CA Legal 10mm Handguns: Roster, Off-Roster, and CCW

Owning a 10mm handgun in California is legal. The state doesn’t ban any caliber, and roughly 15 to 20 California legal 10mm handguns from makers like Glock, Colt, and European American Armory sit on the Department of Justice’s approved list right now.¹ The catch is everything around the gun itself: which specific models a dealer can sell you new, how many rounds your magazine can hold, how you buy ammunition, and how you store and carry the pistol. None of those rules single out the 10mm, but several of them bite harder on this caliber than on more common ones.

Which 10mm Models You Can Buy New

California maintains a Roster of Certified Handguns under Penal Code § 32015, and only listed models can be sold new by a licensed dealer. A pistol lands on the roster after the manufacturer submits it for drop and firing tests and the DOJ finds it “not unsafe” under Penal Code § 31910.²³

The listed 10mm options are almost all older Glock, Colt, and EAA designs that were grandfathered in years ago.¹ The reason no new models get added is a three-feature requirement: a loaded chamber indicator, a magazine disconnect, and microstamping capability that etches the pistol’s make, model, and serial number onto each fired case. Microstamping is the real bottleneck. Almost no manufacturer builds it in, so the roster shrinks as companies stop paying the DOJ’s annual renewal fee to keep older models listed.

A narrow carve-out exists for single-action revolvers with a barrel of at least three inches, an overall length of at least seven and a half inches, and a capacity of five rounds or more, and for true single-shot pistols meeting their own dimensional thresholds. A few single-action 10mm revolvers can qualify.⁴

The 10-Round Magazine Cap

California treats any magazine that accepts more than ten rounds as a “large-capacity magazine,” and manufacturing, importing, selling, buying, or possessing one is illegal for most people.⁵⁶ This lands hard on 10mm shooters because the full-size platforms popular elsewhere, notably the Glock 20, ship with 15-round magazines standard. In California you need a version that comes with 10-round magazines, or aftermarket 10-rounders.

Penalties depend on the conduct. Selling or importing a large-capacity magazine can bring up to a year in county jail or a state prison term. Simple possession is charged as either an infraction with a $100 fine per magazine or a misdemeanor carrying up to a year in jail plus $100 per magazine.⁶ Before you walk out of a shop with a new 10mm, confirm every magazine in the box holds no more than ten rounds.

How to Buy a Roster 10mm

You need a Firearm Safety Certificate first. The FSC comes from passing a written test with a DOJ-certified instructor, costs $25, and is valid for five years. Most gun shops give the test on-site.⁷

With a valid FSC, buying an on-roster 10mm from a dealer runs through the Dealer’s Record of Sale process. The state fees total $37.19, and a mandatory 10-day waiting period follows the paperwork before the dealer can hand you the gun.⁸⁹ There are no exceptions for repeat buyers.

You’re also limited to one firearm purchase per 30 days. That cap originally applied only to handguns and now covers rifles and shotguns too. If you bought any firearm in the past 30 days, you can’t take home a 10mm yet.⁸

Dealers must also include or sell you a DOJ-approved locking device with the purchase.¹⁰

Getting an Off-Roster 10mm

The roster restricts what dealers can sell new. It doesn’t stop you from owning off-roster models acquired through two other channels.

Private Party Transfer

A California resident who already owns an off-roster 10mm can sell it to another California resident through a licensed dealer, with both parties appearing in person. The dealer can charge up to $10 per firearm for handling, on top of the $37.19 DROS fee. The 10-day wait and background check still apply.⁸ Because supply is capped by whatever is already in the state, off-roster 10mm pistols often command premium prices.

Intrafamilial Transfer

Transfers between parents, children, and grandparents don’t require the handgun to be on the roster, and the family member can be out of state. The recipient needs a valid FSC and must file the Report of Operation of Law or Intra-Familial Firearm Transaction (Form BOF 4544A) with the DOJ within 30 days, along with a $19 processing fee.¹¹ Siblings, aunts, uncles, and cousins don’t qualify and have to use the private party route.

Buying 10mm Ammunition

Every ammunition sale in California has to happen face-to-face through a licensed vendor. You can order 10mm online, but it ships to a California vendor who processes the transfer in person. No direct-to-door delivery.¹²

The vendor runs a DOJ background check at the counter. If you already have a firearm registered to you in the state’s Automated Firearms System, the standard check usually clears in seconds and costs $1. If you don’t, the DOJ runs a fuller eligibility check that costs $19 and can take several business days.¹³ First-time buyers get caught by the longer version most often.

Transporting a 10mm

In a vehicle, the handgun must be unloaded and inside a locked container. The trunk counts. The glove box and center console do not. A hard-sided pistol case secured with a padlock, key lock, or combination lock qualifies; a zippered soft case alone doesn’t, because it lacks a locking device.¹⁴

The locked-container rule also covers the walk between your vehicle and your destination. Crossing a parking lot with a 10mm in a holster or waistband, even unloaded, violates the law unless you hold a valid CCW.

Carrying With a CCW

Carrying a loaded, concealed 10mm in public requires a Concealed Carry Weapon license issued by your county sheriff or local police chief. California doesn’t restrict specific calibers, so a 10mm qualifies if it’s listed on your permit. Applicants must be at least 21, demonstrate good moral character, complete a state-mandated training course, and go through a background investigation that can take several months.

California’s sensitive-places law, enacted through Senate Bill 2, tried to ban concealed carry in a long list of locations including parks, public transit, libraries, and places of worship. Federal courts have partially blocked enforcement. Some restrictions have been upheld and others enjoined as litigation continues through the Ninth Circuit, so check the current status of the injunctions before relying on the right to carry in any specific public location.

Safe Storage Exposure

California imposes criminal liability when a firearm owner stores a gun where a child could access it, graded by what happens next:

First-degree criminal storage applies when a child accesses the firearm and causes death or serious injury. It’s a wobbler: prosecutors can charge it as a misdemeanor (up to one year in county jail, up to $1,000 fine) or a felony (16 months, two years, or three years in state prison, up to $10,000 fine).
Second-degree criminal storage applies when a child accesses the firearm and takes it to a public place or brandishes it. Misdemeanor, up to one year in jail and up to $1,000.
Third-degree criminal storage applies when you negligently store a firearm where you know a child could access it, regardless of whether any harm results. Misdemeanor.¹⁵

A California-approved firearm safety device or DOJ-approved lock box removes the exposure.

Hunting With a 10mm

The 10mm is a common handgun choice for wild boar and other medium game, and California allows handgun hunting for many species. The rule to plan around is the statewide lead-ammunition ban. Since July 1, 2019, any ammunition used to take wildlife anywhere in the state must be non-lead, defined as one percent lead or less by weight, on both public and private land.¹⁶

Certified non-lead 10mm loads are available from Barnes, Federal, Hornady, Lehigh Defense, and others, though they cost more per round than standard jacketed hollow points and your local shop may not stock them.¹⁷

Wildlife officers can inspect all ammunition you have while hunting. If your 10mm can fire lead, you can’t also have lead 10mm rounds on your person, with one exception: ammunition in a concealed handgun carried for personal protection is exempt from the possession ban.¹⁶ Keeping hunting and carry ammo clearly separated avoids trouble during a field check.
