Benzene Lawsuit: Cancer Claims, Verdicts, and Recalls

A benzene lawsuit is a personal injury, wrongful death, or class action claim brought by someone who developed cancer, a blood disorder, or purchased a contaminated product after exposure to benzene, a chemical used throughout industry and found as a contaminant in many everyday consumer goods. Outcomes have ranged from six-figure settlements to a $725.5 million jury verdict against ExxonMobil in 2024.1Washington Legal Foundation. WLF Urges Pennsylvania Supreme Court to Rein in Excessive Noneconomic Damages Awards Who can sue, what the case is worth, and how hard it is to prove all depend on how you were exposed and what you were diagnosed with.

Who Can File a Benzene Claim

Plaintiffs generally fall into three groups.

Workers Exposed on the Job

Occupational cases are the oldest and most common type of benzene lawsuit. High-risk jobs include oil refinery and chemical plant workers, gas station attendants, mechanics, painters, printers, rubber industry workers, firefighters, and maritime workers.2American Cancer Society. Benzene and Cancer Risk3ScienceDirect. Benzene Occupational Exposure Sources These claims typically allege that an employer or product manufacturer failed to warn about benzene’s dangers, failed to provide adequate ventilation or protective equipment, or kept using benzene-containing products when safer alternatives existed.

Consumers Who Used Contaminated Products

Since 2021, the analytical laboratory Valisure has detected benzene in hand sanitizers, spray sunscreens, aerosol deodorants and antiperspirants, dry shampoos, and acne treatments containing benzoyl peroxide.4Chemical & Engineering News. Finding Benzene Everywhere You Look Those findings triggered recalls and dozens of lawsuits against major brands. Most consumer-product cases are class actions seeking economic damages for buying a contaminated product, not personal injury claims.

Residents of Contaminated Areas

People who lived or worked near refineries, chemical plants, or contamination sites have also sued. The EPA has identified benzene from refineries as a major contributor to cancer risk, with roughly five million Americans living in areas with elevated exposure from airborne industrial emissions.5Center for Public Integrity. What Illnesses Qualify

Benzene is a known human carcinogen under every major health authority: the International Agency for Research on Cancer places it in Group 1, the EPA calls it a known human carcinogen for all routes of exposure, and the National Toxicology Program lists it as “known to be carcinogenic.” The strongest evidence, and the diagnosis most often alleged in lawsuits, is acute myeloid leukemia (AML). Studies also suggest links to acute lymphocytic leukemia, chronic lymphocytic leukemia, non-Hodgkin lymphoma, multiple myeloma, and myelodysplastic syndromes, though the evidence for those is less definitive.2American Cancer Society. Benzene and Cancer Risk

Long-term exposure also damages bone marrow and can cause aplastic anemia, dangerously low white blood cell counts, and bleeding disorders from reduced platelets.2American Cancer Society. Benzene and Cancer Risk AML remains the clearest fit; other diagnoses are winnable but tend to draw harder causation fights.

What Benzene Cases Have Paid

Verdicts and settlements span a wide range. The outliers get the headlines, but most individual cases settle for far less.

Gill v. ExxonMobil — $725.5 Million

In May 2024, a Philadelphia jury awarded $725.5 million to Paul Gill, a former gas station attendant who alleged he developed AML after working at a Mobil service station from 1975 to 1980. The award included $725 million for Gill’s pain and suffering and $500,000 for his wife’s loss of consortium, with no punitive or economic damages.1Washington Legal Foundation. WLF Urges Pennsylvania Supreme Court to Rein in Excessive Noneconomic Damages Awards

ExxonMobil moved for a new trial, arguing juror bias based on a juror’s social media posts. Judge Carmella Jacquinto rejected those arguments in a 362-page opinion issued in May 2025, finding that competent and sufficient evidence supported the verdict and dismissing the social media posts as hearsay.6The Legal Intelligencer. As of mid-2025, the case is on appeal before the Pennsylvania Superior Court, where industry groups have filed amicus briefs urging the court to overturn the verdict or set stricter standards for reviewing noneconomic damages.8Washington Legal Foundation. Other Notable Outcomes

  • Chevron / Eaves Brothers ($21.4 million, 2019): A Contra Costa County, California jury awarded the families of Gary and Randy Eaves, two brothers who died of blood cancers after exposure to benzene at a Cooper Tire & Rubber facility in Arkansas. The tire manufacturing used a petroleum solvent supplied by a Chevron subsidiary.9San Francisco Chronicle. Contra Costa County Jury Awards $21.4 Million in Benzene Cancer Case
  • Du Pont ($8.2 million, 2015): Awarded to a 60-year-old plaintiff diagnosed with AML and myelodysplastic syndromes from work-related exposure.10ConsumerNotice.org. Benzene Lawsuits
  • Shell and ConocoPhillips ($4.83 million, 2017–2018): Settlement with Roxana, Illinois residents over groundwater contamination.11Drugwatch. Benzene Lawsuits
  • BP Texas City (2016): BP paid an undisclosed amount to settle roughly 25,000 claims related to a refinery leak.10ConsumerNotice.org. Benzene Lawsuits

