Who Was Covered
The settlement class included anyone who used the BJC HealthCare MyChart patient portal between June 2017 and August 2022.3ClassAction.org. BJC is headquartered in St. Louis, but class members were not limited to Missouri residents.
If you used MyChart at a different health system, this settlement does not cover you. A separate class action involving Mount Sinai Health System’s MyChart resulted in its own $5.26 million settlement covering patients who logged in between October 2020 and October 2023.4NewsNation. What Claimants Received
Each class member who submitted a valid claim was entitled to a base cash payment of $35. That amount could move up or down on a pro rata basis depending on the total claims filed: higher if the fund was not exhausted, lower if claims exceeded the $9.25 million cap.5BJC Privacy Settlement. The financial structure was tiered. BJC funded an initial $5.5 million to cover attorneys’ fees (capped at $3 million), administration costs (up to $200,000), $15,000 service awards for each of the two named plaintiffs, and class member payments. If claims exceeded that pool, BJC agreed to add up to another $3.75 million, for a total possible payout of $9.25 million.6HIPAA Journal. What the Lawsuit Alleged
The case was filed on July 25, 2022, in Missouri state court as John Doe I and John Doe II v. BJC Health System d/b/a BJC HealthCare, Case No. 2222-CC09151-01.8ClassAction.org. Doe I et al. v. BJC Health System Settlement Agreement Two pseudonymous plaintiffs alleged that BJC embedded online tracking code on its websites and MyChart portal that transmitted personally identifiable patient information to outside companies.
According to the complaint, the tracking tools captured data tied to bill payments, doctor services, treatments, medical conditions, and appointments, and sent that information to Facebook, Google, SiteScout, Invoca, and The Trade Desk without patient knowledge or consent.9The HIPAA E Tool.
