The Brita lawsuit is over. A proposed class action accusing Brita of misleading buyers about what its water filters remove was dismissed by a federal district court in September 2024, and the Ninth Circuit Court of Appeals affirmed that dismissal on April 16, 2026. There is no settlement, no payout, and no claims process. Both courts concluded that no reasonable consumer would expect a low-cost pitcher filter to strip every contaminant, including PFAS “forever chemicals,” from tap water.
What the Lawsuit Claimed
Nicholas Brown filed the case in Los Angeles County Superior Court in September 2023 after buying a Brita Everyday Water Pitcher for about $15 in early 2022. He said the packaging promoted “cleaner, great-tasting water” and claimed the filters reduce “mercury, chlorine, lead, benzene, copper and more.” The suit zeroed in on that “and more.”1Courthouse News Service. According to the complaint, Brita’s standard filters do not remove several contaminants many buyers would worry about: PFOA and PFOS, arsenic, nitrate, uranium, chromium-6, radium, and total trihalomethanes. Brown argued he would not have bought the filter, or would have paid less, had he known. He sought to represent a California class of buyers going back four years, a group the complaint estimated at “millions.”2Environmental Science and Engineering Magazine. The suit brought claims under California’s Unfair Competition Law, False Advertising Law, and Consumers Legal Remedies Act, plus breach of warranty and unjust enrichment. Two theories drove it: that Brita’s packaging affirmatively suggested comprehensive protection, and that Brita omitted a material fact by not telling buyers its filters leave many hazardous contaminants in the water.3Ninth Circuit Court of Appeals. Why the Courts Threw It Out
Chief U.S. District Judge Dolly M. Gee granted Brita’s motion to dismiss on September 30, 2024. She applied California’s reasonable consumer test, which asks whether a significant portion of the public, acting reasonably, could be misled by the marketing. She found it “simply not plausible” that a reasonable buyer would read the word “reduce” as meaning “remove” or “reduce to below lab detectable limits,” particularly when the labels listed the specific contaminants the filters are certified to address.1Courthouse News Service. The misrepresentation, warranty, and unjust enrichment claims were dismissed with prejudice. Judge Gee denied leave to amend, ruling any fix would be futile.
On appeal, a three-judge Ninth Circuit panel led by Circuit Judge Kim McLane Wardlaw agreed. Judge Wardlaw wrote that “no reasonable consumer would expect Brita’s low-cost filters to completely remove or reduce to below lab detectable levels all contaminants present in tap water,” given the front-label disclosures and the Performance Data Sheets accessible through QR codes on the packaging.4Metropolitan News-Enterprise. The panel also rejected the omission theory. Under California law, a duty to disclose generally arises only when there is a contrary representation, or when the product has a defect that creates an unreasonable safety risk or defeats the product’s central function. The court found neither applied. Brita’s filters do what the labels say they do, and the labels do not claim to remove everything.3Ninth Circuit Court of Appeals. Brown v. What Brita Filters Are Actually Certified to Remove
Since no payout is coming, the useful question is what your filter actually does. The answer depends on which Brita product you own.
The standard Brita pitcher filter (Model OB03) is certified under NSF/ANSI Standards 42 and 53 to reduce chlorine taste and odor, lead, mercury, cadmium, copper, zinc, benzene, and certain particulates. It is not certified for PFAS.6NSF International. NSF Certified Drinking Water Treatment Units – Brita
The Brita Elite filter (Model OB06) is certified under NSF/ANSI 53 for PFOA and PFOS reduction, with a published overall reduction rate of 98.1 percent on its Performance Data Sheet.7Brita. Elite Performance Data Sheet The Brita Hub countertop system is also certified for PFOA and PFOS reduction. Neither is certified for the broader PFAS family, which includes shorter-chain compounds like PFHxS, PFNA, and PFBS that the EPA now regulates.
The standard filter does not reduce arsenic, uranium, chromium-6, radium, nitrate, or trihalomethanes to certified levels. If those are your concern, the pitcher filter is not the product.
Independent Testing Tells a More Complicated Story
Certification is a laboratory result. Real-world performance can be different. A 2024 peer-reviewed study in Frontiers in Environmental Chemistry tested pitcher filters against two Canadian tap water sources. The Brita Elite reduced PFAS by 20 to 48 percent depending on the source. The standard Brita reduced PFAS by 38 percent in one test. Environmental Working Group testing found the Brita Elite reduced PFAS by only 22 percent, the lowest result among 10 filters tested. EWG noted the filter “didn’t seal well” and may have allowed unfiltered water to bypass the media.9Wisconsin Public Radio. Drinking Water PFAS Filters Ranking
Part of the gap comes from how NSF/ANSI 53 was designed. The protocols were originally built around the EPA’s 2016 advisory limit of 70 parts per trillion for PFOA and PFOS. The EPA’s 2024 enforceable maximum contaminant levels are 4 ppt for each, and the NSF standards are still being updated to match.10NSF International. The Regulatory Backdrop
In April 2024, the EPA finalized the first enforceable national limits on PFAS in public water supplies: 4 parts per trillion for PFOA and PFOS, and 10 ppt for PFHxS, PFNA, and HFPO-DA (GenX).11Federal Register. The EPA recommends looking for filters certified under NSF/ANSI 53 or NSF/ANSI 58 (reverse osmosis) for PFAS reduction, while cautioning that existing certifications do not yet guarantee reduction to the new federal levels.13U.S. Environmental Protection Agency. What to Do If You Own a Brita Filter
Nothing you own becomes eligible for a refund because of this case. If PFAS is the reason you bought a filter, check which Brita model you have. The standard pitcher is not certified for PFAS. The Elite and Hub are certified for PFOA and PFOS, though independent tests have found their real-world PFAS reduction well below the certified figure, and neither addresses the full PFAS family covered by the EPA’s 2024 rule.
For a broader PFAS spectrum or contaminants like arsenic, uranium, chromium-6, or nitrate, a pitcher filter is the wrong tool. Reverse osmosis systems certified under NSF/ANSI 58 and dedicated PFAS-certified filters from other manufacturers performed substantially better in the independent testing cited above. Match the certification to the contaminant, and check the Performance Data Sheet for the specific model rather than the brand.
