California automatic voter registration at the DMV means that when you apply for, renew, or update a driver’s license or state ID, the DMV sends your information to the Secretary of State and you are registered to vote unless you affirmatively decline. What Triggers Registration
Three kinds of DMV transactions feed the program: applying for a new driver’s license or state ID card, renewing an existing one, and submitting a change of address.2CalMatters Digital Democracy. AB 1461 Voter Registration – California New Motor Voter Program Once you finish the transaction, the DMV electronically transmits your name, residence address, mailing address, date of birth, driver’s license or ID number, and party preference (if you gave one) to the Secretary of State.3California Legislative Information. The Secretary of State, not the DMV, makes the final call on eligibility before your registration is added to the rolls.4California Legislative Information. California Elections Code ELEC 2263
Who Is Eligible
To be registered through the program, you have to attest during your DMV transaction that you meet California’s voter eligibility rules: U.S. citizen, California resident, at least 18 by Election Day, and not currently serving a state or federal prison term for a felony conviction. If you don’t attest, the DMV does not transmit your information at all, and nothing happens to your voter status.5California Secretary of State. California New Motor Voter Program
The statute also carves out one category by design. Records for licenses issued under Vehicle Code section 12801.9, which are available to applicants who cannot show that their presence in the United States is federally authorized, are never sent to the Secretary of State. How to Decline or Cancel
Every qualifying DMV transaction gives you a chance to affirmatively decline voter registration. If you check that box, the DMV records the choice and you are not registered.6California Legislative Information. California Elections Code ELEC 2262 The Secretary of State may send you one notice within three weeks confirming that you declined, along with instructions for registering later by mail or online if you change your mind. If you were automatically registered and later decide you don’t want to be, you can cancel your registration at any time through the Secretary of State’s website or by contacting your county elections office.
Party Preference
The DMV transaction asks whether you want to state a political party preference. If you name one, it goes on your registration. If you leave it blank, you are recorded as “No Party Preference.”3California Legislative Information. California Elections Code ELEC 2265 That designation matters in primary elections: some California parties let No Party Preference voters take part in their primary, others do not. You can change your party preference any time through the Secretary of State’s online portal.
Pre-Registration at 16 and 17
The program covers minors too. A 16- or 17-year-old who applies for a driver’s license or ID and does not opt out has their information transmitted like any adult. Privacy Protections
Your choice to register or decline is confidential and can only be used for voter registration purposes.8California Secretary of State. Chapter 2 – Voter Registration at Department of Motor Vehicles The DMV also will not transmit records with a home address flagged as confidential under Vehicle Code protections for people like law enforcement officers and domestic violence victims.4California Legislative Information. Once you are on the voter rolls, additional confidentiality protections apply to specific categories of people: victims of domestic violence, sexual assault, or stalking; reproductive health care providers, employees, volunteers, and patients; public safety officers; and anyone granted a court order based on a life-threatening circumstance.9California Legislative Information. How This Differs From the Federal Motor Voter Act
The federal National Voter Registration Act of 1993 already required every state DMV to offer a voter registration form during driver’s license transactions.10Office of the Law Revision Counsel. 52 USC 20504 – Simultaneous Application for Voter Registration and Application for Motor Vehicle Drivers License Under that federal rule, you had to affirmatively fill out and sign the form to get registered. California’s law flipped the default. Now the action required is the opt-out, not the opt-in. If you do nothing and you are eligible, you are registered.
