California exempt license plates are special plates the DMV issues to vehicles owned or leased by government agencies and a small group of qualifying emergency-response organizations. Under California Vehicle Code 9101, these vehicles skip most registration and weight fees because one arm of government generally doesn’t charge fees to another.1California Legislative Information. California Vehicle Code 9101 The plates look different from regular ones, they don’t renew annually, and they come with rules about how the vehicle can be used.
Who Qualifies
CVC 9101 waives fees for vehicles “operated by the state, or by any county, city, district, or political subdivision of the state, or the United States.” That covers state departments like Caltrans and the California Highway Patrol, state universities, county sheriff’s offices, city public works fleets, municipal transit, water and school districts, and similar public entities. The exemption also applies to vehicles these agencies lease, provided the lease gives the agency possession for at least 30 consecutive days.1California Legislative Information. A handful of non-government organizations also qualify. The California Department of Tax and Fee Administration identifies public and voluntary fire departments, the American Red Cross, and the Civil Air Patrol as eligible.2California Department of Tax and Fee Administration. Exempt License Plates Public safety and emergency response are the common thread. Having 501(c)(3) status alone doesn’t qualify a nonprofit.
Which Fees Are Waived, Which Are Not
The waiver is broad but not total. Qualifying vehicles are excused from registration fees, weight fees, and most other Vehicle Code charges. CVC 9101 carves out fees “not exempted under Section 9103,” meaning certain costs remain.1California Legislative Information. California Vehicle Code 9101
Per the DMV’s procedures, agencies still pay for replacement plates and duplicate documents, and use tax is collected when it applies.3California State Department of Motor Vehicles. 11.070 Exempt Vehicles (VC 5600) A fire department that loses a plate pays for a new one. A county that buys a used truck from a private seller owes use tax on the purchase.
How to Spot One
The clearest tell is the missing registration sticker. CVC 4155 says exempt plates “need not display the year number” but must show “a distinguishing symbol or letter.”4California Legislative Information. California Vehicle Code 4155 Where a personal plate has the colored month-and-year tab, an exempt plate has a blank corner or a symbol.
State-owned vehicles typically show a small diamond ahead of the plate number, setting them apart from county or city vehicles, which use a standard alphanumeric sequence without the diamond. The word “EXEMPT” or an abbreviation may also appear on the plate face. Special construction equipment and cemetery equipment that qualify as exempt don’t need to display the distinguishing symbol at all.4California Legislative Information. California Vehicle Code 4155
No Annual Renewal
Exempt registration works differently from ordinary registration. Under CVC 4155, registration for an exempt vehicle “shall not be renewed annually but shall remain valid” until the DMV suspends, revokes, or cancels the certificate, or until any ownership interest transfers.4California Legislative Information. California Vehicle Code 4155 No annual notices, no renewal fees, no late penalties. Registration stays valid as long as the qualifying agency owns the vehicle.
The DMV keeps a separate record of exempt-plated vehicles, and that record isn’t open to public inspection.5California Legislative Information. California Vehicle Code 5003 Looking up the registered owner of a government exempt plate the way you might a private plate isn’t possible.
How Agencies Apply
A qualifying agency or organization submits an Exempt License Plate Request (REG 5050) to the DMV. The form is both the application and the certification that the vehicle qualifies.3California State Department of Motor Vehicles. 11.070 Exempt Vehicles (VC 5600) Private individuals can’t file it.
When an exempt vehicle passes from one qualifying agency to another, the purchasing agency files a new REG 5050 and the existing plates can stay on the vehicle. Fees and penalties that accrued before the new agency took possession are waived.3California State Department of Motor Vehicles. 11.070 Exempt Vehicles (VC 5600)
What the Plate Doesn’t Get You
An exempt plate is a registration status, not a pass on traffic law. Speed limits, signals, and right-of-way rules apply to a government car the same as they do to yours. A few areas cause the most confusion.
Tolls
An exempt plate alone doesn’t waive tolls. CVC 23301.5 creates a narrow toll exemption that applies only to authorized emergency vehicles when all of the following are true at once:
- The vehicle has an exempt California plate and is visibly marked as an emergency vehicle with external red or blue warning lights and agency identification like “Fire Department,” “Sheriff,” “Police,” or “Ambulance.”
- The vehicle is actively responding to or returning from an urgent or emergency call, or covering a fire station assignment tied to an emergency response.
- The driver has determined that using the toll facility will improve response or arrival time.
Even then, emergency vehicles returning from a call aren’t exempt from tolls on high-occupancy toll (HOT) lanes. A parks department truck or a building inspector’s sedan with exempt plates gets no toll exemption at all. If a toll operator questions whether a trip was truly an emergency, the agency head or fire chief can certify in writing that the vehicle was responding to an emergency, and the toll operator must accept that letter in place of payment.6California Legislative Information. HOV Lanes
Exempt plates don’t grant single-occupant access to HOV lanes. Emergency and response vehicles may use them with one occupant under certain operational conditions, but that comes from the vehicle’s emergency status, not the plate.7California Highway Patrol. HOV and HOT Lane Information A county administrator driving alone follows the same occupancy rules as everyone else.
Smog Checks
Government vehicles aren’t excused from smog inspection. The Bureau of Automotive Repair confirms that government vehicles meeting the standard criteria still need a Smog Check.8Bureau of Automotive Repair. When a Government Vehicle Is Sold to a Private Buyer
This is where private buyers most often get caught out. When an agency sells an exempt-plated vehicle to an individual or business, several things happen together:
- The exempt plates must be surrendered to the DMV, and regular-series plates are issued to the new owner.4California Legislative Information. California Vehicle Code 4155
- Full-year registration fees, a transfer fee, and any other applicable charges apply from the moment the vehicle leaves government hands.3California State Department of Motor Vehicles. 11.070 Exempt Vehicles (VC 5600)
- If the vehicle came from a state agency, a permit from the Department of General Services, Caltrans, or the California State University system is required before the DMV will process the transfer.3California State Department of Motor Vehicles. 11.070 Exempt Vehicles (VC 5600)
- Use tax is collected at transfer if it applies.
The buyer has 20 days to complete registration and pay the full fees before standard penalties start accumulating.3California State Department of Motor Vehicles. 11.070 Exempt Vehicles (VC 5600)
Federal Vehicles Follow a Different System
Federal vehicles don’t use California exempt plates. Under 41 CFR Part 102-34, federal motor vehicles must display U.S. Government license plates, be marked “For Official Use Only,” and identify the owning agency, with a letter code before the plate number for that agency. Certain federal vehicles, such as those used for law enforcement, intelligence, or investigative work, run on ordinary state plates instead under limited exemptions from the marking rules.9eCFR. Official Use Only
Exempt-plated vehicles are for official business, not personal use. For federal employees, willful misuse of a government motor vehicle can result in suspension of at least one month up to and including termination, and the violation may be referred to the Attorney General for criminal prosecution.10eCFR. 41 CFR 102-34.225 – How Are Federal Employees Disciplined for Misuse of Government Motor Vehicles California state and local agencies enforce their own personnel policies for vehicle misuse, which vary by employer. The exempt plate marks a taxpayer-funded vehicle, and agencies treat violations accordingly.
