Biagi Bros, Inc., the Napa-based logistics and trucking company, has been the subject of a range of lawsuits and enforcement actions over the past two decades. The most recent is a January 2025 data breach that several law firms are now investigating for potential class action claims. Earlier matters include two settled California labor cases under the Private Attorneys General Act, a pending wrongful termination suit, an OSHA fatality investigation, a California Air Resources Board emissions settlement, and a contested workers’ compensation claim.
The 2025 Data Breach Investigation
Biagi Bros detected suspicious activity on its network in January 2025 and later determined that unauthorized access had occurred between December 31, 2024, and January 10, 2025. The exposed information was broad. It potentially included names, addresses, dates of birth, Social Security numbers, driver’s license and government ID numbers, financial account details, medical and health insurance information, and login credentials. The cybersecurity firm Breachsense reported that as much as 820 gigabytes of data may have been stolen, a figure Biagi Bros has not confirmed. PAGA Labor Settlements
Biagi Bros has resolved two lawsuits brought under California’s Private Attorneys General Act, which lets employees sue on behalf of the state for labor code violations.
The first, filed by Santiago Alvarez in Los Angeles County Superior Court in August 2021, covered an estimated 350 aggrieved employees and was handled by Schimmel & Parks.3CABIA. Santiago Alvarez v. The second PAGA action, filed by Fabio Escobar and Lisandro Reyes in June 2022 under case number 23CV00749 and handled by Shegerian & Associates, involved 65 employees. It settled for $801,000, finalized in May 2026, with $267,000 in attorney fees, $15,000 in litigation expenses, $20,000 in PAGA penalties, $20,000 in plaintiff awards, and $5,000 as an individual PAGA payment. Contreras Wrongful Termination Case
Paul Contreras filed a wrongful termination suit against Biagi Bros in Los Angeles County Superior Court on May 20, 2022. Judge Robert B. Broadbelt was assigned the case at the Stanley Mosk Courthouse, and a jury trial was scheduled for May 15, 2024. OSHA and Workplace Safety
The most serious safety incident on record occurred on November 2, 2006, at a Biagi Bros Virginia Inc. facility in Williamsburg. Around 7:30 p.m., a truck driver was caught and pulled into a tractor-trailer by pallets moving on an automated conveyor. OSHA issued two citations. One was a serious violation with an initial $7,000 penalty. The other was a willful violation with an initial $70,000 penalty, a designation reserved for cases where OSHA believes the employer knowingly disregarded safety requirements or was plainly indifferent to worker safety. CARB Diesel Emissions Settlement
In February 2010, Biagi Bros settled with the California Air Resources Board over the company’s failure to properly inspect its diesel vehicles for excess emissions during 2008 and 2009. Tole Workers’ Compensation Decision
Darrell Tole, a 57-year-old employee, tore his right knee meniscus on February 18, 2022, while crawling under a trailer to inspect for damage. Biagi Bros contested the claim, calling a transportation manager, a corporate compliance manager, and a transportation supervisor who argued Tole’s account was not credible. The administrative law judge found Tole more credible. On March 26, 2024, the Workers’ Compensation Appeals Board issued a split decision that admitted two medical exhibits Biagi Bros had sought to introduce but affirmed the finding that Tole had sustained an industrial injury arising out of his employment.13California DIR. Current Operating Status
None of these matters has affected the company’s ability to operate. As of June 2026, Biagi Bros Inc. holds active USDOT status and authorized operating authority for property transport and brokerage through the Federal Motor Carrier Safety Administration, with a “Satisfactory” safety rating. Over the prior 24 months, FMCSA recorded 305 roadside inspections, a driver out-of-service rate of 0.3 percent, a vehicle out-of-service rate of 10 percent, and eight crashes, all tow-aways, with no fatalities or injuries.14FMCSA.
