What the Case Was About

Sixteen named plaintiffs accused Beyond Meat of making misleading protein claims across its retail lineup, including plant-based burger patties, ground beef, sausage links, breakfast sausages, breaded chicken tenders, and Italian-style meatballs.3Beyond Meat Protein Settlement. The dispute turned on how protein gets measured. FDA rules let manufacturers list total grams of protein using the nitrogen method, which multiplies a food’s nitrogen content by a standard factor. When a package makes a protein claim on the front, though, the Nutrition Facts panel is supposed to show the percentage of daily value using a second method called PDCAAS, which accounts for how well the body can actually digest and use that protein.4GovInfo. The plaintiffs argued Beyond Meat used the more flattering nitrogen figure on the front of the package while its products scored lower on PDCAAS, meaning the protein was less digestible and less complete than the labels suggested. Their lab testing indicated the adjusted daily value percentages fell below what appeared on the packaging.4GovInfo. In Re Beyond Meat Inc Protein Content Marketing and Sales Practices Litigation

Judge Sara Lee Ellis partially sided with Beyond Meat on the law, holding that FDA rules don’t require the front-label gram figure itself to be adjusted using PDCAAS. Those front-label gram claims were dismissed as preempted. Broader misleading-marketing claims survived long enough to produce the settlement.4GovInfo.
