Breast Cancer Side Effects Lawsuit: Prempro, Hair Dye, and PFAS

If you developed breast cancer and believe a product, drug, or medical device played a role, your legal options depend heavily on which product is involved. One hormone replacement drug, Prempro, has already produced roughly $1.7 billion in settlements and verdicts. Most other breast cancer lawsuit categories are either early-stage, limited to other cancers, or effectively closed. Medical malpractice claims for misdiagnosis remain a separate and active route.

Prempro and Hormone Replacement Therapy

Prempro is the only product liability litigation tied to breast cancer that has produced large-scale compensation. The drug, originally made by Wyeth and later carried by Pfizer after its 2009 acquisition, was linked by the Women’s Health Initiative trial to a sharply higher risk of breast cancer, with studies showing risk increases of over 300% for estrogen-dependent breast cancers in women who took it for five or more years.1Hausfeld. Prempro Hormone Replacement Therapy

More than 10,000 women sued. Trials produced large awards, including a $75 million punitive verdict in a 2009 Pennsylvania case and a $34.3 million verdict in a Philadelphia case the same year.2MedPage Today. Pfizer Ordered to Pay $34.3 Million in Prempro Case One trial judge called Wyeth’s conduct “reprehensible” and described a “long-term campaign to muddy the waters regarding the risks posed by Prempro.”1Hausfeld. Prempro Hormone Replacement Therapy

Pfizer disclosed in a 2013 SEC filing that it had spent approximately $1.7 billion resolving the litigation.3FiercePharma. Pfizer Expects to Wrap Up Prempro Suits Average individual payouts came in around $150,000. By 2015, the centralized docket was closed and more than 99% of claims had been resolved.4Simon Attorneys. NJ Personal Injury Prempro Prempro is essentially a closed chapter at this point, but it remains the clearest example of what a successful breast cancer product liability campaign looks like.

Hair Relaxers: Breast Cancer Is Not Currently in the MDL

The chemical hair relaxer litigation is the largest active mass tort tied to women’s cancers, but if your diagnosis is breast cancer, this is important: breast cancer is not a qualifying condition for the current multidistrict litigation. More than 11,500 cases are consolidated in In re: Hair Relaxer Marketing, Sales Practices, and Products Liability Litigation (MDL No. 3060) in the Northern District of Illinois before Judge Mary Rowland, with defendants including L’OrĂ©al USA, Namaste Laboratories, and Godrej SON Holdings.5Drugwatch. Hair Relaxer Lawsuit The qualifying injuries are uterine, ovarian, and endometrial cancer. One law firm’s analysis stated plainly that the breast cancer association “is not included in the lawsuit at this time.”6The Winder Law Firm. Hair Relaxer Lawsuit

The science connecting these products to breast cancer does exist. A 2019 analysis of the NIH’s Sister Study, published in the International Journal of Cancer, found that women who used chemical hair straighteners every five to eight weeks were roughly 30% more likely to develop breast cancer.7National Institutes of Health. Permanent Hair Dye and Straighteners May Increase Breast Cancer Risk A 2021 study in Carcinogenesis following over 50,000 Black women found some evidence linking heavy use of lye-based relaxers to estrogen receptor-positive breast cancer, though the authors described overall results as “largely null” and called for further research.8PubMed. Some individual law firms do evaluate hair relaxer breast cancer cases on a case-by-case basis outside the MDL,9Miller Law Group NC. How Do You Qualify for a Hair Relaxer Lawsuit but no settlements have been reached in the hair relaxer litigation as a whole. The defendants deny the allegations and maintain their products are safe.6The Winder Law Firm. Hair Relaxer Lawsuit Bellwether trials are not expected before mid-2027.10MDL Update. Permanent Hair Dye

Permanent hair dye is a separate category where breast cancer cases are being filed, though at a very early stage. The 2019 Sister Study found permanent hair dye use associated with a 45% higher breast cancer risk among Black women and 7% among white women, climbing to 60% among Black women who dyed every five to eight weeks.11PubMed. Lawsuits are being filed against major manufacturers on behalf of women with breast cancer who used permanent dye frequently over long periods.12Consumer Notice. Hair Dye Breast Cancer Lawsuit At least one major firm has said it is monitoring the research but not yet filing breast cancer claims, focusing instead on bladder cancer among salon workers as a more established cause of action.13You Have a Lawyer. PFAS and Firefighting Foam