Individual occupational verdicts typically land in the single-digit millions, with documented awards running from $824,000 for a printer with AML up to $17.5 million for a petroleum inspector with acute promyelocytic leukemia. Settlements usually fall between the high hundreds of thousands and low single-digit millions, depending on the severity of illness, the strength of the exposure evidence, and the defendant.

Consumer Product Recalls and Class Actions

Valisure’s 2021 testing opened a second front focused on contaminated consumer goods. The lab filed FDA citizen petitions after detecting benzene in 78 of 300 tested sunscreens and later found the chemical in hand sanitizers, aerosol deodorants, dry shampoos, and acne treatments.12ConsumerNotice.org. Sunscreen Lawsuits

Major Recalls

  • Johnson & Johnson (July 2021): Voluntarily recalled five Neutrogena and Aveeno aerosol sunscreen products after internal testing confirmed low levels of benzene. The company said benzene was not an ingredient and that detected levels were not expected to cause adverse health effects, but acted “out of an abundance of caution.”13Johnson & Johnson. Johnson & Johnson Consumer Inc. Issues Voluntary Recall
  • Procter & Gamble (November 2021): Recalled aerosol antiperspirant, deodorant, and dry shampoo products sold under the Old Spice, Secret, Pantene, Herbal Essences, Aussie, Waterless, and Hair Food brands.4Chemical & Engineering News. Finding Benzene Everywhere You Look
  • Edgewell Personal Care (expanded January 2023): Expanded a 2022 recall of Banana Boat Hair & Scalp Sunscreen Spray after benzene was traced to the spray propellant.12ConsumerNotice.org. Sunscreen Lawsuits

Class Action Results

  • Procter & Gamble ($8 million, 2022): Settled consolidated claims for benzene-contaminated aerosol products. Class members who bought affected products between November 2015 and December 2021 could receive a voucher worth $5 to $10 or a $3.50 cash payment, plus injunctive relief requiring P&G to limit benzene in sourced propellant to 1 ppm.14SGT Law Group. • Coppertone ($2.3 million, 2023): Settled sunscreen contamination claims.11Drugwatch. Benzene Lawsuits
  • Unilever dry shampoo (denied, 2026): A federal judge in Connecticut denied preliminary approval of a $3.625 million settlement in February 2026, ruling that the proposed class covering purchasers of Suave, TIGI, TRESemmé, Dove, and Nexxus dry shampoos was “impermissibly broad” and that many named plaintiffs had not shown they actually bought the products. Plaintiffs were given leave to rework their claims.16ClassAction.org. $3.6 Million Unilever Dry Shampoo Settlement

Benzoyl Peroxide Acne Products

In March 2024, Valisure advanced a new theory: that benzoyl peroxide, the active ingredient in many acne treatments, degrades into benzene over time. The petition triggered 35 class actions across 10 federal districts. In August 2024, the Judicial Panel on Multidistrict Litigation declined to consolidate them, finding too many distinct defendants and product formulations to make centralization efficient.17GovInfo. In re: Benzoyl Peroxide Marketing, Sales Practices and Products Liability Litigation, MDL No. 3120

The FDA pushed back in March 2025, announcing that after testing 95 benzoyl peroxide products, more than 90% showed “undetectable or extremely low levels of benzene.” Six products with elevated levels were voluntarily recalled: La Roche-Posay Effaclar Duo, Walgreens Acne Control Cleanser, Proactiv Emergency Blemish Relief, SLMD Benzoyl Peroxide Acne Lotion, Walgreens Tinted Acne Treatment Cream, and Zapzyt Acne Treatment Gel. The agency also criticized “unvalidated testing methods by third-party laboratories” for creating “consumer confusion.”18FDA/Skadden. Proving a Benzene Case

The central challenge is tying a specific exposure to a specific illness. Attorneys gather workplace records including safety data sheets, chemical inventories, air monitoring data, and OSHA inspection records to document the intensity and duration of exposure. Medical documentation, including pathology reports and blood work, establishes the diagnosis. Expert witnesses, typically industrial hygienists, oncologists, and toxicologists, bridge the gap between exposure and disease.20Gianaris Trial Lawyers. Benzene Cancer Lawsuit

