking $5 million. He alleged that Caban had illegally recorded their interaction in violation of California Penal Code Section 632, which governs recording of confidential conversations, and that posting the video caused him “severe emotional distress, humiliation, anxiety, the loss of his employment, and the inability to get another job.”12Los Angeles Times. Caban’s attorney, Rivers Morrell III, called the countersuit “totally bogus” and said it showed how “disingenuous Golden was on his apology tour,” adding, “What’s he want to apologize for if everything was the fault of Edward?”10CNBC. Legal analysts agreed the claim was weak.