If your breast cancer may be linked to PFAS exposure, often through aqueous film-forming foam (AFFF) used by firefighters and military personnel, there is active litigation, but like the hair relaxer MDL it currently excludes breast cancer from its bellwether track. Research summarized in the journal Toxics has linked PFOS, PFOA, and PFDA to higher breast cancer risk, and IARC classifies PFOA as a possible carcinogen.14Sokolove Law. Firefighting Foam AFFF Lawsuits

Over 15,000 personal injury PFAS cases are consolidated in an MDL in South Carolina federal court.15Drugwatch. PFAS Lawsuits Breast cancer is on the list of conditions associated with PFAS exposure, but the bellwether pool is limited to kidney cancer, testicular cancer, thyroid disease, and ulcerative colitis.16MDL Update. MDL 2873 – Aqueous Film-Forming Foams Breast cancer claims may be addressed in later phases. On the water-contamination side, manufacturers have already paid billions, including a $10.3 billion settlement by 3M in 2023.14Sokolove Law. Firefighting Foam AFFF Lawsuits

Zantac Is Largely Closed

Breast cancer was among the diagnoses alleged in the Zantac (ranitidine) litigation, which claimed the heartburn drug broke down into the probable carcinogen NDMA. The federal MDL judge dismissed all claims in December 2022 after finding the plaintiffs’ expert causation testimony unreliable. An appeal is pending, but legal observers have expressed “general pessimism” about its prospects.17TorHoerman Law. Zantac Lawsuit Some state court cases continue, but major firms have stopped taking new Zantac clients.

Breast Cancer Misdiagnosis Claims

Separate from product liability, medical malpractice is the other practical lawsuit route for breast cancer. These cases usually allege a doctor or radiologist missed an abnormality on a mammogram, failed to order a biopsy, or failed to follow up on suspicious findings, letting the cancer advance to a later and less treatable stage.

The national average payout for a breast cancer misdiagnosis claim is roughly $586,875, based on 2019 data.18Levin & Perconti. Cancer Misdiagnosis Lawsuit Payout Individual results vary widely. Reported settlements include $3.5 million for a 28-year-old whose breast lump was repeatedly misdiagnosed as cystic breast disease because her doctors failed to order a mammogram or biopsy,19NJ Attorney. Medical Malpractice – Failure to Order Appropriate Testing and $1.25 million for a 50-year-old whose mammogram was read as normal 16 months before metastatic breast cancer was discovered.20Lubin & Meyer. Breast Cancer Malpractice The central legal question is whether the delay actually changed the patient’s prognosis.

Device Lawsuits Involving Breast Cancer Patients

Two active or recently resolved device litigations involve women who had breast cancer or breast surgery, though neither alleges that the device caused breast cancer itself.

Allergan’s Biocell textured breast implants have been tied to breast implant-associated anaplastic large cell lymphoma (BIA-ALCL), a rare non-Hodgkin’s lymphoma in the tissue around the implant, with reported cases appearing two to 30 years after implantation. The FDA requested a worldwide recall in July 2019.21You Have a Lawyer. Breast Implant Lawsuit About 1,261 cases are consolidated in MDL 2921 in New Jersey federal court before Judge Brian R. Martinotti, with the first bellwether trial scheduled for June 2026.22Drugwatch. Allergan Breast Implant Lawsuits

Hologic’s BioZorb breast tissue marker, placed during lumpectomy to mark the surgical site, was the subject of roughly 200 lawsuits alleging the markers failed to dissolve and instead migrated, eroded through the skin, and caused pain, infections, and unplanned surgeries.23About Lawsuits. BioZorb Lawsuit The FDA issued a Class I recall in October 2024 covering 53,492 units.24You Have a Lawyer. BioZorb Lawsuit A global settlement was reached in February 2026, with terms undisclosed, and firms are no longer accepting new BioZorb cases.

What This Means for a Potential Claim

If you are weighing a lawsuit, the practical picture breaks down this way. Prempro cases have largely been resolved, and the window there is effectively closed. Hair relaxer and PFAS MDLs are active but do not currently include breast cancer in their qualifying conditions, meaning a breast cancer plaintiff would be looking at an individual case outside the MDL framework rather than a slot in the main litigation. Hair dye breast cancer claims exist but are early and limited. Zantac is a dead end for most new filers. Misdiagnosis claims are the most consistently available route and turn on whether the delay in diagnosis measurably worsened the outcome. Device cases such as Allergan and BioZorb are separate injury categories that happen to involve women treated for breast cancer, not claims that a device caused the disease.