Latency complicates nearly every case. Benzene-related cancers can take 10 to 30 years to appear, so defendants routinely argue that other factors caused the disease or that the exposure was too remote to matter.21YourLawyer.com. Benzene Cancer Lawsuits Plaintiffs must distinguish their workplace or product exposure from background sources like cigarette smoke, which accounts for about half of all benzene exposure in the general population.2American Cancer Society. Benzene and Cancer Risk

Expert testimony on causation has drawn its own fights. In a 2024 ruling, the California Court of Appeal reversed a trial court’s exclusion of an expert who used a “weight-of-the-evidence” approach, holding that the absence of epidemiological studies tying a specific substance to a specific cancer does not automatically disqualify an expert if the methodology is otherwise sound.22Alston & Bird. Expert Decisions, Garner v. BNSF Railway Co.

Filing Deadlines Can Expire Before You Get Sick

Filing deadlines vary by state and are a recurring problem because illness often appears years or decades after exposure ends. Many states apply a discovery rule, starting the limitations clock when the plaintiff is diagnosed or first learns that exposure contributed to the illness. In those states, the typical window is two years from diagnosis.20Gianaris Trial Lawyers. Benzene Cancer Lawsuit Railroad workers filing under the Federal Employers Liability Act have three years.

Not every state is so forgiving. Alabama applies a “date of last exposure” rule, meaning the clock runs from when exposure ends, not from diagnosis. A worker named Jack Cline, exposed to benzene from 1968 to 1987, did not develop leukemia until 12 years later; his lawsuit was thrown out because the statute had expired in 1989, years before he was sick. The Alabama Supreme Court upheld that result 5-4.23Beasley Allen. Emerging Statute of Limitations Issues for Latent Injuries Anyone with past benzene exposure and a recent diagnosis should check their state’s rule quickly.

Who Gets Sued and What They Argue

The most frequently named defendants include major oil and gas companies like ExxonMobil, Chevron, Shell, ConocoPhillips, and BP, along with industrial defendants like U.S. Steel and Du Pont. Consumer product litigation has targeted Procter & Gamble, Johnson & Johnson, Unilever, Edgewell Personal Care (Banana Boat), and Beiersdorf (Coppertone), among others.11Drugwatch. Benzene Lawsuits

Defendants recycle a few core arguments. They challenge causation, saying the plaintiff’s cancer subtype is not linked to benzene or that the exposure was too low. They lean on the long latency period to argue the connection to past exposure is speculative.21YourLawyer.com. Benzene Cancer Lawsuits In consumer product cases, manufacturers have argued that FDA-approved labeling preempts state-law claims; that defense has already killed one benzoyl peroxide class action.19Michigan Lawyers Weekly. Class Action Over Benzene Dismissed as Preempted

Plaintiffs have their own counterweight. Internal documents uncovered through litigation show that BP, Chevron, ConocoPhillips, ExxonMobil, and Shell formed the Benzene Health Research Consortium in the late 1990s and spent at least $36 million funding the Shanghai Health Study, which API documents described as “designed to protect member company interests” and aimed at providing “scientific support for a lack of a risk of leukemia” at ambient levels.5Center for Public Integrity. Benzene and Worker Cancers: An American Tragedy24The Guardian. Documents Reveal Petrochemical Industry’s Effort on Benzene As far back as 1948, the American Petroleum Institute itself acknowledged that “the only absolutely safe concentration for benzene is zero.” The gap between what industry knew and what it told workers is the foundation of most plaintiffs’ theories.

What’s Coming Next

Three developments will shape the next few years of benzene litigation. The Pennsylvania Superior Court’s handling of the Gill appeal will test whether a $725 million noneconomic damages award survives review. The benzoyl peroxide cases now proceeding one by one, without MDL consolidation, will test how much weight courts give the FDA’s criticism of Valisure’s testing methods. And in March 2025, IARC classified automotive gasoline itself as a Group 1 carcinogen, concluding it causes both bladder cancer and AML in adults based on sufficient evidence in humans, experimental animals, and strong mechanistic evidence in exposed humans.25IARC. IARC Monographs Evaluation of the Carcinogenicity of Automotive Gasoline That classification gives plaintiffs’ lawyers a new tool for establishing causation in gasoline-related cases and could broaden claims from benzene as an isolated chemical to gasoline as a whole product.

With roughly 85,000 hematopoietic and lymphatic cancers diagnosed annually in the United States, the pool of potential plaintiffs remains large.26Casualty Actuarial Society. Benzene Litigation Presentation If you have a documented exposure history and a qualifying diagnosis, the first move is confirming your state’s filing deadline before anything else.
