Boeing Whistleblower Lawsuit Over John Barnett’s Death

The lawsuit filed over John Barnett’s death is a wrongful death and retaliation suit brought by his mother and two brothers against Boeing in March 2025, alleging that a years-long campaign of retaliation against the former quality manager caused him to take his own life during his deposition week. The parties told the court they had reached a confidential settlement in May 2025, but as of April 2026 a federal judge in South Carolina had refused at least twice to approve it, saying the court could not evaluate fairness without seeing the full terms.¹

Who Barnett Was and What He Reported

John Barnett spent more than 30 years at Boeing, working as a quality control and quality manager at facilities in Everett, Washington, and North Charleston, South Carolina, before retiring in 2017 on health grounds.² Beginning around 2010, by his account, leadership at the North Charleston 787 Dreamliner plant began pressuring staff to bypass quality procedures, avoid documenting defects, and install defective parts to keep production moving.³

Three concerns anchored his complaints. He said testing showed roughly 25% of emergency oxygen systems failed to deploy properly, meaning passenger masks could malfunction during decompression.⁴ He reported that titanium fasteners peeled during floorboard installation, sending sharp metal slivers into areas housing flight control wires; an FAA spot audit of ten airplanes confirmed the debris was present in all of them.³ And he alleged the plant was not properly tracking non-conforming components; a 2017 FAA review confirmed at least 53 defective parts had effectively been lost.

Boeing acknowledged the metal shavings issue and said it had been addressed through a 100% inspection requirement, while maintaining that its flight safety board determined the debris did not present a safety-of-flight concern.

The Retaliation Case That Was Underway When He Died

On January 16, 2017, Barnett filed a formal whistleblower retaliation complaint with OSHA under the Wendell H. Ford Aviation Investment and Reform Act (AIR-21), the federal statute that protects aviation employees who report safety concerns.⁵ He alleged Boeing subjected him to a hostile work environment, penalized him in performance reviews, and blocked him from transfers because of his protected activity. He retired that same year, citing severe stress.⁴

In November 2020, OSHA found “no reasonable cause to believe” Boeing had violated AIR-21. Barnett objected and requested a hearing before an administrative law judge, who denied Boeing’s partial motion to dismiss in March 2022. The case then moved into discovery with the Department of Labor and was approaching a scheduled hearing by early 2024.⁶

How He Died

Barnett had traveled from his home in Louisiana to Charleston for the deposition and had already been questioned by Boeing’s lawyers over the preceding days. On March 9, 2024, he failed to appear for a scheduled day of testimony. His body was found in his locked pickup truck in a Charleston Holiday Inn parking lot. He was 62.²

Charleston police released their investigation on May 17, 2024, concluding that Barnett died from a self-inflicted gunshot wound to the head. Investigators found no signs of forced entry or a struggle. A Smith and Wesson handgun was in his right hand with his finger still on the trigger, and ballistics confirmed the bullet and casing were fired from that weapon, which he had legally purchased.⁷ Security footage showed his vehicle parked in the same spot from the evening of March 8 until discovery, with no one seen entering or exiting.⁸

A notebook found in the passenger seat contained handwritten messages including “I found my purpose! I’m at peace!” and “I pray Boeing Pays!!!” Forensic analysis confirmed only Barnett’s fingerprints were on the note. Police also cited medical records indicating a history of PTSD, anxiety, and intrusive thoughts.⁷ The Charleston County Coroner ruled the manner of death a suicide, and the investigation was closed with foul play ruled out.⁸

What the Wrongful Death Lawsuit Claims

On March 19, 2025, Barnett’s mother, Vicky Stokes, and his brothers Rodney and Michael Barnett filed a wrongful death lawsuit against Boeing in the U.S. District Court for the District of South Carolina.⁹ The 146-page complaint alleges that Boeing subjected Barnett to a retaliatory campaign of harassment, denigration, and humiliation after he raised safety concerns, and that the resulting hostile work environment was the “clear, foreseeable cause” of his death. The suit accuses Boeing of blacklisting him from transfers, isolating him from colleagues, and working to discredit him.¹⁰

The complaint asserts claims for wrongful death, abuse of process, and retaliation, and seeks compensatory and punitive damages along with a jury trial.¹⁰ The family is represented by Charleston attorneys Robert Turkewitz and Brian Knowles, who handled Barnett’s earlier retaliation case, together with David Boies and Sigrid McCawley of Boies Schiller Flexner.¹¹

Boeing said it was “saddened by John Barnett’s death” and extended condolences to his family, but did not directly address the allegations in the complaint.¹²

The Settlement and Why It Hasn’t Been Approved

In May 2025, Federal District Judge Bruce Hendricks confirmed that Boeing and Barnett’s estate had notified the court of a settlement, and the lawsuit was dismissed pending completion of the agreement within 60 days.¹³ The deal was described as a “full, final and confidential” resolution of all claims brought by Barnett and his estate, covering both the wrongful death suit and the underlying retaliation case that had been pending when he died.¹⁴

Court filings disclosed that Boeing agreed to pay at least $50,000 for the wrongful death claim itself, with $20,000 designated for legal fees and $30,000 going to Barnett’s mother. Any broader payment tied to the retaliation case was kept confidential.¹⁵ Boeing stated in the filing that it “denied and continues to deny that any act or omission on its part” contributed to Barnett’s injury or death.¹⁴

Judge Hendricks declined to approve the $50,000 settlement, saying the court could not determine whether the deal was fair without seeing the details of the related confidential agreement covering the retaliation claim.¹⁶ The judge rejected the proposed settlement at least twice on that ground.¹ As of April 2026, the settlement remained unapproved, and the court continued to require disclosure of the confidential terms before signing off.

Where the Case Fits in Boeing’s Broader Whistleblower Problems

Barnett’s case did not stand alone. Between December 2020 and March 2024, Boeing was the subject of 32 whistleblower retaliation complaints filed with OSHA, 13 of them related to aviation safety. Apart from two cases that resulted in monetary restitution, all complaints with specified outcomes were closed without agency action, often because filing deadlines were missed or OSHA lacked jurisdiction.¹⁷

Other Boeing whistleblowers drew public attention in the months after Barnett’s death. Joshua Dean, a former quality auditor at Boeing supplier Spirit AeroSystems who had raised concerns about improperly drilled holes on 737 MAX fuselages, died on April 30, 2024, after a sudden illness involving MRSA, pneumonia, and a stroke; he had been represented by Brian Knowles, the same attorney who represented Barnett.¹⁸ Boeing quality engineer Sam Salehpour testified before a Senate subcommittee on April 17, 2024, alleging that Boeing used excessive force to join 787 fuselage sections and that he had been told to “shut up” and threatened after raising concerns.¹⁹ Boeing inspector Sam Mohawk filed an OSHA complaint in June 2024 alleging supervisors ordered staff to delete records identifying hundreds of non-conforming 737 MAX parts.²⁰

At a June 18, 2024, Senate hearing, then-CEO Dave Calhoun was asked how many employees Boeing had fired for retaliating against whistleblowers. He responded, “I don’t have that number on the tip of my tongue. But I know it happens,” and confirmed that Boeing had “disciplined and even fired” supervisors for retaliation, though he could not give a count and said he had never personally spoken with a company whistleblower.²¹ Senator Richard Blumenthal, whose staff had spoken to more than two dozen whistleblowers alleging retaliation, called Boeing’s safety culture “broken.”²² Boeing has said it does not tolerate retaliation and reported a more than 500% increase in employee safety reports since January 2024, while acknowledging it has “more work to do.”¹⁹
