There is no Bobbie formula lawsuit. As of mid-2026, Bobbie Baby Inc. is not a defendant in any product liability case, class action, or enforcement action, and no settlement or claims process exists for its products. Searches for the phrase usually lead back to one of three unrelated stories: Bobbie’s own voluntary FDA recall in 2019, the large necrotizing enterocolitis (NEC) litigation against Abbott and Mead Johnson, or the heavy-metals class actions that have targeted other formula makers.
The 2019 Recall Was Not a Lawsuit
Bobbie’s only direct regulatory event happened weeks after its 2019 pilot launch. FDA inspectors visited the company’s San Francisco warehouse in May 2019 and determined that the product, which Bobbie had marketed as a “toddler” or “companion” formula, was in fact being sold as infant formula. That classification triggers the Infant Formula Act, which requires growth monitoring studies, nutrient testing, and specific food safety standards Bobbie had not met.1Fortune. The company issued a voluntary recall, notified its roughly 100 subscribers, and stopped production. The original product never came back. CEO Laura Modi acknowledged that the packaging and online copy had been misleading by failing to specify the product was intended for children 12 months and older.2Inc. Bobbie hired a former Abbott regulatory specialist, partnered with Vermont-based Perrigo Nutritionals for manufacturing, and met with the FDA in Silver Spring in November 2019 to lay out a new domestic supply chain.1Fortune. The NEC Lawsuits Do Not Involve Bobbie
The formula litigation most often mistaken for a Bobbie case is the necrotizing enterocolitis multidistrict litigation. NEC is a severe intestinal condition that primarily affects premature infants. Plaintiffs allege that Abbott Laboratories (Similac) and Mead Johnson, a Reckitt subsidiary (Enfamil), marketed cow’s milk-based formulas as safe for preterm infants while failing to warn that those formulas substantially raise the risk of NEC.4Motley Rice. Trial verdicts so far have gone in both directions:

No global settlement has been reached, and no settlement fund or claims process has been established as of mid-2026.5Keller Postman. Bobbie is not named in any of these cases, and its formulas are not among the products at issue.
Heavy Metals Lawsuits and Where Bobbie Stands
A separate line of litigation involves heavy metals in infant formula. Consumer Reports tested dozens of powdered formulas and found that roughly half contained potentially concerning levels of at least one contaminant, including arsenic, lead, and mercury. The FDA has no formal federal limits for heavy metals in infant formula, though it announced a new oversight initiative the day after Consumer Reports shared its findings in March 2025.7Consumer Reports. The primary defendant has again been Abbott. A class action, Huggins et al. v. Abbott Laboratories, No. 1:25-cv-02460, was filed in March 2025 in the Northern District of Illinois, alleging Abbott failed to disclose heavy-metal contamination in several Similac products. The complaint cited testing claiming that 98 percent of samples contained at least one heavy metal.8ClassAction.org. Bobbie’s products have performed well in independent testing. Consumer Reports named all four Bobbie formulas “Top Choices” in both 2025 and 2026, finding non-detectable to low levels of heavy metals and toxins.10Yahoo Finance. Bobbie’s Current Regulatory Standing
Bobbie is an FDA-compliant infant formula manufacturer with no pending lawsuits, enforcement actions, or regulatory sanctions against it. The company runs its own manufacturing plant in Heath, Ohio, in addition to its co-manufacturing relationship with Perrigo, and reports conducting more than 2,000 quality and safety checks per batch.10Yahoo Finance.
