No lawsuit has been filed against BlockDAG as of mid-2026, and no government regulator has brought an enforcement action against the project itself. The Allegations Driving Legal Interest
Blockchain investigator ZachXBT made the most detailed public accusations in April 2026, alleging that BlockDAG took more than $300 million from “unsophisticated retail investors” through social media ads promising returns of 50x, 85x, and 100x. He identified Gurhan Kiziloz, a Turkish-British entrepreneur whose role had been hidden from investors, as the project’s co-founder, and described BlockDAG’s public leadership as “figureheads.”2CryptoPotato. In May 2026, ZachXBT alleged that at least $25 million in presale funds from BlockDAG and a separate project called ZKP were commingled and used to pay influencers promoting Spartans.com, a casino site linked to Kiziloz. He published a forensic graph showing presale wallets consolidating, funds bridging from Ethereum to Tron, and connections to Spartans’ payment addresses. Neither project’s presale materials, according to ZachXBT, disclosed that funds would be used to promote a separate venture.4Cryptopolitan. A parallel investigation by DL News, based on interviews with 13 insiders and internal records, found that the sum raised is itself disputed. BlockDAG’s website has claimed more than $442 million; CEO Nic Van Den Bergh told DL News by phone that the actual figure was about $200 million. No auditable smart contract holds the funds, and leadership has declined to say where the money is kept. Blockchain analysis traced at least $110 million to accounts on Binance and BTSE, roughly $7 million to a token-swapping protocol called Bridgers, and about $5 million to the DeFi protocol Mimic. What Investors Say They Lost
Complaints fall into three groups: undelivered hardware, diluted tokens, and money that cannot be accounted for.
BlockDAG sold X30 miners at $500 each and X100 miners at $1,600 each. As of early 2026, 2,550 X30 orders and 2,250 X100 orders remained unfulfilled, totaling more than $5 million in unshipped sales. Only about 20 prototypes had been shipped. Turner acknowledged that during his tenure only a deposit had been paid toward the X100s and “nothing towards the X30s.”3DL News. On tokens, the original whitepaper described a 50 billion BDAG supply. Beginning in April 2024, the project ran “bonus coin” promotions such as “buy one coin, get 10.” Investors estimated that between 90 billion and 150 billion tokens were ultimately sold, and CoinGecko data from June 2026 shows a total supply near 102.8 billion. BDAG hit an all-time high near $0.094 on March 13, 2026, shortly after exchange listings began. By June 2026 it had fallen to roughly $0.0000384, with a market capitalization of $3.2 million.6CoinGecko. BlockDAG Price, Chart, and Market Cap
Contract counterparties fared no better. Borussia Dortmund declared BlockDAG in default on a €2,007,444 payment and terminated its agreement in September 2024. Inter Milan issued a cease-and-desist in August 2025 citing material breach for non-payment. Alpine Racing Limited sent a letter in November 2025 stating that $1.4 million in sponsorship fees was unpaid, setting a December 3, 2025, remedy deadline. Former assistant Liza Van Den Berg said roughly 24 employees were owed more than $140,000 for December 2025 work. Turner said most salaries, mining equipment orders, and third-party invoices went unpaid during his time as CEO, and that he had been “heavily reliant on a shadow director to execute payments.”3DL News. The One Formal Regulatory Action
In March 2025, the Financial Services Authority of Seychelles issued a formal warning against BlockDAG for “unauthorised activity under the Virtual Asset Service Providers Act 2024.”3DL News. It is a warning, not an enforcement proceeding, and no fine, injunction, or criminal charge has followed.
Related actions target a different entity. The UK’s Financial Conduct Authority previously warned consumers about Kiziloz’s earlier venture Lanistar for operating without authorization, and the High Court of Justice in London ordered Lanistar Limited liquidated in September 2025.7Sifted. The Investor-Led Legal Effort
With no lawsuit yet on file, affected buyers have organized their own vehicle. The BlockDAG Community DAO is registered as a Wyoming Decentralized Unincorporated Nonprofit Association (DUNA), a structure under Wyoming state law meant to give an online investor group legal standing for collective action.8ChimeraPool. Organized in part by community figure Reid Davis, the DAO’s stated objectives include pushing for a transition of the project (code, wallets, and development) to community control, notifying regulators and exchanges of an active legal claim over the project, and recovering funds from the entity the group calls “G,” a reference to Kiziloz. A separate Change.org petition launched in 2025 by the “BlockDAG Investor Coalition” demanded full tokenomics disclosure, a verifiable miner delivery timeline, and proof of regulatory compliance. The Arbitration and Class-Action Waiver
Anyone considering a lawsuit against BlockDAG will run into a clause in the project’s whitepaper requiring all disputes to be resolved through individual arbitration under the Centre for Effective Dispute Resolution, with participants waiving the right to class action.1BlockDAG Network. The operating company, DAG Systems Ltd, is registered in Samoa according to the current whitepaper and governed by Seychelles law according to an earlier litepaper.1BlockDAG Network. The Founder’s Track Record
Kiziloz’s earlier venture Lanistar, a digital banking startup launched in 2019, attracted celebrity endorsements and heavy influencer marketing but never delivered a viable product. The FCA warned consumers, and the UK’s Advertising Standards Authority flagged its advertising as misleading. After the departure of its CEO and advisory board member Sir Gavin Williamson in late 2024, a payments provider filed a winding-up petition in February 2025, and the High Court ordered liquidation months later.7Sifted.
