BMW Fire Class Action Lawsuit: Recalls, Cases, and Settlements

BMW owners searching for a fire-related class action lawsuit are usually looking at one of four separate defects, each tied to its own recall and its own set of model years. The longest-running case, consolidated in the U.S. District Court for the District of New Jersey, covers 2006–2012 models with blower motor wiring and PCV valve heater defects and survived BMW’s motion to dismiss in March 2024. Other fire-risk recalls — a water pump electrical connector on 2012–2018 four-cylinder cars, an exhaust gas recirculation cooler on 2013–2018 diesels, and a corroding starter relay on 2019–2022 models — have produced short-lived lawsuits, active investigations, or no litigation at all so far.

Which BMWs Are Covered

Four distinct fire-risk defects have driven recalls and litigation over the past decade. The vehicle you own determines which one, if any, applies.

  • 2006–2012 1 Series, 3 Series, 5 Series, X3, X5, and Z4 with N51, N52, N52K, or N52T engines: blower motor wiring harness and PCV valve heater defects.   • 2013–2018 328d, 535d, 740Ld, X3 xDrive28d, X5 xDrive35d (N47 or N57 diesel engines): EGR cooler leaks. The Active Case: Blower Motor and PCV Heater Litigation

The furthest-advanced BMW fire class action is consolidated in the U.S. District Court for the District of New Jersey under Case No. 18-cv-09546. Named plaintiffs include Gabriel Patlan, Ryan Cornell, and La Della Levy. The complaint targets 2007–2012 BMW 1 Series, 3 Series, 5 Series, X3, X5, and Z4 models with N51, N52, N52K, or N52T engines and alleges two defects — a blower motor wiring harness and a PCV valve heater — either of which can short-circuit and ignite a fire even when the car is parked and turned off.1Giskan Solotaroff & Anderson. Levy’s 2007 328i caught fire in her driveway in September 2015 while parked and off, burning beyond repair and destroying personal property. Patlan and Cornell, both California owners of 2011 328i vehicles, allege BMW told them recall repairs couldn’t be performed and offered no compensation.7GovInfo. Patlan v. On March 28, 2024, Judge Cecchi ruled on BMW’s motions to dismiss. Consumer fraud claims under California, New Jersey, and Nevada law were allowed to proceed, with the court finding that plaintiffs had adequately alleged BMW knew about the defects from customer complaints and incident reports. Breach of implied warranty and Magnuson-Moss Warranty Act claims also survived. Express warranty claims were dismissed without prejudice.7GovInfo. Patlan v. The court also rejected BMW’s argument that its 2017 recalls made the case moot, noting that plaintiffs sought relief beyond what the recalls covered, including compensation for diminished vehicle value and out-of-pocket expenses. Class certification has not yet been decided. The case is still open, and no class has been certified yet, so there is nothing for owners to claim at this stage. Owners in the covered model years should retain repair records, tow receipts, and any documentation of a fire or thermal event.

Water Pump Connector Recall and the Lawsuits That Followed

The August 2024 recall (NHTSA 24V-608) covers 720,796 BMWs from 2012–2018 with N20 or N26 four-cylinder engines. Liquid from the positive crankcase ventilation system can drip onto the water pump’s electrical plug connector, seep inside, and short-circuit — in rare cases igniting a fire.5NHTSA. Two class actions were filed after the recall. Both were voluntarily dismissed by the plaintiffs before any substantive ruling.

Both dismissals were without prejudice, meaning the claims could theoretically be refiled. As of the available research, no other active class action covers the water pump connector defect. Owners with an affected VIN should get the free recall repair through a BMW dealer and keep records of any related repair costs paid before the recall.

EGR Cooler Diesel Recall

Certain 2013–2018 BMW diesels — including the 328d, 535d, 740Ld, X3 xDrive28d, and X5 xDrive35d — can develop internal leaks in the exhaust gas recirculation cooler. Coolant mixing with diesel soot at engine temperatures can form smoldering particles that melt small holes through the intake manifold and, in rare cases, cause a fire.14NHTSA. The 2025 “Park Outside” Starter Relay Recall

In September 2025, BMW recalled roughly 196,355 model year 2019–2022 vehicles — the Z4, 330i, X3, X4, 530i, 430i, and 230i — plus about 1,469 Toyota Supras built by BMW, for a corroding engine starter relay that can overheat and short-circuit. The fire risk exists whether the car is running or parked, so NHTSA directed owners to park outside and away from buildings until the repair is done.6CNN. BMW Fire Recall16NHTSA. Because replacement parts weren’t immediately available, the recall is being conducted in phases. Interim notification letters were scheduled to be mailed November 14, 2025, with a second round to follow once parts are ready.17NBC News. Related Settlements

Three prior class settlements involved BMW defects that overlap with the fire-risk vehicle population. The claim windows on all three have closed, but owners who filed timely claims may still be receiving benefits or awaiting distribution.

Timing Chain Settlement (2021)

Gelis v. Bayerische Motoren Werke Aktiengesellschaft (Case No. 2:17-cv-07386, D.N.J.) covered 2012–2015 BMW vehicles with N20 and N26 engines — the same engines involved in the 2024 water pump recall — over defective timing chain and oil pump drive chain modules. Final approval came February 16, 2021. Reimbursements ranged from 40% to 100% of costs depending on mileage, capped at $3,000 for chain module repairs and $7,500 for engine replacements at independent shops. Water Damage Electronic Component Settlement (2017)

Catalano v. BMW of North America LLC resolved claims about water-damaged electronic modules in the spare-tire wells of 2004–2010 5 Series (E60 and E61) vehicles. Final approval came July 28, 2017, in the Northern District of California. Class members received free inspection and repair plus reimbursement up to $1,500. Canadian PCV and Blower Motor Settlement (2021)

Quebec residents who owned or leased 2006–2012 BMWs subject to the PCV heater and blower motor wiring recalls received benefits under a C$1.3 million settlement in Pasaje v. BMW Canada Inc. (File No. 500-06-000915-187), approved June 14, 2021 by the Quebec Superior Court. Benefits included a $40 dealership credit for all class members, a $50 credit for those told to park outside, and up to $750 reimbursement for expenses related to a fire or thermal event. What Owners Should Do

Check whether your BMW is covered by any of the recalls above using NHTSA’s VIN lookup, and if it is, schedule the free repair at a BMW dealer. Keep every record you have: repair invoices, tow bills, rental car receipts, insurance claims, and photographs of any fire or thermal event. If your vehicle falls into the 2007–2012 range covered by the consolidated New Jersey litigation, those records may matter later if a class is certified. If you paid out of pocket for a repair that a recall now covers for free, you can generally request reimbursement directly from BMW under the recall program.

BMW has not publicly conceded liability in any of the fire-related class actions. Two of the four defect categories — water pump connector and starter relay — currently have no active class action attached to them. The blower motor and PCV heater case remains the only fire-related BMW class action to have survived a motion to dismiss.
