What Customers Say Happened
Complaints follow a recurring pattern. A seasonal or full-time salesperson offers a “today only” neighborhood promotion with a discounted initial treatment. The customer signs on a phone screen, often without reading a full contract. Months later, when they try to cancel, they learn they are on an 18- to 24-month commitment and owe a cancellation fee reported anywhere from $175 to $275, plus any accumulated monthly charges.1Law for People. A Clovis, California, homeowner named Caroldean Ross told a local television station that a Brooks salesperson handed her his phone, enlarged the signature area, and told her she was signing “to get the appointments scheduled.” She said she was never shown a contract and did not know she had committed to a year. After a single treatment in June, she was billed $49 per month for services she said she never received, and was quoted a $275 cancellation fee on top of the accumulated charges. Brooks holds a B+ rating from the Better Business Bureau and has accumulated 226 complaints over the past three years, 195 of them closed in the last twelve months. The largest categories are service and repair issues, order issues, and billing disputes. Some customers who filed bank chargebacks reported the company added $35 to $70 in dispute fees. Your California Cancellation Rights
Independent of any lawsuit, California’s Home Solicitation Sales Act (Civil Code sections 1689.5 through 1689.13) gives you three business days to cancel a door-to-door purchase of $25 or more, with no penalty. The seller must tell you about this right verbally and provide two copies of a written cancellation notice at the time of sale. The Wage Cases
Two employment lawsuits have been filed against Brooks in Los Angeles County Superior Court. The first, Clyde Davis Morrison II v. Brooks Pest Control, Inc. (case number 23STCV22466), was filed in September 2023 under California’s Private Attorneys General Act. A second wage case, Matthew Perez v. Brooks Pest Control, Inc., was filed in May 2024 and alleged failure to pay minimum wages, failure to pay overtime, failure to provide meal and rest period premiums, and failure to pay timely final wages.7Trellis Law.
